BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING OCTOBER 3, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, October 3, 2017, with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Albert Kirkland was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Minister Chris Jones, Westgate Church of Christ, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of September 19 and September 26, 2017, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming October 8-14, 2017 as “Fire Prevention Week.” Fire Chief Larry Williams was present for the proclamation. Chief Williams and Fire Marshal/Battalion Chief Chris Etheredge presented 2017 Member of the Year Fire Department Awards to Firefighter Tyler McClenny, Rookie of the Year; Sergeant Todd Phillips, Sergeant of the Year; and Captain Chris Clayton, Fire Officer of the Year. Firefighter Jeff Posey (not present) received the award of Firefighter of the Year. Commissioner Dorsey thanked everybody for their calls, texts, and prayers throughout his recent illness from which he is still recovering, and he gave a special thanks to General Services Director Randy Morris and his staff for the new Commission Chamber chairs. Commissioner Dorsey said Executive Assistant Sarah Woodham’s brother passed away Sunday, and he asked everyone to keep her in their prayers. Commissioner Kenward thanked everybody who participated in the “Paws for a Cause” event on Thursday, September 28th at the Civic Center. She said over $20,000 was raised and all sixty dogs went home with loving families. She said this was a wonderful event that may even become an annual affair. Mayor Saliba thanked Sarah Woodham and all involved with orchestrating the swearing-in ceremony last night. He said the ceremony went well and was beautifully done. City Manager West made the following announcements and comments:  The Eastgate Park pond will be closed until Friday, October 13th for maintenance and restocking.  “Take a Kid Mountain Biking” Day is being held on Saturday, October 7th beginning at 9:30 a.m. at the Forever Wild Trails at Beaver Creek. This event is presented by the Southeast Alabama Mountain Bikers Club and Dothan Leisure Services. Riding these trails is a lot of fun, and everyone is invited to attend.  “Youth Fishing Day” will take place on Saturday, October 7th from 9:00 a.m. until 11:30 a.m. at Eastgate Park. This is a wonderful event and it is always great to see the joy on the kids’ faces as they reel in catfish. Minutes of the Board of Commissioners – October 3, 2017, continued.  A “How to Do Business with the City of Dothan” seminar will be held in the Commission Chambers this afternoon starting at 5:30 p.m. with a social. Purchasing Agent Charlotte Langford and other staff members will assist attendees with understanding our bid laws and procedures. This event is held twice per year and allows us to reach out to our local businesses.  The first public brownfield meeting will be Wednesday, October 18th at 1:00 p.m. in the Board Room of the Civic Center. ADEM and the EPA will have representatives present. Anyone interested in the brownfield assessment grant is invited to attend.  Saturday, October 14th is the Mayor’s Cross Country Challenge Cup at Eastgate Park Soccer Field. Registration is at 9:00 a.m. and the Cup goes to the school with the most participants.  Circle City BMX hosted the 2017 Gold Cup Southeast Championship this past weekend. This was a great event for our community, and there was a big crowd in attendance.  The “Paws for a Cause” event was great and raised over $20,000.00. At this time, City Manager West invited Police Chief Steve Parrish to make an announcement. Chief Parrish said the Police Department received a $5,000.00 check yesterday from the Jack Hanna Columbus Ohio Zoo for the Dothan Animal Shelter. He said this was in response to the donation of the birds and is a very benevolent gesture. Chief Parrish said the birds came a long way during this process, and he gave kudos to Big Bend Wildlife Refuge in Level Plains for doing an excellent job. He said three of these Macaws are on the extreme endangered list, the Zoo is very thankful, and we are glad to have this contribution from them. City Manager West announced that for every year he has been city manager the volunteers who worked on the United Way campaign for the City have exceeded their goal, and this year they have received pledges of $75,599 which is six percent above their goal! He thanked United Way Team Leader Chris Etheredge and all of the people who worked on this campaign for another great year and for doing such a good job. Mayor Saliba thanked Chris and everyone who contributed to the United Way. Mayor Saliba introduced the application of Chun Huang for a Restaurant Retail Liquor License (On Premise) for Ichiban Buffet and Grill, located at 4863 Montgomery Highway, Suite 300. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kenward moved for approval, motion seconded by Commissioner Crutchfield. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced Ordinance No. 2017-314 (recorded in Ordinance Book No. _______at Page_______), rezoning a parcel of land owned by Crossroads Baptist Church, located at 2574 Westgate Parkway from R-1 (Low Density Single- Family Residential) District to B-3 (Local Shopping) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Dorsey and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2017-314, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2017-315 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a Minutes of the Board of Commissioners – October 3, 2017, continued. public hearing to be held on the matter during the regularly scheduled commission meeting on October 17, 2017. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-316 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Numbers 2017-235, 2017-264, 2017-266 and 2017-296 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said he receives many phone calls regarding this process, and would like to take this time to provide some information for the public. He explained that costs are assessed for public notice signs, for newspaper advertisement fees, and for cleanup if the City has to bring the property into compliance. Once assessed, these costs are sent to the county to be added to the next property tax bill, and if the bill is not paid, the county will become the owners of the property. Commissioner Dorsey expressed that he wants to continue putting this information out to the public in order to keep citizens informed of the process and aware of the importance of keeping lots cut. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-317 (recorded in Ordinance Book No._______at Page_______), agreeing to aid Orlando Utilities Commission, a member of the American Public Power Association serving the City of Orlando, Florida, in its efforts to recover from the devastation left by severe weather due to Hurricane Irma on September 10, 2017. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward. City Manager West said there were so many volunteers who wanted to help that the City could have doubled the amount of employees sent, and he is very proud of them for this response. He said it is wonderful to see all of the social media posts and pictures being shared of Dothan Utilities restoring power in these areas. Mayor Saliba also expressed his appreciation for Dothan Utilities and their response. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-318 (recorded in Ordinance Book No._______at Page_______), agreeing to aid Lakeland Electric, a member of the American Public Power Association serving the City of Lakeland, Florida, in its efforts to recover from the devastation left by severe weather due to Hurricane Irma on September 10, 2017. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-319 (recorded in Ordinance Book No._______at Page_______), approving Change Order No. 1 to amend the contract with Donald Smith Company, Inc. to include the removal and inspection of Well No. 29 (116 Harmony Lane). Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said the funds are available within the current contract to pay for this and there will be no additional costs associated with this amendment. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-320 (recorded in Ordinance Book No._______at Page_______), donating and transferring ownership of twelve (12) blue macaws and four (4) red macaws to the Columbus Zoo and Aquarium, located at 4850 Powell Road, Powell, Ohio. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. Mayor Saliba expressed his appreciation to everyone involved for handling this. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-321 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Southeast Basketball Officials Association to provide certified referees to officiate during the Downtown Hoops Classic Basketball Tournament at a cost of $105.00 per game. Commissioner Ferguson moved for adoption, motion seconded by Crutchfield. Commissioner Fleming provided a breakdown of the cost, and he said the Association should be commended for providing services as this rate. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-322 (recorded in Ordinance Book No._______at Page_______), amending the agreement with York Risk Services Group, Inc. to provide administrative services for the self-insured workers’ compensation program at an approximate yearly cost of $44,700.00 for a period of one (1) year to commence on October 1, 2017, through September 30, 2018; maintain the escrow account balance at a level of $70,000 rather than the current $55,000; and to pay an implementation fee of $25.00 per new claim. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson. City Manager West said this is basically the same agreement we have had in the past, and he clarified for Commissioner Crutchfield that the escrow amount is being raised because the costs of claims go up as medical costs increase. Commissioner Ferguson asked if the $25.00 implementation fee is new, and City Manager West replied that it is not. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-323 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Enterprise State Community College through its Southeast Alabama Highway Safety Office for participation in the Alabama Department of Economic and Community Affairs Law Enforcement Traffic Safety Grant Program. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-324 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Organized Crime Drug Enforcement Task Forces (OCDETF) Program for reimbursement of overtime expenditures related to the Organized Crime Drug Enforcement Task Force in the amount of $5,000.00, and appropriating funds for said program. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-325 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $6,500.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center (ACJTC) in Selma, Alabama. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Dorsey asked how many officers is this, and Chief Parrish responded that there are five officers currently at the ACJTC. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-326 (recorded in Ordinance Book No._______at Page_______), appointing Mark Saliba as a Member of the Southeast Alabama Gas District Board. Commissioner Fleming moved for adoption, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none; “abstained:” Saliba. The motion was carried by the majority of five "yeas" to one “abstention.” Mayor Saliba introduced Resolution No. 2017-327 (recorded in Ordinance Book No._______at Page_______), appointing Larry Patrick as a Member of the Recreation Board. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Ferguson. Mayor Saliba recognized Larry Patrick in the audience, and the Commission thanked him for his service. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-328 (recorded in Ordinance Book No._______at Page_______), appointing Randy Morris as a City of Dothan representative on the City of Dothan-Houston County Communications District Board.
