BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 18, 2020 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, February 18, 2020 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Administrative Secretary Courtney Vickers, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Lyle Peluso, Dothan Vineyard Church, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of February 4, 2020, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming February 24-28, 2020 as “Public Schools Week for the City of Dothan.” Lee Jacobs and Meagan Dorsey, Dothan City Schools, were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming February 27, 2020 as “Arbor Day.” Dan Williams, Horticulturist, City of Dothan was present for the proclamation. Commissioner Kirkland recognized Executive Assistant Sarah Woodham, Executive Assistant Lisa Matheny, and Personnel Director Delvick McKay for doing a great job speaking at Anita Fulton’s funeral on Saturday, February 15th, and he thanked them for their representation of the City. Commissioner Kirkland said he wants to lift up fellow commissioner John Ferguson, whose mother has cancer, and he requested everyone to remember them in their prayers. Commissioner Ferguson wished Commissioner Kenward a Happy Birthday! Commissioner Kenward said a fundraiser for the Wiregrass Pet Rescue and Adoption Center is being held at Red Elephant from 11:00 a.m. until 1:00 p.m. on Friday, February 21st, and this is one way citizens can get involved with our shelter initiative. Commissioner Crutchfield said he would like to take the time to recognize our public safety, which is something we often take for granted and hope we never need. He said he recently had to call 9-1-1 due to an incident with his parents and the police, fire, and ems response was amazing. He said help arrived quickly and everyone was very professional. He thanked Police Chief Steve Parrish and Fire Chief Larry Williams for their leadership, as well as Pilcher’s Ambulance Service. Commissioner Crutchfield reminded everyone of the Mardi Gras parade on Saturday, February 22nd, starting at 3:00 p.m. around Solomon Park and ending on Foster Street, and the concert at The Plant following the parade. He said there will be plenty of things to do on Saturday for those who would like to come out. City Manager Cowper made the following announcements and comments:  City offices were closed yesterday in observance of Presidents’ Day. Residents who normally have their garbage picked up on Monday will receive service tomorrow. Minutes of the Board of Commissioners – February 18, 2020, continued.  Leisure Services Therapeutic Program and Dothan Civitan Club is having a spaghetti lunch fundraiser on Friday, February 21st from 11:00 a.m. until 1:00 p.m. at the Westgate Softball Complex. Tickets are $7.00 each.  Eastgate Park’s community playground build is planned for Saturday, March 7th at the baseball pavilion from 8:00 a.m. until 3:00 p.m. This will be a great event and anyone who has never experienced this type of effort is encouraged to come out to help.  Everyone is invited to come out and have fun at the Mardi Gras parade on Saturday, February 22nd. Mayor Saliba introduced the application of Bobby Greenawalt for a Special Events Retail License (on premise) for Dothan Rodeo, located at 5622 Highway 231 South. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced the application of Kali Jackson for a Retail Beer and Retail Table Wine License (off premise) for Run and Tell Food Mart, located at 2225 Lake Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Dorsey moved for approval, motion seconded by Commissioner Fleming. Commissioner Dorsey said he has heard no other complaints from the community and the existing neighborhood is actually really excited about having a store in that vacant building because it has been an eyesore for quite some time. Commissioner Kirkland said the applicant seems to have quite a relationship with the police department and this is a concern. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Dorsey, Fleming, and Kenward; “nay:” Saliba, Kirkland, Ferguson, and Crutchfield. The motion was denied by the majority of four “nays” to three “yeas.” Mayor Saliba introduced the application of Dipali M. Patel for a Retail Beer and Retail Table Wine License (off premise) for Murphy Mill Convenience, located at 4279 Montgomery Highway. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Crutchfield moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced the application of Worawadee Pattanapong for a Pool and Billiards License for Rob & Dave’s, located at 182 S. Foster Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba announced a Public Hearing regarding the rezoning of property owned by Michael Jerrell, located at 618 Westgate Parkway. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba introduced Ordinance No. 2020-49 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Michael Jerrell, located at 618 Westgate Parkway from R-1 (Residential Single-Family, Low Density) District to O-2 (Office Park) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Ferguson then moved for adoption of Ordinance No. 2020-49, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Minutes of the Board of Commissioners – February 18, 2020, continued. Mayor Saliba introduced Resolution No. 2020-50 (recorded in Ordinance Book No._______at Page_______), requesting that the local legislative delegation introduce legislation, supported by the Dothan Board of City Commissioners, that will provide for an alternative procedure for abating tall grass and weeds. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Mayor Saliba requested an explanation for the media and others present. Planning Director Todd McDonald said an objective on his business plan was to accelerate the abatement process and the proposed legislation, which is patterned after other cities who have taken this step, will accomplish this goal while also reducing the costs incurred. Commissioner Dorsey, Commissioner Kirkland, and Mayor Saliba expressed their appreciation. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-51 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Sain Associates, Inc., for professional services to update the 2045 Long Range Transportation Plan for the Southeast Wiregrass Area Metropolitan Planning Organization, in the amount of $122,254.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-52 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Dorsey asked if the City will sell the traffic signal controls, and General Services Director Randy Morris replied that the item will be placed on GovDeals for online auction. Commissioner Dorsey asked how much this item may sell for, and Public Works Director Charles Metzger said the amount is not yet known. Mayor Saliba confirmed with Mr. Metzger that he will provide this information when available. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-53 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Housing Authority of the City of Dothan, Alabama to continue the Public Housing Drug Elimination Program by providing police officers for assignment at the public housing developments for a one-year period, at an estimated cost of $744,852.00 with $175,000.00 being reimbursed to the City. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey. Police Chief Steve Parrish confirmed for Commissioner Dorsey that this amount funds eight police officers to work in the HUD housing areas. Chief Parrish said the Housing Authority will reimburse twenty-five percent of the cost and additional money has been budgeted for concentrated patrols in those areas when the need arises. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-54 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Wiregrass High School Umpires Association for two certified referees to officiate during the Dothan Diamond Softball Classic at a cost of $60.00 per game. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-55 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Southeast Alabama Softball Umpires Association for two certified referees to officiate during the Dothan Diamond Softball Classic at a cost of $60.00 per game. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-56 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for the sponsorship of Dothan Leisure Services Youth Baseball/Softball for 2020. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Minutes of the Board of Commissioners – February 18, 2020, continued. Mayor Saliba introduced Resolution No. 2020-57 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of January, 2020 in the amount of $17,613,062.09. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Bullard and Terry Bullard for the right-of-way for Brookside Drive Bridge Replacement Project, motion seconded by Commissioner Crutchfield. Commissioner Crutchfield asked if this is the last deed and Public Works Director Charles Metzger said he believes this wraps it up. There being no further discussion, the motion to accept was unanimously carried.
