BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING NOVEMBER 20, 2018 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, November 20, 2018 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Dr. Johnny Fain, First Baptist Church, then led in prayer, afterwhich Commissioner Kirkland led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of November 6, 2018, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming December 1, 2018 as “World AIDS Day” in the City of Dothan. Robert Forehand, Medical AIDS Outreach was present for the proclamation. Mayor Saliba invited up local farmer David “PeeWee” Bell, who he participated with in this year’s Farm City Week swap. Mayor Saliba said the great thing about this week is that it brings awareness to how important agriculture is to our community, this state, and this country, and he appreciates what farmers do day in and day out. He recognized Gloria Jeffcoat, who was present in the audience, for being a great representative of the agricultural community. He said we are there with you through the devastation that has just occurred with Hurricane Michael and we know there are a lot of people who are suffering in those markets. Commissioner Kirkland wished everyone a safe and Happy Thanksgiving. Commissioner Ferguson congratulated Dothan Eagle reporter Jeremy Wise and his wife, Lindsey, on the birth of their son. Commissioner Kenward reminded everybody that we have a lot of refugees here from Florida and Georgia, and many have lost everything. She said, given her day job, she has walked into some intensely sad situations where people have been displaced and are in apartment housing with no furniture. She asked everyone to be mindful of this during the holiday season and to go the extra mile to be extra friendly because that is what Dothan is. She said she knows traffic is busy right now, and part of the reason is because we have a lot of people here that are going to be calling Dothan their home, so let’s roll out the red carpet and show them how kind we can be. Mayor Saliba announced that Item No.’s 12, 13, and 14 will be removed from today’s agenda and appropriate action will be taken at that time. City Manager West made the following announcements and comments:  City offices will be closed in observance of Thanksgiving on Thursday, November 22nd and Friday, November 23rd. Thursday garbage and recycling will be picked up on Wednesday, November 21st. Friday garbage and recycling will be picked up on Friday, November 23rd. There will be no trash pickup on either of these days. The recreation centers will also be closed Thursday and Friday but will reopen on Saturday, November 24 th. Minutes of the Board of Commissioners – November 20, 2018, continued.  The draw for the Downtown Dothan Hoops Classic will be held on Monday, December 3rd at 5:00 p.m. in the Great Hall of the Wiregrass Museum of Art. The tournament will be conducted December 26th through the 31st.  The City’s Annual Christmas Tree Lighting event will be held on Tuesday, December 4th at 6:00 p.m. in the Civic Center parking lot.  Rose Hill Senior Center will hold their “My Little Christmas Shoppe” event the week of December 10th – 14th where arts and crafts built by the seniors will be available for very reasonable prices.  The Annual Downtown Christmas Festival will be held on Saturday, December 1st from 10:00 a.m. until 2:00 p.m. on North and South Foster Streets. There will be snow and Santa too!  Our Boys 10 & Under, Boys 12 & Under, and Girls 12 & Under All-Star Soccer teams have won the state championships. This is quite an accomplishment to win three of the twelve divisions.  The City’s float won this year’s Presidential Award at the National Peanut Festival Parade. Thanks to Public Works Director Charles Metzger for volunteering to the lead the float build and everybody who worked with him. City Manager West invited Mr. Metzger to give an update on the storm cleanup. City Manager West said we are still receiving complaints that some neighborhoods have seen no trash pickup since the hurricane. Mr. Metzger explained that some of the smaller piles of debris and piles containing non-burnable materials have not been picked up because crews have been concentrating on picking up the large, burnable debris piles. He said crews will start back running regular routes on Monday, November 26th and will work to pick up as much as possible on the scheduled days. He said they will continue to work ten hour days, six days a week in an effort to have debris picked up by Christmas. He said the December 31st deadline for picking up of business and professionally cut debris will help them stay on top of the cleanup, because as time goes on, debris will continue to be brought out to the curb as residents continue their cleanup efforts. He noted that 43,000 cubic yards of storm debris has been picked up so far, and there has been one employee injury. He said ditches and drainage ways still need to be cleaned of debris and some work, like pothole patching, has not been done as regular because the Street Division has been helping the Environmental Services Division. He recognized the assistance provided to the Street Division by crews from Dothan Utilities. He requested everyone’s patience as they continue this cleanup process. He said the asphalt work on South Appletree Street will resume soon and then the contractor will finish up the downtown streets. Commissioner Ferguson said in light of some recent events he would like to make a motion to go into Executive Session to discuss good name and character and some time-sensitive issues, motion seconded by Commissioner Crutchfield and unanimously carried. Upon their return, Commissioner Kenward made a motion to come out of Executive Session, motion seconded by Commissioner Crutchfield and unanimously carried. Mayor Saliba stated that no action was taken. Mayor Saliba introduced the application of Jon Archer for a Restaurant Retail Liquor License (on premise) for Cheddars Casual Café, located at 4941 Montgomery Highway. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. City Manager West said this is a transfer of the license. There being no further discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Minutes of the Board of Commissioners – November 20, 2018, continued. Mayor Saliba introduced Ordinance No. 2018-316 (recorded in Ordinance Book No. _______at Page_______), rezoning a parcel of land owned by New Town Development, LLC, located on the corner of Rowland Road and St. Lawrence Road from B-2 (Highway Commercial) District, to R-4 (Residential-Attached Multi Family) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2018-316, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2018-317 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Fleming moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-318 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on December 18, 2018. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. At this time, Commissioner Crutchfield made a motion to remove the following items from the agenda: Item No. 12, a proposed resolution appropriating $475,000.00 to the Dothan Downtown Redevelopment Authority for economic development, to be paid in two installments of $237,500.00, one in December, 2018 and one in June, 2019. Item No. 13, a proposed resolution dedicating, establishing and developing pedestrian trails in downtown Dothan to be known collectively as “The George Washington Carver City Walk” and provide appropriate lighting as determined by the City for the 300 block of North Foster Street and for said “Walk”. Item No. 14, a proposed resolution creating and establishing a city park in and for the City of Dothan to be developed, dedicated, named and maintained by Eagle Investments, LLP, located within the city block at the intersection of North Appletree Street and North College Street. The City of Dothan shall incur no expense in the development and maintenance of the park. The motion was seconded by Commissioner Ferguson and unanimously carried. Mayor Saliba introduced Resolution No. 2018-319 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation (ALDOT) for the removal of a manhole and 120 L.F. of existing sanitary sewer main and the installation of two manholes and approximately 120 L.F. of 8” sanitary sewer main within the ALDOT ROW at the 2300 block of East Main Street (U.S. Hwy 84, AL. Hwy. 12) to serve a new commercial subdivision. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this is the Healthcare Authority property. There being no further discussion, the resolution was unanimously adopted. Minutes of the Board of Commissioners – November 20, 2018, continued. Mayor Saliba introduced Resolution No. 2018-320 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with OffenderWatch to process sex offender mail-out notifications to the public for a one-time deposit fee of $250.00 and a minimum mailing cost of $35.00 per mailing. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2018-321 (recorded in Ordinance Book No._______at Page_______), agreeing to allocate the required 20% match of local funds for the Unified Planning Work Program in an amount not to exceed $51,720.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson. City Manager West said the City has never spent all of the money allocated for this program. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-322 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a Brownfields Clean-up Grant in an amount not to exceed $260,000.00 for the former electrical substation, located at the corner of Whiddon and Linden Streets and agreeing to the City’s match of twenty percent (20%) and appropriating $10,000.00 to construct a fence. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming. City Manager West said this is an old substation where arsenic was discovered during the Phase II Environmental study. He said the fence will go up first to keep people off the property, it will then be cleaned up, and hopefully the property will one day be an expanded part of Aunt Katie’s Community Garden. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2018-323 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of October, 2018 in the amount of $18,306,846.25. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted.
