BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MARCH 5, 2019 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, March 5, 2019 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were Acting City Manager Mike West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Adam Comeens, First Presbyterian Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of February 19, 2019, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming March, 2019 as “Wiregrass Museum of Art-Youth Art Month.” Wiregrass Museum of Art Educators Amanda Holcomb and Brook McGinnis were present for the proclamation and they introduced this year’s award winning artists. Mayor Saliba recognized Commissioner Dorsey for receiving the Bronze “Certificate of Achievement in Leadership Excellence” from the National League of Cities for his successful completion of the Leadership Fellows Program. Commissioner Fleming thanked Executive Assistant Sarah Woodham for her help with the flyers for the upcoming job fair he is hosting along with the Dothan Housing Authority on March 27th from 12:00 p.m. until 2:00 p.m. at the McRae Homes Community Center located at 705 North Lena Street. Commissioner Ferguson said the State of Alabama suffered a series of tornadoes over the weekend, and as the recovery process begins, now is the time we can lend a helping hand. He said Mayer Electric, located at 1390 Columbia Highway, is collecting storm relief supplies and are reaching out to other businesses, organizations, and individuals to join with them in providing much needed donations. Commissioner Crutchfield said the Mardi Gras Parade took place over the weekend and he is proud to be part of this huge and growing event. He expressed appreciation to our citizens, Harry Hall and his Board, for their time and effort in providing this event. He thanked the Dothan Police Department, the Houston County Sherriff’s Department, the Dothan Downtown Redevelopment Authority, and our downtown merchants for their support. Commissioner Crutchfield announced that the Azalea-Dogwood Trail is Sunday, March 10th at 2:30 p.m. and will begin at the intersection of Woodland Drive and Main Street. Mayor Saliba said the tragedy with the tornadoes occurring over the weekend weighs heavy on everyone’s hearts and we send our prayers. He recognized Police Chief Steve Parrish and Fire Chief Larry Williams, along with their departments and other staff in the City, for always being there and for being prepared to respond during emergencies, and he expressed appreciation to Houston County and the Dothan/Houston County Emergency Management Agency for their partnerships. Minutes of the Board of Commissioners – March 5, 2019, continued. Acting City Manager West made the following announcements and comments:  Opening Ceremonies for Dothan Southern League is Friday, March 15th at 6:30 p.m. at Eastgate Park, Dothan American League is Saturday, March 16th at 9:00 a.m. at James Oates Park, Dothan National League is Saturday, March 16th at 10:30 a.m. at Westgate Park, Miracle League is Saturday, March 16th at 9:30 a.m. at Westgate Park, and Girls Softball is Saturday, April 6th at 9:00 a.m. at James Oates Park.  Brandi Deese, one of our local Special Olympians, is participating in Cycling in the 2019 Special Olympics World Games in Abu Dhabi. This is quite an honor for her and for this community.  The last storm pile from Hurricane Michael has been burned.  Five Dothan Basketball Teams are participating in the State Tournament in Trussville, AL.  The Brookside Bridge construction will begin on Monday, April 1st.  Daylight Savings Time starts this Sunday, March 10th at 2:00 a.m. when the time springs forward one hour to become 3:00 a.m. Mayor Saliba introduced Ordinance No. 2019-53 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by James R. Wilson, 22.53 acres located south of Robinson Street (Parcel 38-10-03-06-3-001.007) from R-4 (High Density, Single-Family, Attached) District to R-A (Residential, Multi-Family, High Density) District (Tabled on February 19, 2019). Commissioner Kenward moved that this item be removed from the table, motion seconded by Commissioner Crutchfield and unanimously carried. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Ferguson then moved for adoption of Ordinance No. 2019-53, motion seconded by Commissioner Crutchfield. Commissioner Dorsey asked all citizens present in the audience from the Bamadale area to please stand and approximately eighteen people stood. Commissioner Dorsey said there is a scripture in the Bible that he reads, in Matthew 7:12, which states to do unto others what you would have them to do to you, and then said he asks his fellow colleagues today that you all please vote with your heart and be very considerate as you vote today. Commissioner Ferguson said he received all the emails and calls, and while he greatly respects everyone’s opinion, he thinks some of the comments he has heard are outside of this Commission’s purview – for instance, that there was a desire to have a gated community at one time – as those issues are not really for this Commission to decide. He said the only thing we really need to consider is whether or not the zoning is appropriate for that part of town. He said he thinks residential is appropriate in that area and his understanding is that there is an approximate twenty-two acre buffer between the proposed development and the neighborhood. He said he respects the opinions expressed but he believes it is appropriate to allow a developer to develop his land in this manner. Mayor Saliba said he appreciates Commissioner Ferguson expressing his thoughts on this matter. He said we know that any time we are dealing with our homes, our children, and other issues like that it is a sensitive topic and it is hard for the Commission sometimes to have to make these decisions. He said we do care about all opinions and he has tried to hold a couple of meetings individually with both groups, but now is the time to vote. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Saliba, Kirkland, Ferguson, and Crutchfield; “nay:” Dorsey, Fleming, and Kenward. The motion was carried by the majority of four “yeas” to three “nays.” Mayor Saliba introduced Resolution No. 2019-54 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to Minutes of the Board of Commissioners – March 5, 2019, continued. the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on April 2, 2019. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-55 (recorded in Ordinance Book No._______at Page_______), amending various accounts in the 2019 Fiscal Year Budget. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Ferguson. Acting City Manager West said the vast majority of these amendments are associated with Hurricane Michael. He said this is budgeting the money that has been spent for the expenditures and also bringing in the FEMA money to help offset that cost. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-56 (recorded in Ordinance Book No._______at Page_______), approving the Final Summary Change Order with Lewis Construction, LLC, for the Opera House Additions and Renovations; a net decrease of $19,499.01 and a final amount of $491,800.99. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-57 (recorded in Ordinance Book No._______at Page_______), accepting the proposal and service agreement of McGriff, Seibels and Williams, Inc. for Specific Stop Loss Reinsurance for the City of Dothan’s Health and Accident Insurance Plan, as quoted by Lloyd’s of London. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson. Acting City Manager West said this is the Stop Loss over which claims above that amount are actually paid by the reinsurer. He said there is a seven percent increase, but that was the lowest quote, and over the years we have been reimbursed a lot of money based on having this insurance. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-58 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Houston County for providing meals to inmates housed in the Dothan City Jail. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kenward. Police Chief Steve Parrish confirmed for Commissioner Dorsey that this contract includes a twelve cents per meal increase for a total of $2.23 per meal. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-59 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Organized Crime Drug Enforcement Task Forces (OCDETF) Program for reimbursement of overtime expenditures related to the Organized Crime Drug Enforcement Task Force in the amount of $25,000.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-60 (recorded in Ordinance Book No._______at Page_______), accepting funding from the United States Secret Service for participation in the U.S. Secret Service Alabama Electronic Crimes Task Force for reimbursement of overtime expenses not to exceed $10,000.00 for fiscal year 2019, and appropriating funds for said funding. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-61 (recorded in Ordinance Book No._______at Page_______), naming the entry road to the Eastgate Park Youth Baseball Complex as “Benny Sims Way”. Commissioner Fleming moved for adoption, motion seconded by Commissioner Ferguson. Commissioner Fleming said he worked at Eastgate Park with Mr. Benny and, seeing the dedication that he gave to our kids and also what his son J.P. is carrying on, this will be a beautiful thing, like Spanky Thomas at Walton Park and the naming of that field. He said he appreciates Leisure Services and the City for supporting this request. Commissioner Crutchfield concurred with Commissioner Flemings sentiments.
