BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JANUARY 16, 2018 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, January 16, 2018 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Albert Kirkland was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Stacy Stafford, Southside Baptist Church, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of December 19, 2017, be approved, motion seconded by Commissioner Crutchfield and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming January 25, 2018 as “Public Education Day for the City of Dothan.” Dothan Education Foundation President Gindi Prutzman, Communications Director Meagan Dorsey, and other representatives were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming January, 2018 as “Human Trafficking Awareness Month.” Gia Hughes and Allison Moody of Hope Rising Ministries were present for the proclamation. Mayor Saliba invited Kody Kirchhoff and Joel Williams from The Harbor, Ken Rice and Pastor Clint Adams from New Freedom Church, and Bob Gross and Ron Bruce from First Baptist Church of Dothan to the podium for recognition of their response in providing warming shelters this season during the extreme cold weather days. Mayor Saliba said it is with great love and compassion that these members, representing a larger group of people, come together to reach out to those citizens in our City that sometimes go unnoticed and do not have shelter and heat. Mayor Saliba said, on behalf of the Commission and the City of Dothan, he would like to personally thank each and every one involved for all that they do and for their response in these times of need. Mayor Saliba also expressed appreciation to Fire Chief Larry Williams and the Fire Department for their part in these efforts. Commissioner Dorsey wished a Happy New Year to the staff and our community here today. He expressed appreciation to Pastor Stafford for this morning’s prayer and to The Harbor for all the great things they do in our community. Commissioner Dorsey thanked Planning Director Todd McDonald and staff for responding to citizen’s concerns regarding the car wash at Flynn Road and Denton Road. Commissioner Dorsey said a little old lady at Johnson Homes known as the “Candy Lady” told him to thank Police Chief Steve Parrish for her for making it safe in her neighborhood. Commissioner Dorsey said he wants to kick this year off right and he’s got a lot of great things coming up. He said they say some people have angels and he knows one of his angels is Dr. Barbara Alford who is here today. He said Dr. Alford is a good lady who is near and dear to his heart. Minutes of the Board of Commissioners – January 16, 2018, continued. Commissioner Fleming thanked Sam Crawford and DeDe Peterson with the Dothan Housing Authority for their assistance with the December 23, 2017 event held in partnership with Vanessa Harris and S.P.I.N.N. (Single Parents In Need Nationally). Commissioner Fleming thanked EEO Officer Darryl Mathews and the City for their involvement with the job fair. He said this event was held at Henry Green Apartments for the residents of a number of apartment complexes and food was also served. Commissioner Fleming invited members of the Girard Middle School basketball team, Head Coach James Ford, Assistant Coach Bernard Anglin, Assistant Coach Anthony Austin, and Principal Darius McKay to come forward to be recognized for having an amazing year. He said the team finished their season undefeated and these students are doing a great job academically as well. Principal McKay said he is extremely proud of what this team has accomplished and what the coaching staff has established with these young men, on and off the basketball court, to include academics and behavior. Commissioner Fleming recognized Marquez White, who attended and played football at Northview High School and Florida State University and is currently with the Dallas Cowboys, as being present in the audience today. Commissioner Kenward said the State of Alabama is in a state of emergency because of the flu outbreak. She requested everyone wash their hands, use sanitizer, and educate those around them until we are out of the state of emergency. Commissioner Crutchfield expressed appreciation to Chuck Harris, who recently stepped down from the Planning Commission after serving twenty-five years, many of those years as Chairman, for his service. He said he wants to thank Mr. Harris and all those in this city that volunteer their time to serve on boards. Commissioner Crutchfield thanked Police Chief Steve Parrish and staff for continuing to work with our neighborhood watch groups and for their quick response to issues. Commissioner Crutchfield said the non-emergency number 793-0215 has been a great asset, and he said citizens can call this number when there is an issue that does not rise to the level of a 9-1-1 emergency. City Manager West invited Reeivice Girtman of the Liberty Learning Foundation to make a presentation. Mr. Girtman spoke about the work being accomplished by the Foundation. He said they focus on teaching children the importance of citizenship and to take ownership of their citizenship. He said they talk about issues such as voting, immigration, financial literacy, honoring our military, careers, patriotism, and character. He said the Foundation is a nonprofit organization, they partner with people all over the state, and they work with municipalities and business leaders. He invited Commission members and the community to attend an event being held Friday, January 19th at 9:00 a.m. at Northview High School. He said the work they do and the resources they provide are at no cost to Dothan City Schools but they do rely on people from the community to help them run their ship. City Manager West invited Amy Anderson with SpectraCare Health Systems to make an announcement. Ms. Anderson announced that a Prescription Drug Take- Back Event will be held on Thursday, January 25th from 9:00 a.m. until 3:00 p.m. at the Sam’s Club Pharmacy. She explained that with recent funding from the Alabama Department of Mental Health, SpectraCare has begun a targeted response to the opioid epidemic, and she discussed the work being done by the organization in further detail. She thanked MedSharp Disposal for their partnership and the Dothan Police Department for recognizing the need for this effort. Upon City Manager West’s request, Fire Chief Larry Williams announced that The Harbor will be open tonight and First Baptist Church will be open tomorrow as warming stations. He said another State of Emergency has been declared as we are under a Winter Weather Advisory for our area and are expecting a half inch or more of snow and ice tonight. He said the City is working on plans to take care of basic infrastructure issues and to make the public aware of warnings. Minutes of the Board of Commissioners – January 16, 2018, continued. City Manager West made the following announcements and comments:  Little League softball and baseball registration is underway and will continue through Saturday, January 20th. Registration is at the recreation centers for the respective leagues, except for James Oates Park registration which is taking place at Doug Tew Recreation Center.  The Troy University Theatre and Dance Department will present the Pied Pipers in the Dothan Opera House at 6:00 p.m. on Tuesday, January 30 th.  There was record attendance again this year at the Downtown Dothan Hoops Classic. This event continues to grow and we are hoping for a significant increase in the money given back to the participating schools.  The Community Development Block Grant applications are available online and the deadline to turn in completed applications is Thursday, March 22nd.  The Highway 84 East Corridor workshop will be held tonight from 6:00 p.m. until 8:00 p.m. at the Wiregrass Museum of Art in the Great Hall. Everyone interested is encouraged to attend to share their concerns or ideas.  The AHSAA South Regional Basketball Tournament will take place February 15th – 21st, and this is always a great event.  City offices were closed on Monday, January 15th in observance of Martin Luther King, Jr. Day. Regarding the sanitation schedule, Monday residents will receive garbage and recycling pick-up on Wednesday, January 17th.  A free bidder’s registration seminar and enrollment event will be held on Tuesday, February 13th in the City Commission Chambers at 9:00 a.m. These events are held several times a year. Mayor Saliba introduced Ordinance No. 2018-1 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Michael Smith, located at 759 North Beverlye Road from H-I (Heavy Industry) District to L-I (Light Industry) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2018-1, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2018-2 (recorded in Ordinance Book No._______at Page_______), requesting that the local legislative delegation introduce legislation, supported by the Dothan Board of City Commissioners, to amend Section 12 of the Civil Service Act. This section refers to hiring individuals above the minimum pay rate increase. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-3 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Numbers 2017-352, 2017-379, 2017-381 and 2017-399 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Minutes of the Board of Commissioners – January 16, 2018, continued. Mayor Saliba introduced Resolution No. 2018-4 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on February 6, 2018. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-5 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Networkfleet, Inc. for all GPS monthly monitoring and equipment. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said this contract will save the City some money and is being done because there has been a change in who has the authority to Verizon GPS. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-6 (recorded in Ordinance Book No._______at Page_______), authorizing the Mayor to execute all forms necessary to ensure successful participation in the 2020 LUCA (Local Update of Census Addresses) operation. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-7 (recorded in Ordinance Book No._______at Page_______), appropriating $100,000.00 to the Dothan Downtown Redevelopment Authority for assistance in funding for the 2018 Foster Fest Expansion Project. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Ferguson pointed out that this is sort of a private/public partnership as the DDRA has raised a significant amount of private dollars to enhance Foster Fest. Commissioner Kenward added that this is in direct response to what our citizens are asking for and the Commission has listened. She said Foster Fest has grown tremendously and it is a major economic stimulator in our downtown area. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-8 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Lewis Construction, LLC, for a New Civic Center Message Board in the amount of $186,500.00, and appropriating funds for said project. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said this amount includes the structure as well as the two-sided LED sign. Commissioner Ferguson said he is glad to see this because the previous sign was lacking in impact. He said this is a good way to communicate and will hopefully remedy some of the complaints from citizens regarding not being aware of events. Commissioner Ferguson confirmed with City Manager West that the sign will be used strictly for City events. Commissioner Kenward advised that citizens can also sign up for numerous City alerts and notifications at www.dothan.org. Commissioner Dorsey pointed out that this is a local contractor and he is glad the money is being kept here in the city of Dothan. Commissioner Fleming asked if there was a specific push from the public to have this sign or is this being done because the other sign did not look good. City Manager West said the sign will help the City get messages out to the public, which will help the events taking place at the Civic Center and Opera House become more successful, and the City will then attract more events. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Ferguson, Kenward, and Crutchfield; “nay:” Fleming. The motion was carried by the majority of five "yeas" to one “nay.” Mayor Saliba introduced Resolution No. 2018-9 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Saliba Construction Co., Inc. for a Regional Public Safety Training Center in the amount of $18,278,100.00, and appropriating funds for said project. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming. Commissioner Dorsey said he is glad to see this money is staying in the community. City Manager West pointed out that the Commission has already approved the bond issue of $17 million and this money is in the bank. Commissioner Kenward said this facility is being done in partnership with the Minutes of the Board of Commissioners – January 16, 2018, continued. Wiregrass Foundation and is one of only a few in the country. She explained that the City is taking on the bond so that the Wiregrass Foundation can partner with us and they will be paying the majority of this cost for us. She expressed what a blessing the Wiregrass Foundation is to the community, and City Manager West added that this is a great opportunity. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba requested a motion to delay the next item in light of Commissioner Kirkland not being here today given that this is in his district and there still being some questions the Commission feels need to be answered. A brief discussion followed with the Commission agreeing to table this item until the next regularly scheduled meeting in three weeks and to hold a work session before that time to make sure everybody has all the information they need. Commissioner Ferguson made a motion to table Item No. 17, awarding the bid, entering into a contract and issuing a Notice to Proceed to Tolleson Construction, LLC, for a New Multi-Purpose Facility at Eastgate Park in the amount of $1,321,934.00, and appropriating funds for said project, until February 6, 2018, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-10 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Motorola for the maintenance and repair of handheld radios and vehicular radios utilizing the Motorola Astro 7.16 800MHz P25 radio system at a monthly cost of $9,440.00. The contract period is January 1, 2018 through December 31, 2019. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West confirmed with Police Chief Steve Parrish that maintenance on our current handhelds will stop on December 31, 2019. Regarding replacements for these radios, Chief Parrish said staff at the radio shop have stockpiled quite a bit and they will make those radios last as long as possible. Chief Parrish noted that this monthly cost will be less the $1,165.00 per month the City receives from Dothan City Schools. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-11 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Southeast Basketball Officials Association to provide a clockkeeper and bookkeeper to officiate during the 2018 South Regional Tournament at a cost of $45.00 per game. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-12 (recorded in Ordinance Book No._______at Page_______), approving a request by the Public Works Department to hire Tommy Wright to fill the position of Traffic Engineer at a starting salary of $3,653.85 bi-weekly or $95,000.00 annually. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-13 (recorded in Ordinance Book No._______at Page_______), amending Resolution No. 2017-374, approved on November 7, 2017, by rescinding Bid #17-061, which awarded the bid to ADS Security for fire alarms. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson. City Manager West explained that ADS Security was the low bidder but they refused to honor the terms and conditions included in the bid. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-14 (recorded in Ordinance Book No._______at Page_______), re-appointing Tony Donelson and Tom Ziegenfelder as members of the Recreation Board and appointing Jason Cosby as a member of the Recreation Board. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-15 (recorded in Ordinance Book No._______at Page_______), re-appointing Albert Kirkland as a member of the National Peanut Festival Association, Inc.
