BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING DECEMBER 19, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, December 19, 2017 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. City Clerk Tammy Danner was absent. Mayor Saliba called the meeting to order. Reverend Lynn Nesbitt, First United Methodist Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of December 5, 2017, be approved, motion seconded by Commissioner Crutchfield and unanimously approved. Commissioner Dorsey wished Happy Holidays to everyone and said to enjoy your family to the fullest. Commissioner Fleming thanked Community Relations Specialist Cassandra Milton and Executive Assistant Sarah Woodham for their help with fliers for an event taking place from noon until 2:00 p.m. on Saturday, December 23rd in partnership with S.P.I.N.N. (Single Parents In Need Nationally). He said this event will center around a job fair and provide a meal for the residents of Henry Green Apartments, Ussery Apartments, and Marvin Lewis Apartments. He thanked Personnel Director Delvick McKay and EEO Officer Darryl Mathews for their involvement with the job fair at the previous event held for the residents of McRae Homes, and he said he thinks this one will be a success as well. He said the Fire Department and the Police Department came out last time, and it was wonderful. Commissioner Kirkland wished everyone a Merry Christmas and a Happy New Year. He said he has enjoyed working with everyone this year, and he wants everyone to have a safe and happy holiday. Commissioner Ferguson recognized that this is Public Works Director Jerry Corbin’s last Commission meeting and said he would like to thank him for his great leadership. He said he is going to miss Mr. Corbin, and he wishes him all the best for a long, healthy, and happy retirement. Commissioner Ferguson wished everyone a Merry Christmas. Commissioner Kenward thanked the Dothan Utilities Department and the General Service Department for the Christmas lights around the City. She said they look great, and she has received lots of positive comments from our citizens. She wished everyone a Merry Christmas. Commissioner Crutchfield thanked Police Chief Steve Parrish and Corporal John Chesser for their participation and help with the organization of Brentwood Subdivision’s Neighborhood Watch. He said there have been some meetings and questions have been answered. He said Electric Operations Superintendent Chris Phillips assisted as well, and he expressed appreciation for the response given to citizens when they have issues. Commissioner Crutchfield wished everyone a Merry Christmas, and he wished Mr. Corbin a happy retirement. Minutes of the Board of Commissioners – December 19, 2017, continued. Mayor Saliba recognized and thanked Leisure Services Director Elston Jones and the Therapeutic Recreation Program for putting on the Talent Show each year for our community’s special needs citizens. He said this is an awesome program and he was blessed to attend the show on Saturday, December 16th. Mayor Saliba wished everyone Happy Holidays and a Merry Christmas. Mayor Saliba announced that there will be an amendment to Item No. 28 and appropriate action will be taken at that time. City Manager West presented a retirement certificate to Public Works Director Jerry Corbin, and he expressed appreciation for everything he has done. He said Mr. Corbin is someone he admires and respects, he thanked him for being a great department head and friend, and he said he is really going to miss him. City Manager West, along with Police Chief Steve Parrish, Captain Bubba Ott, and Public Safety Communication Center Manager Kayla Owens presented service awards to Sandra Jarrett for twenty-five years of service with the City and Anna Kelly for twenty-five years of service with the City. City Manager West invited Police Chief Steve Parrish and Captain Bubba Ott to make a check presentation. Chief Parrish discussed the Police Department’s modified version of the “No Shave November” fundraiser to raise money for Children’s of Alabama. He said the department reached their goal last year and this year the goal was raised to $25,000. Captain Ott provided details of the fundraiser, and he expressed appreciation to everyone who contributed. The top fundraisers were also present and were recognized. Chief Parrish and Captain Ott presented a check in the amount of $27,116 to Carmen Maddox with Children’s of Alabama. Ms. Maddox said on behalf of Children’s and the Alabama Center for Childhood Cancer she would like to thank the officers and our community for coming together to raise such an amazing amount. She explained that this money will go to the Hope and Cope Program which provides support and services to families from the first point of diagnosis on, and she said this Program is made possible through fundraising. City Manager West made the following announcements and comments:  The Troy University Men’s basketball team will play Milligan College in the Civic Center arena at 6:00 p.m. on Thursday, December 21st. Fans are encouraged to come out and show their support.  The Downtown Dothan Hoops Classic starts on Tuesday, December 26th and runs through Saturday, December 30th in the Dothan Civic Center arena. So far, this tournament has raised over $400,000 which has been given back to the participating schools. Come out and support this event.  Dothan Utilities will begin accepting Christmas trees for recycling at their facility off of South Park Avenue on Tuesday, December 26th.  City of Dothan offices will be closed Monday, December 25th, Tuesday, December 26th, and Monday, January 1st in observance of the Christmas and New Year’s holidays. Regarding the sanitation schedule, Monday residents will receive garbage and recycling pick-up on Wednesday, December 27th and Wednesday, January 3rd. Garbage and recycling will run as normal on Tuesday, December 26th. There will be no trash collection on December 25th, December 26th or January 1st, and there is no make-up day for trash.  The January 2, 2018 City Commission meeting will be cancelled as some Commissioners will be out, and at this point in time, there is very little on the agenda for that day. Mayor Saliba introduced the application of Kenneth Mourton for a Wholesale Table Wine and Beer Combined License for United Distributing, located at 1158 Jordon Avenue. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced Ordinance No. 2017-413 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Jearld Vinson, located at 634 S. Shady Lane from R-1 and A-C (Low Density, Single – Family, Residential) and (Agriculture-Conservation) Districts to B-2 (Highway Commercial) District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2017-413, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Ordinance No. 2017-414 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by the Dothan Downtown Redevelopment Authority, located at 408, 410, and 426 E. Newton Street from B-1 and L-I (Central Business) and (Light Industry) Districts to PUD (Planned Unit Development) Preliminary Plan Rezoning. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2017-414, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2017-415 (recorded in Ordinance Book No._______at Page_______), appointing Charles E. Metzger as Public Works Director, at an annual salary of $132,040.48, effective January 1, 2018. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Mayor Saliba said he has heard the comment a lot lately that he’s got big shoes to fill, so he’ll pass that along to Mr. Metzger! There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-416 (recorded in Ordinance Book No._______at Page_______), de-annexing property owned by Harry Wayne Parrish, located at 5270 Fortner Street, from the city limits of Dothan, Alabama. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Kenward, and Crutchfield; “nay:” Ferguson. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Saliba introduced Resolution No. 2017-417 (recorded in Ordinance Book No._______at Page_______), vacating a portion of the right-of-way of Sylvania Road to the use of the public as a street right-of-way. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-418 (recorded in Ordinance Book No._______at Page_______), appropriating $150,000.00 to the Commercial Development Authority of the City of Dothan for public infrastructure improvements for U.S. Highway 84 East in vicinity of the Southeast Alabama Medical Center and Minutes of the Board of Commissioners – December 19, 2017, continued. Med Park East Development. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, and Kenward; “nay:” Ferguson and Crutchfield. The motion was carried by the majority of five "yeas" to two “nays.” Mayor Saliba introduced Resolution No. 2017-419 (recorded in Ordinance Book No._______at Page_______), submitting an application for a license agreement with Genesee & Wyoming Railroad Services, Inc. in consideration of the sum of $4,000.00 for the purpose of conveying sanitary sewerage under the land and tracks of the railroad at a location near Mile Post 381 in conjunction with the Bell to Foster Sewer Improvements Project. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-420 (recorded in Ordinance Book No._______at Page_______), amending the Supplemental Agreement with CDG Engineers & Associates, Inc. for professional engineering services for ROW Acquisitions for the additional roadway lanes to CR-25 (Denton Road) from SR- 210 (Ross Clark Circle) to Westgate Parkway, Project No. STPOA-9450 (602) for an amount of $55,912.00, thereby increasing the original contract amount to $231,238.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming. Commissioner Dorsey said he is thankful this is a local contractor because it is good to keep the money here in the city of Dothan. Commissioner Ferguson confirmed with City Manager West that this is to eventually five lane this section of Denton Road. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-421 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation to replace approximately 80 L.F. of 10” sanitary sewer line with a 12” sanitary sewer line within a 22” steel casing by the jack and bore method within the ROW of S. Oates Street (U.S. Highway 231 South). Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-422 (recorded in Ordinance Book No._______at Page_______), agreeing to allow the Fire Department to issue a fireworks permit for the Dothan Downtown Redevelopment Authority Fireworks Display to be held on Sunday, December 31, 2017. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-423 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Alfred Saliba Family Services Center to provide funding for administrative salaries, fringe benefits and operational expenses in the amount of $12,500.00 identified in the Community Development Block Grant 2017 Annual Action Plan, and appropriating funds for said agreement. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey. Mayor Saliba abstained from voting on this item because he has served on the board before. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none; “abstained:” Saliba. The motion was carried by the majority of six "yeas" to one “abstention.” Mayor Saliba introduced Resolution No. 2017-424 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Boys and Girls Club of the Wiregrass to provide funding for administrative salaries, fringe benefits, and operational expenses in the amount of $6,000.00 identified in the Community Development Block Grant 2017 Annual Action Plan, and appropriating funds for said agreement. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-425 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Minutes of the Board of Commissioners – December 19, 2017, continued. Boys and Girls Clubs of Hawk-Houston to provide funding for administrative salaries, fringe benefits, and operational expenses identified in the Community Development Block Grant 2017 Annual Action Plan in the amount of $18,009.00, and appropriating funds for said agreement. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-426 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Exchange Center to provide funding for administrative salaries, fringe benefits and operational expenses identified in the Community Development Block Grant 2017 Annual Action Plan in the amount of $11,000.00, and appropriating funds for said agreement. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-427 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with Girls, Inc. to provide funding for administrative salaries, fringe benefits and operational expenses in the amount of $7,500.00 and HVAC Improvements identified in the Community Development Block Grant 2017 Annual Action Plan in the amount of $28,041.00, and appropriating funds for said agreement. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-428 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Wiregrass Habitat for Humanity to support Emergency Housing Repair in the amount of $80,000.00 and Weatherization Improvements identified in the Community Development Block Grant 2017 Annual Action Plan in the amount of $33,000.00, and appropriating funds for said agreement. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-429 (recorded in Ordinance Book No._______at Page_______), entering into a subrecipient agreement with the Wiregrass Rehabilitation Center for the purpose of purchasing equipment identified in the Community Development Block Grant 2017 Annual Action Plan in the amount of $31,750.00, and appropriating funds for said agreement. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2017-430 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the law firm of Beasley, Allen, Crow, Methvin, Portis and Miles, P.C. to pursue feasible civil remedies for damages to the City of Dothan resulting from the manufacture and/or distribution of opioids in the City of Dothan, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Kenward asked for an explanation of this item for our citizens’ knowledge. City Attorney Len White said this resolution is authorization for the law firm to evaluate what claims the City might have for damages resulting from the distribution of these opioids within the city of Dothan that has impacted us negatively, and if they do determine that there exists a cause of action it will authorize them to pursue damages on behalf of the City. City Attorney White confirmed for Commissioner Kenward that this includes the manufacturers and wholesale distributers of these particular opioids. Commissioner Ferguson asked if the doctors who issue the prescriptions are a part of this, and City Attorney White replied that they are not. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2017-431 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Cox Swimming Pools, Inc. for the Wiregrass Pool Re-Plaster project in the amount of $37,750.00.
