BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING OCTOBER 2, 2018 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, October 2, 2018 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Albert Kirkland was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Minister Chris Jones, Westgate Church of Christ, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of September 18, 2018, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming October 7-13, 2018 as “Fire Prevention Week.” Deputy Fire Chief Chris Etheredge, on behalf of Fire Chief Larry Williams who was under the weather and unable to attend today, was present for the proclamation. Mayor Saliba said it is his pleasure, as mayor and representing the City Commission, to proclaim this week as Fire Prevention Week. He expressed how proud the Commission is of our Fire Department, whose members have put themselves in the way of harmful situations many times. He said we are proud of the work they do and proud of them each and every day. Deputy Chief Etheredge, presented 2018 Member of the Year Fire Department Awards to Firefighter Dalton Quattlebaum, Rookie of the Year; Firefighter Preston Banister, Firefighter of the Year; Sergeant Jack Wood, Sergeant of the Year; and Captain Kevin Knight, Fire Officer of the Year. Commissioner Dorsey said he recently visited his doctor for his annual checkup, and he was happy to hear that his blood pressure was 127/80. He thanked Executive Assistants Sarah Woodham and Lisa Matheny for being great assistants and for their help in handling phone calls. Commissioner Ferguson asked that the Commission consider tabling Item No. 11 regarding the Affordable Housing Implementation Plan for two weeks, until the October 16th meeting, to allow time to disseminate all the information to ensure we do the right thing. Commissioner Crutchfield reminded everyone that Foster Fest is this Friday night from 6:00 p.m. until 10:00 p.m. He said this will be the last one of the year and he hopes everybody can participate in this event. Commissioner Crutchfield encouraged all who live in Brentwood Subdivision to attend their Neighborhood Watch meeting on Thursday, October 11th at 6:00 p.m. at Westgate Recreation Center. He said there will be updates from the Dothan Police Department on crime stats and investigations. Mayor Saliba said he gets to see day in and day out what all of our commissioners do for the citizens and how they handle issues. He expressed his appreciation for what they do, each and every day, in addition to working in order to make a living and serving our community. Mayor Saliba said City Manager West recently attended a city manager conference where he was recognized for thirty-five years of service and we are glad he has spent fourteen of those years with us. Minutes of the Board of Commissioners – October 2, 2018, continued. City Manager West requested Public Works Director Charles Metzger to provide an update on Woodburn Drive and downtown road work. Regarding downtown, Mr. Metzger said the first layer is on Saint Andrews Street, crack sealing is still taking place on some of the other streets, and South Appletree Street still has to be done. He said work will start tomorrow on Woodburn Drive and the road will be milled down far enough to do two layers of resurfacing, in part because of the heavy truck traffic on the north end. He said the milling work and first layer of resurfacing will take place this week. He said a news release is going out because this is a heavy traffic area, and there will be people flagging in an effort to keep those affected businesses open. He said there is a three lane section on the north end and this does help keep traffic moving. Mayor Saliba asked if we notify the businesses ahead of time or do we rely on the press release. Mr. Metzger said we usually just do a press release but this is something we can look at on a shorter street. City Manager West asked if the east and west downtown streets will be paved by Foster Fest. Mr. Metzger said the work will not be complete by that time, but we do have drier weather right now and this will help with the timeframe. City Manager West made the following announcements and comments:  Troy University’s musical group POPulous is performing shows in the Dothan Opera House today for students and this evening at 7:00 p.m. for the public. This is a free concert and they do a phenomenal job.  Eastgate Park pond is closed until Wednesday, October 10th for maintenance and restocking.  Youth Fishing Day will be held at the Eastgate Park pond on Saturday, October 6th from 9-11 a.m. and Senior Fishing Day will be held on Monday, October 8th.  Cubmobile registration is going on this week and next week at Doug Tew Recreation Center from 9:00 a.m. until 4:00 p.m.  The Leisure Services Department is planning a first time Fall Fling event at Westgate Park on Tuesday, October 30th from 5:30-8:30 p.m. on the soccer fields across from the Miracle Complex.  The City will host a Health Fair for employees in the Civic Center tomorrow from 8:00 a.m. until 2:00 p.m.  Foster Fest will be Friday night and preliminaries for the National Peanut Festival pageant will also be taking place at the Civic Center. Parking may be difficult at times and everyone is asked to be patient. Leisure Services Director Elston Jones confirmed for Commissioner Crutchfield that the Miracle Field playground is currently back open. Mr. Jones said there is some additional work in the contract that will need to be done over the weekend and the playground will then reopen on Monday, October 8 th. Mayor Saliba announced a Public Hearing regarding the demolition and removal of unsafe structures. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba introduced Resolution No. 2018-274 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on October 16, 2018. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-275 (recorded in Ordinance Book No._______at Page_______), declaring certain properties as creating a nuisance, constituting a hazard to the public health, safety and convenience of the citizens of Minutes of the Board of Commissioners – October 2, 2018, continued. the City of Dothan and authorizing the demolition and removal of the said structures. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced a proposed resolution, adopting the “City of Dothan Strategic Affordable Housing Implementation Plan” to guide decisions in the implementation of price appropriate housing strategies particularly for at risk populations and to serve as the basis to better understand the housing needs and affordable housing gaps which may preclude the citizens of Dothan from obtaining adequate housing. Commissioner Ferguson made a motion to table until the October 16th meeting, motion seconded by Commissioner Kenward. Commissioner Dorsey said this issue was put on the strategic plan in 2016, we’ve been talking about this, and it is time to do the walking now. He said we can see in our community what we need, the study has been done, and he does not feel this item should be tabled. Commissioner Ferguson said he missed the work session and that is his mistake, but he just received this information on Friday and has not had a chance to really digest some of it. He said the meeting minutes from the Planning Commission were not complete and it was a six to three vote – none of this is included in the minutes. He said before he votes on something this important he wants a full picture of what happened and he would like to know why those minutes were not complete. He asked City Attorney Len White if the law requires minutes to be complete. Mr. White said minutes do not have to be verbatim but he has not seen the Planning Commission minutes to be able to advise. Commissioner Kenward said the minutes included only a small paragraph and then the six to three vote, so they are left to guess as to what the discussion was and why the vote went the way it did. She said she agrees with Commissioner Ferguson – she does not feel comfortable making a major decision like this and adopting a policy if we are not fully aware. She said we rely on the people we appoint to these boards to help us make decisions because we cannot be at every meeting. She said normally she will read through the meeting notes and go to that individual board member if she has questions but they were not provided the full notes for this item. She said she does not think it is anything negative – we just need more information in order to make the decision as good elected officials. Commissioner Dorsey asked Planning Director Todd McDonald to state for the record his job title and how long he has served in this position. Mr. McDonald stated he has been the Planning Director since May 22, 2006. Commissioner Dorsey asked Mr. McDonald if we need this policy. Mr. McDonald replied that it was generated by the City Commission at one of your strategic planning sessions and the department is following your lead. Mayor Saliba said he wants to respect everybody’s opinion and although he is for this policy, he does not want any of our commissioners to feel they have not had enough time to vote on it. He said this is important and he would be glad for us to table it, but know that he is for moving ahead, and hopefully on October 16th, we will have gotten where we need to be to vote at that particular time. Commissioner Crutchfield said he has discussed this with Mr. McDonald and several others on the Planning Commission, and while he disagrees maybe on what the minutes are, he feels he has enough to make a decision, but he will be glad to table it for two more weeks for those who need more questions answered. Commissioner Fleming said he has enough information and is ready to make a decision as well, but this request is fair and he would feel comfortable tabling the item if the Commission needs time to take a look at it further. There being no further discussion and upon the motion to table being put to vote, those voting “yea,” were Saliba, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” Dorsey. The motion was carried by the majority of five "yeas" to one “nay.” Mayor Saliba introduced Resolution No. 2018-276 (recorded in Ordinance Book No._______at Page_______), approving Change Order No. 1 with Saliba Construction Co., Inc. for the Regional Public Safety Training Center for a net decrease of $87,558.00 and a contract total of $18,190,542.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey. City Manager West said to remember that this project is still in the beginning stages. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-277 (recorded in Ordinance Book No._______at Page_______), approving the Final Summary Change Order with BCS, LLC for interior renovations at the Alfred Saliba Family Services Center for a Minutes of the Board of Commissioners – October 2, 2018, continued. net increase of $1,850.00 and a final contract total of $49,244.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. Mayor Saliba said he will abstain from voting on this item because he is a past board member of the Alfred Saliba Family Services Center. There being no further discussion, and upon the motion being put to vote, those voting “yea,” were Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none; “abstained:” Saliba. The motion was carried by the majority of five "yeas" to one “abstention.” Mayor Saliba introduced Resolution No. 2018-278 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the American Registry for Internet Numbers for issuance of an Autonomous System Number and IP addresses at a cost of $800.00 annually and submitting the required attestations for IP address assignments. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-279 (recorded in Ordinance Book No._______at Page_______), submitting an application with the State of Alabama Department of Education for participation in the At-Risk Afterschool Food Service Program for children, entering into an agreement with the United States Department of Agriculture for administration of the program and entering into an agreement with the Dothan City Board of Education for providing the food services. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-280 (recorded in Ordinance Book No._______at Page_______), submitting a conditional letter of acceptance of 6,141 kW of additional power allocation from Southeastern Power Administration. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Ferguson. City Manager West explained that we currently have an allocation from Southeastern Power Administration and they have offered us additional hydroelectric power. He said there are a couple of conditions included in our acceptance letter, and if everything works out, this could save us between $600,000 and $700,000 a year on our electrical cost. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-281 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Enterprise State Community College through its Southeast Alabama Highway Safety Office for participation in the Alabama Department of Economic and Community Affairs Law Enforcement Traffic Safety Grant Program. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-282 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $3,900.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center (ACJTC) in Selma, Alabama. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-283 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for sponsorship of the Dothan Leisure Services Youth Football and Soccer programs. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-284 (recorded in Ordinance Book No._______at Page_______), appointing Neil Holloway as a Member of the Planning Commission. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West pointed out that Mike Palmer will serve at the next Planning Commission meeting and this appointment is effective the next day.
