BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 6, 2018 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, February 6, 2018 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Kevin Knight, First Church of the Nazarene, then led in prayer, afterwhich Commissioner Crutchfield led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of January 16, 2018, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming February 22, 2018 as “Arbor Day.” Dan Williams, Horticulturist, City of Dothan was present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming the City of Dothan lineman training yard as the “John Marse Lineman Training Yard.” Kim Culpepper with the Tennessee Valley Public Power Association, Pam Marse and Family, Dothan Utilities Director Billy Mayes, and Electric Operations Superintendent Chris Phillips were present for the proclamation. Mayor Saliba presented a certificate of recognition to Robert A. “Bob” Hendrix, who is retiring as Executive Director of the Dothan Area Convention and Visitors Bureau (CVB), in appreciation for his eighteen years of service promoting Dothan tourism. CVB Chairman Bill Durden was also present for this recognition. Mayor Saliba announced that there will be an amendment to Item No. 27 and appropriate action will be taken at that time. Commissioner Dorsey said he has visited with some people in public housing, and he asked City Manager West if the City could partner with the Dothan Housing Authority to discuss the possibility and cost of having nurses at every public housing facility in Dothan. Commissioner Fleming thanked Project Manager Melissa McGill, Executive Assistant Sarah Woodham, and City Manager West for their help with providing information and handouts to present to Mrs. Davis’ 4th Grade class at Grandview Elementary School. He said the students, who reside in District 2, wrote him letters and invited him to come explain how government works in Dothan. Commissioner Kirkland said he had a touch of the flu during the last meeting and he is glad to be back. Commissioner Kirkland asked for prayers in the loss of Wayne Taylor, his neighbor, who passed away last night after an illness. Commissioner Ferguson said he received a text this morning about car break-ins in the Trawick Road area. He reminded everyone to please lock your cars every day and do not take for granted that this will not happen to you. Commissioner Ferguson said we have a significant problem with trash and litter on the right-of-ways all over Dothan, and he wants to challenge our Commission to partner with the Houston County Commission to raise awareness as Houston Minutes of the Board of Commissioners – February 6, 2018, continued. County Commissioner Doug Sinquefield has recently mentioned this issue as well. Commissioner Ferguson said he wants us to look at ways to combat this problem and get it under control. Commissioner Ferguson said he would like to ask for prayers for our friend Bryan Nyman, who usually videos our meetings for Scenic Cable, as he has a lot of challenges right now. Commissioner Kenward said she would like to personally thank Bob Hendrix for his commitment to the City, for being creative in his thinking with leisure services to make the best of what we do have, and she agrees with him that we have the best Leisure Services Department in the state. She wished him good luck in his future endeavors. Commissioner Crutchfield said he would also like to thank Bob Hendrix who has done an excellent job. Commissioner Crutchfield thanked the department heads for responding with information and feedback that he has requested over the last couple of weeks, and he expressed his appreciation for their honest responses. Commissioner Crutchfield noted that there are several people in the audience who will be appointed to boards today, and he said we could not do without the volunteers in this community who serve on all these boards. He expressed his appreciation to those who are involved and invited anyone interested in serving to contact their commissioner. City Manager West added that there is a Board Application Form available on the City’s website www.dothan.org for anyone interested in volunteering to request to serve on a board or commission. Mayor Saliba said last week was busy with lots of activity and he noted some of the high points. The groundbreaking for the wiregrass public safety training center was held on Thursday, February 1st. This was a huge event for the city of Dothan and the Wiregrass area, and we will be talking about it for the next eighteen months until we have the moving in celebration. The Black History Month Kick-Off event was also held on Thursday, February 1st at The Carver Museum and there will be events taking place all month. The Southeast Alabama Medical Center held an event to talk about heart and cardiovascular health, and this is very important. Mayor Saliba said he would also like to add his thanks to Bob Hendrix. He said as mayor he knows there is plenty to do in Dothan and a lot of it has to do with the efforts put forth from Mr. Hendrix and the CVB group. Mayor Saliba announced that a big weekend is coming up with the Dothan Downtown Redevelopment Authority’s event Downtown Collide taking place on Friday, March 2nd and Saturday, March 3rd. City Manager West made the following announcements and comments:  A free bidder’s registration seminar will be held on Tuesday, February 13 th at 9:00 a.m. in the City Manager’s Conference Room.  The AHSAA South Regional Basketball Tournament will take place February 15th – 21st at the Civic Center. There will be parking problems so be patient if you are coming to do business or attend the games.  The Community Development Block Grant applications are available online and the deadline to turn in completed applications is Thursday, March 22 nd.  The check presentation for the Downtown Dothan Hoops Classic Tournament was held last week and this year we had a record distribution of $61,440 to the schools. The total amount generated and given back to the schools in the twelve years of this Tournament is now over $480,000, which is quite an accomplishment. Minutes of the Board of Commissioners – February 6, 2018, continued.  The strategic planning session will be February 22nd – 24th and the Commission will meet with Lyle Sumek February 23rd – 24th.  The next session of Dothan 101 will be held April 3rd – May 29th. We have 12 people signed up and the class is capped at 25 so anybody interested needs to go ahead and submit an application. The program is three hours each Tuesday night during these nine weeks.  The Chipola Visit Dothan Invitational Softball Tournament will be held February 9th – 11th at James Oates Park Softball Complex with over 20 teams participating and one team traveling from as far away as Utah. Mayor Saliba announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba introduced Ordinance No. 2018-19 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 114, Zoning, Section 114-131.2, Table of Permitted Uses, of the Code of Ordinances of the City of Dothan. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2018-19, motion seconded by Commissioner Crutchfield. City Manager West said this amendment will allow RV’s and travel trailers in mobile home parks, which is becoming common all throughout the country. Commissioner Ferguson asked if this will be for permanent or temporary type stays. City Manager West replied that there is no restriction; it will be the same as for mobile homes. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Ordinance No. 2018-20 (recorded in Ordinance Book No. _______at Page_______), granting a Franchise Agreement to the Southeast Alabama Gas District for construction and operation of a gas distribution system for its member municipalities, including the City of Dothan. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2018-20, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2018-21 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-22 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on March 6, 2018. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Minutes of the Board of Commissioners – February 6, 2018, continued. Mayor Saliba introduced Resolution No. 2018-23 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Tolleson Construction, LLC, for a New Multi- Purpose Facility at Eastgate Park in the amount of $1,321,934.00, and appropriating funds for said project (tabled on January 16, 2018). Commissioner Kirkland moved that the resolution be removed from the table, motion seconded by Commissioner Dorsey and unanimously carried. Commissioner Kirkland then moved for adoption, motion seconded by Commissioner Fleming. Commissioner Crutchfield said there was discussion during the Commission’s Work Session on Tuesday, January 23rd regarding new rates once the facility is built, and he requested an update from Leisure Services Assistant Director of Operations Kim Meeker. Mr. Meeker said the Dothan Recreation Board met in a special called meeting last week in order to consider this request and make a recommendation. He said the Board recommends the rental rates to be $400 for the entire facility and $150 for the multi-purpose room which has the option to be split into two rooms. He explained that, in the past, weekends were limited to the entire house rental, but this will not be the case with the proposed multi-purpose facility, as there will be flexibility to rent out individual rooms or the entire facility with options to use the kitchen and conference room. Commissioner Kenward said she applauds Leisure Services staff and the Board for looking at raising rates to be more in line with some of our private entities but she noticed there is still no cleaning fee. She asked that, at some point, this be considered because her fear is we end up with the same situation we deal with now, which is the condition of the place has crumbled because it has not been maintained or cleaned properly. She said she personally wants to focus on the process by which we maintain our facilities during this year’s strategic planning. She said also this item gives her pause because we as a city, by building a facility which we can rent for much cheaper, competes with the private market who are there to make money in our city and pay in to our tax structure, and presents itself as an unfair scenario. She said she knows as a city our goal is not to make money, and we barely break even on these types of things, but she has a lot of second guessing about the fact that we are competing with private industry here. Commissioner Ferguson said he agrees with Commissioner Kenward. He said he wants to be clear that he thinks this is a wonderful design, a great building, and it will be well used. But his concern is that there are several private businesses who have leveraged everything they own to offer this service and we have tremendous resources so we can easily do this and charge a much more competitive rate. He said he thinks we need to be careful when we start venturing down that road. He said also we have a lot of needs across the city, certainly traffic being big right now, and this is just not a high priority for him at this time. He said he does agree we need something to replace the old house but he is just not sure this is the right fit at this time. In response to some of the comments, Mayor Saliba requested an item be placed on the next Administrative Agenda to take a look at the rates across all of our parks that have facilities, if we have not done so in the last several years, to be sure these are regularly reviewed. Mayor Saliba said a valid point has been made and we want to weigh the balance between offering services to those who may not be able to afford facilities, but we also do not want to compete directly with those who have put their lives on the line with their businesses. Commissioner Fleming noted that the City is renting space and not providing some of the same services that private industry may be providing. Mr. Meeker mentioned that from Leisure Services standpoint this is primarily a recreation facility because this is what we do. He provided examples of activities that would be done at this facility such as having camps, meetings for Dothan Southern League, handing out discs for disc golf, and signing people up for archery. He said from our point of view it would be first a recreational facility and second a rental facility. Commissioner Dorsey asked how long the Commission has been talking about this issue, and Mayor Saliba replied two years. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, and Crutchfield; “nay:” Ferguson and Kenward. The motion was carried by the majority of five "yeas" to two “nays.” Mayor Saliba introduced Resolution No. 2018-24 (recorded in Ordinance Book No._______at Page_______), entering into a Reimbursable Agreement with the Alabama Department of Transportation for Relocation of Water and Sanitary Sewer Utility Facilities on Public Right-Of-Way to be performed by State Minutes of the Board of Commissioners – February 6, 2018, continued. Contractor on Project No. RPF-NHF-HPPF-0210(501), Additional Lanes on SR- 210 Ross Clark Circle from Bauman Drive to North Cherokee Avenue, including Engineering and CE&I at an estimated cost of $2,321,721.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Ferguson asked if this is one of the last hurdles. City Manager West replied yes but noted that ALDOT is still working on right-of-way. Commissioner Ferguson asked about this being reimbursable and Public Works Director Charles Metzger clarified that the cost of $2,321,721.00 will be included in and paid under the contract ALDOT enters into. Mr. Metzger said the next item on the agenda will be reimbursed. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-25 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Atkins North America, Inc. for professional consulting services for Preliminary Engineering (Phase I), Engineering Design (Phase II), and Construction Engineering and Inspection (CE&I Phase III) of the water and sanitary sewer utility relocations on Project No. RPF-NHF-HPPF-0210(501), Additional Lanes on SR-210 Ross Clark Circle from Bauman Drive to North Cherokee Avenue, for a not to exceed amount of $266,521.00, and appropriating funds for said services. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said this is 100% reimbursable. Commissioner Ferguson confirmed with City Manager West that this is just for the engineering part. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-26 (recorded in Ordinance Book No._______at Page_______), authorizing and accepting Signature Streetscapes to fabricate and deliver wayfinding signs for downtown Dothan according to the proposal from the vendor in the amount of $29,164.50. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this has been a long time coming. Commissioner Kenward said this signage will identity sites such as parking and she is excited to see it happening. There being no further discussion, the resolution was unanimously adopted. Commissioner Fleming asked to make a clarification regarding his voting nay on the Civic Center sign at the January 16th meeting and voting yea today for the wayfinding signs. He explained his reasoning was to have, instead of one big sign, a bunch of smaller signs all around Dothan so that the general consumer who may not ever come downtown will know that there are events downtown, and now when they do come downtown, they will have wayfinding signs to tell them where to park. He said he just wanted to clarify for his constituents and taxpayers that he was not against one huge sign in his district but was more for signs all over where people in districts one through six could see exactly what is going on in Dothan. Mayor Saliba introduced Resolution No. 2018-27 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Aclara for the use of the AMI system software. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said even though the bid has been approved, Aclara requires a separate software agreement for the use of their software during the pilot program. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-28 (recorded in Ordinance Book No._______at Page_______), entering into an interlocal purchasing agreement with the Dothan Housing Authority. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-29 (recorded in Ordinance Book No._______at Page_______), approving funding for Amendment #1 with Barge Design Solutions, Inc., in the amount of $220,000.00, making the adjusted contract price $2,080,500.00, for additional professional services to include Basin B0-21 comprehensive rehabilitation detailed design, construction management and oversight, and sub-consultant, and appropriating funds for said funding. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Dothan Utilities Director Billy Mayes explained that this is for the design Minutes of the Board of Commissioners – February 6, 2018, continued. for comprehensive rehabilitation of the worst basin that goes into the Omussee Treatment Plant. Upon Commissioner Ferguson’s inquiry into the reason for the increase, Mr. Mayes replied that this was listed as an additional item in the scope of work and is in the next round of projects we need to do since the major projects on the list have now been designed, under construction, or are bidding. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-30 (recorded in Ordinance Book No._______at Page_______), accepting the proposal of APD Urban Planning Management to present the study findings to a maximum of three additional stakeholder groups at a cost of $8,000.00; said fee to be split $4,280.00 to City and $3,720.00 to the Housing Authority, and appropriating funds for said additional public outreach. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-31 (recorded in Ordinance Book No._______at Page_______), declaring the Police K9, Number 851 (Chico) as no longer needed for public or municipal purposes and agreeing to donate the said K9 to Rachel David. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-32 (recorded in Ordinance Book No._______at Page_______), implementing an Amnesty Court for the City of Dothan Municipal Court to begin in 2018. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said this is a good thing for the City and is long overdue. He commended the staff for this recommendation. Commissioner Ferguson requested additional information regarding this item. Municipal Court Administrator Tonja Minnifield said there are currently over 18,000 outstanding warrants and this number is growing weekly. She explained that Amnesty Court will help reduce the number of warrants by allowing people to call their office to schedule an appointment to come in and take care of their outstanding warrant. She said if this program goes successfully they will continue to have Amnesty Court twice a year in February and March. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-33 (recorded in Ordinance Book No._______at Page_______), approving and funding an additional technical staff position of Electrical Planner for the Dothan Utilities Electric Division for oversite of the Advanced Metering Infrastructure (AMI) System. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Fleming asked for additional information regarding this position and how it will help the general consumer. Electric Operations Superintendent Chris Phillips said this position will manage the pilot project as well as the future installation and act as the administrator of the AMI System ensuring meter reads. He said when there are issues customers can reach out to this person. He said there are other duties this person will perform once the system is installed to include implementing load management practices to hopefully help reduce our demand which will in turn reduce our wholesale power bill. Mr. Phillips approximated a two year implementation and estimated four to five years for the AMI System to be completely deployed. Commissioner Kirkland and Mr. Phillips spoke about our rates being based on the peak hour of the year and the potential for saving money. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-34 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for the sponsorship of Dothan Leisure Services Youth Basketball for 2018. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-35 (recorded in Ordinance Book No._______at Page_______), appointing Meagan Dorsey, Sharla Jones, William Nichols, and Vimal Patel as members of the Museum Board. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted.
