BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MAY 21, 2019 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, May 21, 2019 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Keith Frith, Harvest Church, then led in prayer, afterwhich Commissioner Kirkland led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of May 7, 2019, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming the week of May 19- 25, 2019 as “Emergency Medical Services Week” in the City of Dothan. Fire Chief Larry Williams and Battalion Chief Sean Gibson were present for the proclamation. Chief Williams and Battalion Chief Gibson recognized and presented the John T. Ingram Emergency Medical Technician (EMT) of the Year Award to Firefighter Steven Romo, the Paramedic of the Year Award to Firefighter Jeffrey Donner, and the Life Saving Award to Tori Garrett, Dothan Communications. Dothan Ambulance Service crew members Mike Mixon and Shanda Sanders (unable to attend due to a scheduling conflict) were also recognized and were bestowed the Citizen Life Saving Award. Commissioner Fleming introduced Dignity for Dads Committee members Kris Doss, Deandrea Peterson with Betty Dickens Education & Training Center, Dothan Housing Authority Resident Services Coordinator Lamesha Beachum, and DHA Executive Director Sam Crawford. Mr. Doss, Ms. Peterson, and Ms. Beachum spoke about the event being held on Saturday, June 15th at McRae Homes, and they invited everyone to come out to enjoy the activities with the kids and show community support. They provided their email addresses and welcomed anyone interested in volunteering or donating items for the event to please contact them. Commissioner Fleming said he would like to publicly thank Police Chief Steve Parrish and his department for their response last week to a rash of break-ins in certain neighborhoods. He said his house was one of the ones hit, but thanks to the work of some great officers, his kid got his wallet back. He expressed appreciation to Chief Parrish and his crew for being resilient and making sure everyone was taken care of. Commissioner Crutchfield apologized for missing the last meeting as he was out of town attending his nephew’s high school graduation. He said he missed the opportunity to officially welcome City Manager Cowper at that meeting, but he has been seeing him out in the community, and he would like to express appreciation for his presence and for him taking this opportunity to be here. City Manager Cowper, along with Public Works Director Charles Metzger, presented a service award to Nathan Brown, for twenty-five years of service with the City. City Manager Cowper made the following announcements:  Houston County Schools will hold graduation practices at the Civic Center this Thursday, May 23rd and graduations will take place all day on Friday, May 24th. Minutes of the Board of Commissioners – May 21, 2019, continued.  City offices will be closed on Monday, May 27th for Memorial Day. Regarding the sanitation schedule, Monday residents will receive garbage and recycling pick-up on Wednesday, May 29th. There will be no trash collection for Monday residents this week.  Discount season passes can be obtained at Water World today through Thursday from 3:30 – 5:00 p.m. and Friday from 3:30 – 7:00 p.m.  Water World and all City pools will be open for the season beginning Saturday, May 25th.  Playground program registration will begin at Wiregrass Park, Walton Park, and Andrew Belle Youth Center on Saturday, June 1st from 9:00 a.m. until 12:00 p.m.  A public hearing will be held for the CDBG allocations during the Tuesday, June 4th City Commission meeting, which will begin at 10:00 a.m.  The City Commission meeting for Tuesday, July 2nd has been canceled as a result of the Independence Day holiday so there will only be one meeting in July. Mayor Saliba introduced the application of Robin Thagard for a Lounge Retail Liquor License, Class I (on or off premise) for Bella’s Wine Bar, located at 107 West Troy Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced Resolution No. 2019-119 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of a certain property determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offender) and turning the cost over to the County Tax Collector so that the amount can be added to the next regular bill for taxes levied against the respective lot and parcel of land. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-120 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract, and issuing a Notice to Proceed to Mid-South Paving Inc., of Dothan, Alabama for Street Resurfacing scheduled for 2019, for the sum of $2,002,145.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said he is glad to see this is a local contractor and the money is going back into our community. Public Works Director Charles Metzger confirmed for Commissioner Kenward that the list will be put on the website for citizens to be able to view. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-121 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of one tap and valve for fire line and fire hydrants (fire line and hydrants installed by contractor) for new building additions at John Deere located at 168 Ross Clark Circle. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-122 (recorded in Ordinance Book No._______at Page_______), participating with Armway, LLC in the construction cost of extending the sanitary sewage system from the existing sanitary sewer main crossing Rock Creek between Westgate Parkway and Retail Drive and extending along the north side of Rock Creek to serve the proposed David’s Catfish Restaurant, at a cost of $46,500.00. Commissioner Kenward pointed out that this item was discussed at the last meeting and the extension also gives us the opportunity to tie on to it for future use, so again, we are reinvesting in our own community. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-123 (recorded in Ordinance Book No._______at Page_______), extending the Town of Cowart’s sewer billings based upon their water meter consumptions instead of their sewer meters, per Resolution 2017-133 until December 2020, to allow them time to perform significant rehabilitation of their sewer system to reduce inflow and infiltration. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-124 (recorded in Ordinance Book No._______at Page_______), extending the Town of Kinsey’s sewer billings based upon their water meter consumptions instead of their sewer meters, per Resolution 2017-131 until December 2020, to allow them time to perform significant rehabilitation of their sewer system to reduce inflow and infiltration. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-125 (recorded in Ordinance Book No._______at Page_______), extending the Town of Midland City’s sewer billings based upon their water meter consumptions instead of their sewer meters, per Resolution 2017-130 until October 2020, to allow them time to perform significant rehabilitation of their sewer system to reduce inflow and infiltration. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming. City Clerk Danner confirmed for Commissioner Ferguson that these satellite agreements will supersede the previous agreements. Dothan Utilities Director Billy Mayes confirmed for Commissioner Ferguson that these towns are required to give monthly status reports by the 10th of the following month per this agreement, and these reports will be provided to the Commission. Mr. Mayes said if a report is not provided, the City Manager can make the determination to revert back to the sewer meter billing. Mayor Saliba thanked Mr. Mayes for his work on all three of these agreements. He said our intent is to be neighborly and work with the cities on our system to help them be able to meet all the ADEM requirements that we are meeting as well. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-126 (recorded in Ordinance Book No._______at Page_______), renewing the mutual aid agreement with the Southern Nuclear Operating Company, Inc., an agent of the Alabama Power Company, for back-up fire protection services at the Joseph M. Farley Nuclear Plant for a three-year period. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-127 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with SPIDAWeb, LLC, for Pole Loading Calculation software subscription, technical support and upgrades (per National Electric Safety Code), at a cost of $2,495.00 for a twelve- month period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-128 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of April, 2019 in the amount of $13,130,530.66. There being no further discussion, and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Kenward, and Crutchfield; “nay:” none; “abstained:” Ferguson.
