BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 4, 2020 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, February 4, 2020 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Stacy Stafford, Southside Baptist Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of January 21, 2020, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming February, 2020 as “2-1-1 Day” in the City of Dothan. Mike Walton and David Duke, Wiregrass 2-1-1, were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming February 11, 2020 as “Career and Technical Education Month” in the City of Dothan. Chris Duke, Director of Career Technology Education & Workforce Development, and student leaders representing career technical programs were present for the proclamation. Mayor Saliba invited Police Chief Steve Parrish, Major Will Benny, Captain Bubba Ott, Captain Todd David, and officers who were top fundraisers to make a check presentation. Chief Parrish introduced Carmen Maddox with Children’s of Alabama, and he talked about the Police Department’s “No Shave November” fundraiser which is now in its fourth year. Ms. Maddox thanked all the men and women who do this fundraiser each year, and she said it is one of their top fundraisers in the Wiregrass. She said this money goes to several different areas including their cancer center and Christmas present program. She presented a check in the amount of $25,674.57 on behalf of the Dothan Police Department to Children’s of Alabama. Chief Parrish said over $106,000 has been raised the last four years. He said this is a group effort, and he expressed appreciation to the community for their support, the officers who raised money, department employees Natalie Stonestreet and Jena Wallace who account for funds raised, and Bob Woodall for sponsoring steak dinners for the division who collects the highest amount. Commissioner Kirkland thanked the officers and said he has a grandson who had a heart transplant at Children’s Hospital and will soon be twenty years old. Commissioner Dorsey requested that our litter ordinance be revisited for signage and other ways to revamp. He said a particular area in need is the east side part of town in the Lake Street area, and he asked that we look at other places to see what they are doing. Commissioner Fleming thanked Commissioner Dorsey for all he continues to do in giving of his time and resources and contributing financially to the Dothan Wolves basketball program. He thanked Commissioner Kirkland for sponsoring the breakfast for the Dothan Wolves Girls Bowling Team at the state championship where they finished 14th out of 95 teams. Commissioner Fleming said he knows the basketball world has been rocked by the recent death of the nine individuals, including Kobe and Gigi Bryant, in the helicopter crash. He said we have also lost a giant of our own in Coach Warren Reynolds whose funeral was held this past Saturday. He said Coach Reynolds Minutes of the Board of Commissioners – February 4, 2020, continued. was part of the “Ten Tall Men” basketball team that played at Carver High, and he is the most decorated coach to ever come out of Dothan, having coached several Division 1 universities and players who played in the NBA. He said Coach Reynolds was a true, giving individual for all that he did for our community. Commissioner Fleming announced that there are numerous African American history programs coming up, including a Pan-Hellenic Council, which he is a member of and consists of members from a number of fraternities and sororities, and they will have Greek Day at Patterson Street Free Will Baptist Church on Sunday, February 16th at 10:00 a.m. Commissioner Kirkland said he would like to thank the police officers who responded to a recent incident at Waffle House that occurred while he was there having breakfast. He said he appreciates our first responders for what they do. Commissioner Ferguson congratulated Police Chief Steve Parrish, Fire Chief Larry Williams, General Services Director Randy Morris, and everyone involved in the Wiregrass Public Safety Center. He said this is a phenomenal state-of-the-art facility, it is a game changer, and may be the best thing we have done since he’s been a part of this Commission. Commissioner Kenward reiterated Commissioner Dorsey’s concern regarding litter. She said she was very impressed with the Love Dothan presentation given by City Manager Cowper last week and the thought behind loving and embracing where you live. She said she is not from here, she chose to be here, and she chooses to be here. She said she loves this community and littering is one of the things she sees that we can easily stop by taking pride in our city and putting trash where it belongs. She said she is fully engaged in moving forward with Love Dothan and there are many facets, including working with our City staff and elected officials, and she encouraged others to learn more information. Commissioner Kenward said she has received some questions regarding the Wiregrass Public Safety Center from the general public as to when they will have an opportunity to tour and get involved. She confirmed with Chief Parrish that this information will be shared with our citizens through press releases, etc. Commissioner Crutchfield thanked City Manager Cowper for his Love Dothan presentation. He said the program was very well attended and he hopes we can take some of the good ideas presented to make this an even better community. Commissioner Crutchfield said he has reached out to just about every one of our department heads in the last two weeks and he thanked them for their response to inquiries he received. City Manager Cowper made the following announcements and comments:  The Leisure Services Therapeutic Program will hold their Valentine Dance on Friday, February 7th from 6:00 until 8:00 p.m. at Wiregrass Park Gym.  The Visit Dothan Softball Tournament hosted by Chipola College will take place this weekend at James Oates Park.  The Azalea-Dogwood Festival Pageant is Saturday, February 8th starting at 7:30 p.m. in the Opera House.  Hits for Heroes will kick-off two weeks of events with a choral sing-off in the Civic Center on Tuesday, February 11th.  City offices will be closed on Monday, February 17th in observance of Presidents’ Day. Monday residents will receive garbage pickup on Wednesday, February 19th.  The Mardi Gras Parade will take place on Saturday, February 22 nd starting in the Garden District and ending on Foster Street. Everybody is encouraged to come out for this fun community event. Minutes of the Board of Commissioners – February 4, 2020, continued. Mayor Saliba introduced the application of Worawadee Pattanapong for a Special Retail License – (More Than 30 Days) (On Premise) for Rob and Dave’s, located at 182 South Foster Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Crutchfield moved for approval, motion seconded by Commissioner Kenward. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba introduced Resolution No. 2020-34 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetative growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on March 3, 2020. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Upon Commissioner Dorsey’s inquiry, Planning Director Todd McDonald confirmed there is a quicker process for those who have repeat violations within a twelve-month period, and he added that there is an item on today’s agenda to assess costs incurred for some repeat offenders. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-35 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Numbers 2019-261, 2019-272, 2019-273 and 2019-308 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-36 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-37 (recorded in Ordinance Book No._______at Page_______), entering into a cooperative agreement with ALDOT for maintenance and mowing of public right-of-ways on various routes in Dothan with reimbursement of up to $50,000.00 per year to the City. Commissioner Fleming moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Kirkland thanked Public Works Director Charles Metzger and his department for getting the State to help us with this effort. Commissioner Ferguson also expressed his appreciation and said this program was born out of one of the Commission’s planning sessions. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-38 (recorded in Ordinance Book No._______at Page_______), entering into Supplemental Agreement No. 1 with the State of Alabama for construction improvements, for CR-25 (Denton Road) Add lanes, from SR-210 (Ross Clark Circle) to Westgate Parkway. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Dorsey inquired into the timeline of this project. Mr. Metzger said the request for bids is anticipated to be done by Alabama Department of Transportation (ALDOT) at the end of March or early April, and he added that cable and telephone utilities are still being moved. Mr. Metzger confirmed for Commissioner Dorsey that a detour will not be needed through much of the work since the bridge has been widened and sidewalks will be constructed on both sides of the road. Commissioner Kenward said part of the Love Dothan initiative is to love those orange barrels because they are a sign of progress. She said we have a lot of construction going on which is a good thing, and she advised everyone to give themselves a little extra time when traveling through these areas. Mayor Saliba introduced Resolution No. 2020-39 (recorded in Ordinance Book No._______at Page_______), approving the Final Summary Change Order with Blankenship Contracting, Inc., for the Cherokee Avenue and Cornell Avenue Sewer Improvements, which results in a cost increase for the total contract bid in the amount of $25,052.76 making the final adjusted contract price $608,435.76, and appropriating funds for said Change Order. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-40 (recorded in Ordinance Book No._______at Page_______), entering into an amended agreement with Atkins North America, Inc. for additional man-day hours for Construction Engineering and Inspection of the water and sanitary sewer utility relocations (Additional Lanes on SR-210 Ross Clark Circle from Bauman Drive to North Cherokee Avenue), for a fee of $66,886.47, which brings the total amended agreement amount to $424,907.47. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-41 (recorded in Ordinance Book No._______at Page_______), awarding the bid and entering into a contract with McCord Contract Floors, Inc., to replace the carpet around the wave pool at Water World, in the amount of $186,300.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Ferguson asked about the lifespan of the carpet. Acting Leisure Services Director Kim Meeker said they had the contractor tie a number of things into the lifetime limited warranty including that the carpet will never edge ravel. He said he had hoped to get a warranty for ultraviolet but this was not available. Commissioner Ferguson asked when the carpet was last replaced, and Aquatics Manager Kelly Carter replied 2008. Commissioner Dorsey said it is good to see this is a local contractor. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-42 (recorded in Ordinance Book No._______at Page_______), approving a Petty Cash Fund, in the amount of $100.00, for the Police Department to be used for the Wiregrass Public Safety Training Center. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-43 (recorded in Ordinance Book No._______at Page_______), amending Resolution No. 2019-83, agreement with Exceleron Software, LLC, to reflect electronic bill present fee changes. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-44 (recorded in Ordinance Book No._______at Page_______), entering into a contract with CentralSquare for software development contingency to complete the integration of CentralSquare’s Customer Information System and Exceleron’s Customer Usage Monitoring System, at an approximate cost of $7,040.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Kenward requested further explanation of this item. Information Technology Director Jack Mason clarified that there are four software parties involved in the Advanced Metering Infrastructure (AMI) project, multiple interfaces are required, and this additional programming is needed for the system to work as desired. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-45 (recorded in Ordinance Book No._______at Page_______), accepting a 100% reimbursable grant from the State of Alabama Mutual Aid System (AMAS) to be used for purchasing equipment and training for our regional response teams, in the amount of $13,228.00, and appropriating funds for said grant. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted.
