BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MAY 5, 2020 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, May 5, 2020 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, and David Crutchfield. Commissioner Beth Kenward was absent. Also present were City Manager Kevin Cowper and City Clerk Tammy Danner, who recorded the Minutes of the Meeting. Mayor Saliba called the meeting to order. Personnel Director Delvick McKay led in prayer, afterwhich Commissioner Kirkland led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of April 7, 2020, be approved, motion seconded by Commissioner Crutchfield and unanimously approved. Commissioner Dorsey expressed appreciation to staff and City Manager Cowper for the awesome job they are doing through this pandemic, and he thanked Mayor Saliba for his leadership and communication. Commissioner Crutchfield conveyed his condolences to the family of Bill Lisenby, who passed away yesterday. He said Mr. Lisenby had been very instrumental with Dixie Youth Baseball for years and served with the City after his retirement. Commissioner Crutchfield concurred with Commissioner Dorsey and said he appreciates our staff as they have done a great job in tough times. Commissioner Fleming also concurred with these sentiments and said he appreciates everyone for their help with keeping in touch with citizens, getting the proper information out, and assisting in the community. Commissioner Fleming said he and his family, and he’s sure he speaks for everyone, will continue to pray and show our love to Commissioner Ferguson for all that he and his family are going through right now. Commissioner Ferguson thanked everyone for their prayers, calls, texts, cards, food, and all the love expressed in the loss of his mother. He said these are dark days, but we know God is good and graceful, and we will get through it. Commissioner Kirkland said we appreciate our utility workers and this is the month we recognize them. He said we recently sent crews to Alexander City and Troy to provide aid after the storm, and in a meeting he attended Thursday, the mayor of Alexander City sent his appreciation to the City of Dothan for helping them. Mayor Saliba thanked everyone and concurred with their comments. He said we are going through confusing and frustrating times, but he believes there is light at the end of tunnel and we should focus on the good in the hopes that more and more businesses can continue to open up so that people can get back to work, while at the same time being careful and watching out for our citizens who are most vulnerable to the virus. He said he would like to thank City Manager Cowper, all of our staff, our first responders, and everyone who is doing a great job, especially during these harder than normal times. Mayor Saliba introduced Resolution No. 2020-107 (recorded in Ordinance Book No._______at Page_______), continuing the tax levied on property situated in the Minutes of the Board of Commissioners – May 5, 2020, continued. City of Dothan at the rate of five (5) mills upon each one dollar ($1.00) of assessed value and fixing the compensation of the tax assessor and tax collector for collecting and assessing the tax. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-108 (recorded in Ordinance Book No._______at Page_______), submitting an application with the State of Alabama Department of Education for participation in COVID-19 Food Service Program for Children, entering into an agreement with the United States Department of Agriculture for administration of the program and entering into an agreement with Breakfast at Tammie’s for providing food services for the Summer Food Service Program for Children. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. City Manager Cowper explained while we have contracts for our regular feeding program, this item is to approve contracts for the COVID-19 feeding program, which is grant funded and currently in operation. He said we are providing approximately 1,050 meals per day right now and this program will continue through the end of May. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-109 (recorded in Ordinance Book No._______at Page_______), agreeing to aid Troy, Alabama in its efforts to recover from the devastation left by severe weather on April 19, 2020, by sending utility trucks, equipment, and City employees to operate this equipment. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-110 (recorded in Ordinance Book No._______at Page_______), agreeing to aid Alexander City, Alabama in its efforts to recover from the devastation left by severe weather on April 19, 2020, by sending utility trucks, equipment, and City employees to operate this equipment. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-111 (recorded in Ordinance Book No._______at Page_______), submitting a permit application and entering into an agreement with the Alabama Department of Transportation for work to be performed in the right-of-way as required for the 2020 Red Water Watermain Replacement Project A. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-112 (recorded in Ordinance Book No._______at Page_______), submitting the 2019 Municipal Water Pollution Prevention Annual Reports for the City’s three (3) wastewater treatment plants to the Alabama Department of Environmental Management. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-113 (recorded in Ordinance Book No._______at Page_______), approving the Final Summary Change Order for the contract with McCord Contract Floors, Inc. for a net increase of $2,500.00 and a final amount of $123,958.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-114 (recorded in Ordinance Book No._______at Page_______), entering into a supplemental agreement with the State of Alabama for construction improvements for Highway 84/ACOM Shared- Use Trail, and appropriating funds for said improvements. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kirkland. Upon Commissioner Crutchfield’s inquiry, City Manager Cowper said the State is closing out this project and this is for our share of the final bill. There being no further discussion, the resolution was unanimously adopted. Minutes of the Board of Commissioners – May 5, 2020, continued. Mayor Saliba introduced Resolution No. 2020-115 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with CDG Engineers & Associates for Construction Engineering Services for additional roadway lanes on Denton Road from SR-21 (Ross Clark Circle) to 0.10 miles south of Westgate Parkway, Project No. STPOA-9450(602) in accordance with the Agreement for Construction Engineering Services, for a not-to-exceed amount of $534,552.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Upon Mayor Saliba’s request, Public Works Director Charles Metzger provided additional information and an update. Mr. Metzger said this project was recently awarded to Wiregrass Construction and work is anticipated to take six to eight months or more, depending on weather. He said Wiregrass Construction is currently finishing up the landfill project, and therefore, work will hopefully begin soon on this project. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-116 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a grant from the Bureau of Justice Assistance under the 2020 Coronavirus Emergency Supplemental Funding Program, in the amount of $117,598.00. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-117 (recorded in Ordinance Book No._______at Page_______), accepting a grant award from the Federal Bureau of Investigation for reimbursement of overtime expenditures related to the Central Alabama Safe Streets Task Force in the amount of $18,649.00, and appropriating funds for said grant. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-118 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with CDW Government, LLC, to provide computer engineering services to setup a secure connection between the internal network and a hosted cloud server, at a not to exceed amount of $2,450.00. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-119 (recorded in Ordinance Book No._______at Page_______), appointing Lori Wilcoxon as a member of the Board of Zoning Adjustment. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba thanked Lori Wilcoxon for her service. Mayor Saliba introduced Resolution No. 2020-120 (recorded in Ordinance Book No._______at Page_______), appointing James “Dewayne” Bowman as a member of the Planning Commission. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-121 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of March, 2020 in the amount of $13,750,880.65. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-122 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City, and appropriating funds for said purchases.
