BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING OCTOBER 6, 2020 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, October 6, 2020 with the following members present: Mayor Mark Saliba, Associate Commissioners Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Commissioners Kevin Dorsey and Janasky Fleming were absent. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Sister Miriam Fiduccia, St. Columba Catholic Church, then led in prayer, afterwhich Commissioner Crutchfield led in the Pledge of Allegiance to the Flag. Mayor Saliba noted Commissioner Dorsey is out today with sinus issues and Commissioner Fleming’s mother-in-law passed away. He said we all share in our condolences to Commissioner Fleming’s wife Tamika and the family during this time. Commissioner Kirkland moved that the Minutes of the Meeting of September 15, 2020, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Saliba invited to the podium Dothan Rotary Club President James Etheredge, Dothan Tuesday Rotary Club President Heidi Condrey, Rotary Miracle Field Foundation President Bruce McNeal, and Assistant Leisure Services Director – Operations Tyson Carter. Following brief introductions and discussion of the Clubs’ partnerships with the City, their fundraising efforts, and the Rotary Miracle Field initiative, a check in the amount of $10,000 was presented to Mayor Saliba from the Rotary Miracle Field Foundation. Mr. McNeal expressed appreciation to the City for allowing Mr. Carter to be a part of the Foundation’s Board. Mayor Saliba presented and read a proclamation, proclaiming October 6, 2020 as “Johnny Oppert Day” in the City of Dothan. Coach Oppert joined via livestream and Larry Patrick, representing the Oppert Family, was present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming October 23-31, 2020 as “Red Ribbon Week.” Judy Guiler, Executive Director Dothan-Houston County Substance Abuse Partnership, and Petra Ozbun, Youth Council Member, were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming October, 2020 as “Homeless Connect Month.” David Jamison, President of the Southeast Alabama Homeless Coalition, and Kody Kirchhoff, Executive Director of the Harbor, were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming October 4-10, 2020 as “Public Power Week.” Dothan Utilities Director Billy Mayes and General Line and Service Supervisor Allen McJunkins were present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming October 4-10, 2020 as “Fire Prevention Week.” Fire Chief Larry Williams and Battalion Chief David Hasty were present for the proclamation. Chief Williams and Battalion Chief Hasty presented 2020 Member of the Year Fire Department Awards to Firefighter Cole Crawford, Rookie of the Year; Firefighter Mitchell Tucker, Firefighter of the Year; and Sergeant Jeremy Alley, Sergeant of the Year. Captain Shane Lee (not present) received the award of Fire Officer of the Year. Minutes of the Board of Commissioners – October 6, 2020, continued. Commissioner Kirkland expressed a personal thanks to the Fire Department personnel who assisted a friend of his who has heart problems and recently called 9-1-1. He said the responders did a great job, they were very courteous and professional, and the Fire Department is appreciated for all they do for us. Commissioner Kirkland thanked everyone for their prayers in lifting up his friend Ken Napier who fought COVID-19 for eleven weeks and passed away on Sunday. Commissioner Crutchfield read a letter sent by a friend, who recently had a heart attack, to Fire Chief Larry Williams in gratitude to our Fire Department for their professional response and service provided in his time of need. Mayor Saliba requested everyone to continue to lift Mike Schmitz up in prayer as the next few days are critical in his recovery from surgery. Mr. Cowper, along with Fire Chief Larry Williams, recognized Jesse Taylor as our Employee of the Month for October, 2020. Mr. Cowper made the following announcements: • Beginning Saturday, October 10th from sunrise to sunset, outdoor basketball courts located at Andrew Belle, Doug Tew, Kinney Park, Pine Hills, Walter E. Byrd Park, and Wiregrass Park and all outdoor playgrounds will be open to the public. There will be associated rules and restrictions posted and information will be available on the City’s Facebook page, as well as through other media outlets. The hope is this will signal a little bit of a return to normalcy going forward. • City offices will be closed on Monday, October 12th for Columbus Day and Monday residents will receive garbage pickup on Wednesday, October 14th. Mayor Saliba introduced the application of John Moore for a Retail Beer and Retail Table Wine License (off premise) for Murphy Oil #7779, located at 3370 South Oates Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. Commissioner Kirkland moved for approval, motion seconded by Commissioner Crutchfield. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba introduced Resolution No. 2020-264 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetative growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-265 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetative growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on November 3, 2020. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-266 (recorded in Ordinance Book No._______at Page_______), requesting the legislative delegation for the City of Dothan, Alabama to introduce and support legislation that will provide for an alternative procedure for abating tall grass and weeds. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Kenward said she was impressed with the reduced timeline and cost savings, and she asked for these differences to be read for the sake of public knowledge. Planning Director Todd McDonald reviewed the changes mentioned and the next Minutes of the Board of Commissioners – October 6, 2020, continued. steps in the process. Mr. Cowper said we appreciate Representative Paul Lee and his leadership on this legislation, as well as the Commission’s support. He said this is critical for our Love Dothan and Love Your Neighborhood programs, it will condense the timeframe while still maintaining due process, and it will allow us to continue our beautification efforts. He thanked Mr. McDonald and his staff for working hard on this. Mayor Saliba said this is a good change and we appreciate it. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-267 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed and other related documents to Max Foote Construction Company, LLC for the City of Dothan New Cypress Creek WWTP Ultraviolet (UV) Disinfection Equipment Installation for the sum of $252,600.00, and appropriating funds for said project. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-268 (recorded in Ordinance Book No._______at Page_______), extending the agreement with the Town of Kinsey to temporarily continue sewer billings based upon monthly water meter readings set forth in City of Dothan Resolution 2019-124, to December, 2021. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Crutchfield said we have done this before, and he asked if this will be the end of the extensions. Dothan Utilities Director Billy Mayes said he believes this should get Kinsey to the point where they need to be and the City has been flexible. Commissioner Kenward confirmed with Mr. Mayes that the City has allowed this time because Kinsey has been waiting on some grant funding in order to make the required changes. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-269 (recorded in Ordinance Book No._______at Page_______), agreeing to aid Foley, Alabama in its efforts to recover from the devastation left by severe weather on September 16, 2020, by sending utility trucks, equipment, and City employees to operate this equipment. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland. Mayor Saliba thanked all those who respond during these times and said he appreciates what this says about our community. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-270 (recorded in Ordinance Book No._______at Page_______), issuing an emergency purchase order to Blankenship Contracting, Inc. of Dothan, Alabama for $62,500.00 to rebuild a section of the 30-inch diameter sanitary sewer trunk line behind 201 Hagler Road, and appropriating funds for said project. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward. Commissioner Kenward requested an explanation for public record. Mr. Mayes said the creek washed a line out, and he discussed the work and equipment needed. He said this effort is in process, and as soon as materials are received, the work will be done. Mr. Mayes confirmed for Commissioner Kenward that the money is coming from the fund balance. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-271 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Network Technology Services (NTS) to provide IT infrastructure support and network design services for an annual amount of $96,000.00, and appropriating funds for said services. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. Mayor Saliba noted that this was previously handled in-house, and he confirmed with Mr. Cowper that this is still the intent. Mr. Cowper said our IT Department has a vacant upper-level position that we have not been able to successfully recruit at this time, so we are relying on some consulting services to get us through until we are able to hire someone. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2020-272 (recorded in Ordinance Book No._______at Page_______), entering into a contract with ESO for installation of the IFC 2015 National Codeset software package on the City Firehouse Minutes of the Board of Commissioners – October 6, 2020, continued. application to bring the application up to the proper national codes used by the Dothan Fire Department, at a cost of $1,160.00. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-273 (recorded in Ordinance Book No._______at Page_______), entering into a Community Traffic Safety Program Grant Participation Agreement with Enterprise State Community College through its Southeast Alabama Highway Safety Office for participation in the Alabama Department of Economic and Community Affairs Law Enforcement Traffic Safety grant programs. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2020-274 (recorded in Ordinance Book No._______at Page_______), rescinding Resolution 2020-245 and entering into an agreement with A-One Business Solutions, LLC for maintenance of a Konica Minolta color copier located at Doug Tew Recreation Center for a twelve (12) month period at a monthly cost of $26.50. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted.
