BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JULY 7, 2020 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, July 7, 2020 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Delvick McKay, Personnel Director, City of Dothan, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meetings of June 16 and June 23, 2020, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming July, 2020 as “Parks and Recreation Month” in the City of Dothan. Alison Hall, Director, Dothan Leisure Services was present for the proclamation. Commissioner Dorsey requested a hard date on the Cherry Street and Headland Avenue railroad crossing and asked if a public service announcement could be made when this date is known. Commissioner Dorsey asked if information has been obtained regarding the trail at Walton Park. Ms. Hall confirmed and said the information has been forwarded to Mayor Saliba. Commissioner Fleming said there was a ton of excitement in the city over the 4th of July weekend as far as fireworks go, and he thanked Police Chief Steve Parrish and Fire Chief Larry Williams for handling the many calls received and providing information. Commissioner Kirkland said the Commission voted a couple of meetings back to construct the Dothan Utilities Operations Center, and he is proud to say he took the invoice to AMEA and the money is now in the bank to pay for the building. Commissioner Kenward said there was a hotbed of activity in the Chapelwood area with the fireworks and she extended her thanks to Chief Williams and Chief Parrish for their response to calls. She said she wants to remind citizens this is not just us being hard about our ordinance; it is illegal to set off fireworks in the city limits and we do have a lot of veterans with PTSD. She said this hits close to home and those are the kinds of calls you do not want to get because fireworks cause them stress. Commissioner Crutchfield said he would like to thank our department heads, he has worked with most of them over the last couple of weeks. He said they, along with their staff, do a great job in trying to resolve issues. Mayor Saliba thanked everyone for their comments and the reminder about fireworks. He said a lot of calls were received about the fireworks, it continues to be an issue each year, and seems to have grown a bit more this year. Mayor Saliba said times continue to be tough, it seems chaos reigns these days, and it is easy to focus on the negative, but we need to continue to strive and preserve to focus on the positive things we have in our city, our community, and the Wiregrass because we are truly a blessed people. He said, on behalf of the Commission, we are very aware and in tune with what is going on with COVID-19, Minutes of the Board of Commissioners – July 7, 2020, continued. the fluid situation that it is, and it is not something we take lightly. He said it is very important to this Commission, the City, and our department heads, and we need our citizens to know we are monitoring it every day, doing our best to do what is best for our community, and will continue to do so. He said we are working and have been in communication with Governor Kay Ivey and her staff, the Alabama Department of Public Health, and other mayors; so, we are not an island unto ourselves and we are not relying only on our own opinions. We are reaching out to others, as well as listening to all of our citizens, and this is something that is very important and on our minds. Mayor Saliba announced a Public Hearing regarding the rezoning of property owned by Houston County Health Care Authority, located at 2020 Alexander Drive. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba announced a Public Hearing regarding the rezoning of property owned by Cottages Dothan, LLC, located at the NE corner of Bethlehem and Murphy Mill Roads (pending annexation). Mayor Saliba noted that this property has been annexed. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba announced a Public Hearing regarding the 2020-2024 Five Year Consolidated Plan and the 2020 Annual Action Plan Projects. Mayor Saliba introduced Ordinance No. 2020-174 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Houston County Health Care Authority, located at 2020 Alexander Drive from L-I (Light Industry) District to B-2 (Highway Commercial) District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2020-174, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Ordinance No. 2020-175 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Cottages Dothan, LLC, located at the NE corner of Bethlehem and Murphy Mill Roads from A-C (Agricultural Conservation) District to R-A (Apartments) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2020-175, motion seconded by Commissioner Crutchfield. Commissioner Kirkland said sewer fees were included in the first phase of this development and he asked if they will also apply to this phase. Mayor Saliba said he believes the sewer fees were handled at the beginning for the entire development and this phase will tie-in with no further action needed. Public Works Director Charles Metzger concurred that he also believes this to be the case but said Dothan Utilities Director Billy Mayes will be able to confirm. Mayor Saliba said if this is not the case that information will be communicated back to the Commission. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Saliba introduced Resolution No. 2020-176 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetative growth as injurious to the health, safety and welfare of the community as nuisances and calling for a Minutes of the Board of Commissioners – July 7, 2020, continued. public hearing to be held on the matter during the regularly scheduled commission meeting on August 4, 2020. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-177 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Numbers 2020-82 and 2020-143 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Kirkland thanked the staff who work on enforcement issues. He said it is tough sometimes trying to keep yards cut, houses clean, etc. and they do a great job trying to help us resolve these matters. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-178 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-179 (recorded in Ordinance Book No._______at Page_______), appointing Linda B. Cunningham as EEO & Professional Development Training Officer, at an annual salary of $75,000.00, to be payable on a biweekly basis, effective July 27, 2020. Commissioner Fleming moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Kenward said, having known Mrs. Cunningham for many years, this is a big win for our city and she is excited to bring her on board. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba thanked Mrs. Cunningham and welcomed her on board. Mayor Saliba introduced Resolution No. 2020-180 (recorded in Ordinance Book No._______at Page_______), appointing Andrew W. Love as General Services Director, at an annual salary of $125,000.00, to be payable on a biweekly basis, effective August 10, 2020. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Commissioner Kirkland said he has known Andy Love for a long time and this is a great hire as well. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-181 (recorded in Ordinance Book No._______at Page_______), approving the projects to be included in the 2020 Annual Action Plan Projects. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-182 (recorded in Ordinance Book No._______at Page_______), rescinding Resolution Number 1997-225 and entering into a Private Development Agreement with Azalea Terrace Home Owners Association (HOA) for the ownership and maintenance of the water facilities located at Azalea Terrace, Dothan, AL. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Crutchfield said this has been ongoing for as long as he can remember, and he thanked Dothan Utilities for working with the HOA to get this resolved. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-183 (recorded in Ordinance Book No._______at Page_______), approving a Change Order of the B0-21 Comprehensive Rehabilitation Project with BLD Services, LLC, for additional work throughout the City, at a cost increase of $205,109.07. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward. Commissioner Kenward requested clarification for public knowledge. Mayor Saliba introduced Resolution No. 2020-184 (recorded in Ordinance Book No._______at Page_______), entering into a Trademark Assignment with Wiregrass Foundation for the transference of the Wiregrass Public Safety Center logo. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-185 (recorded in Ordinance Book No._______at Page_______), appropriating $15,000.00 to the ASF Foundation to assist with the 2020 Alabama State Games XXXVIII. Commissioner Fleming moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-186 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with CentralSquare Payments for the acceptance of credit and debit cards at City offices and on-line for a three (3) year period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Fleming asked if this is the same company we had issues with previously, and if so, have they improved their security? City Manager Cowper confirmed it is the same company, and Finance Director Lisa Reeder said CentralSquare is turning over the payment processing to a third party. She said this agreement is with CentralSquare because the third party company’s software is with them. Commissioner Ferguson asked if this is for all payments, and Mrs. Reeder replied it is for business license and permits payments. She said Dothan Utilities payments are handled through a different software company because they are integrated with that system. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-187 (recorded in Ordinance Book No._______at Page_______), entering into a service agreement with Utility Associates, Inc., for the Body-Worn/In-Car Camera Video System, in the amount of $1,387,200.00, over a five-year period. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-188 (recorded in Ordinance Book No._______at Page_______), appointing Destiny Hosmer as a member of the Museum Board and re-appointing Mike Owen as a member of the Museum Board. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Crutchfield thanked both members for their service. There being no further discussion, the resolution was unanimously adopted. The need for an additional 125 Laserfiche Participation User subscriptions for form approvers/users has been requested due to social distancing measures due to the Covid-19 pandemic and the need for more departments to be involved than originally targeted for this project. 5 This is in addition to the $20,000 approved previously. 6 The actual total depends upon the combination of items chosen to purchase as required. Commissioner Kenward moved to accept a utility easement from Douglas Sinquefield on Avon Road, motion seconded by Commissioner Fleming and unanimously carried. Commissioner Ferguson moved to accept a utility easement from The Cove, LLC on Eddins Road, motion seconded by Commissioner Fleming. Commissioner Kirkland said this is his LLC so is abstaining from this vote. There being no further discussion, and upon the motion being put to vote, those voting “yea,” were Saliba, Dorsey, Fleming, Ferguson, Kenward, and Crutchfield; “nay:” none; “abstained:” Kirkland. The motion was carried by the majority of six "yeas" to one “abstention.” Commissioner Crutchfield moved to accept a construction easement from SMB Land, LLC for sanitary sewer for the Charleston Mills Subdivision, motion seconded by Commissioner Kenward and unanimously carried. Commissioner Kirkland moved to accept easements from Self Storage, LLC and Watson and Downs, LLC, needed to construct necessary improvements and appurtenances to existing utility facilities, motion seconded by Commissioner Kenward and unanimously carried. Minutes of the Board of Commissioners – July 7, 2020, continued. Commissioner Crutchfield moved to approve a damage claim filed by Patricia Peters in the amount of $20,000.00, motion seconded by Commissioner Ferguson and unanimously carried. Mayor Saliba announced the re-appointment of Precious Freeman as a member of the Dothan Housing Authority Board.
