Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, April 16, 2013, beginning at 6:00 PM in the 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez City Treasurer Gina Gillis Mayor Purcell calls the meeting to order at 6:03 p.m. All present except Jon Thompson, Alan Bojorquez and Gina Gillis. Also present City Attorney Jill Hoffman. II. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). Convened to Executive Session at 6:05 p.m. Those present: Mayor Purcell, Councilman Kroll, Councilman King, Councilman Alba, Mayor Pro Tem Foulds, Councilman Busbey, Jill Hoffman, City Administrator Michelle Fischer, Deputy City Administrator Ginger Faught, and City Secretary Jo Ann Touchstone. Reconvened to Regular Session at 6:10 p.m. A. Consideration of recommendation from the City of Dripping Springs Economic  Development Committee regarding request for financial or other incentives for a business project, that being the Texas Longhorn Cattle and Trail Drivers Museum, Inc. (Consultation with Attorney Tex. Gov’t Code §551.071 and Economic Development Tex. Gov’t Code §551.086). III. PLEDGE OF ALLEGIANCE A. Pledge of Allegiance – leads the pledge. IV. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. No one speaks. V. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of 2013 Founders Day Contracts: 1. Pro Tech Automotive for Car Bash 2. Waste Partners of Texas, Inc. for Portable Toilets 3. Hill Country Bible Church for Kids Area Inflatables 4. Rusty Fosdick for Sound Production on the Party Stage 5. Catch a Dream Band for Musical Entertainment 6. Carport Casanovas for Musical Entertainment 7. Bobby Pounds for Musical Entertainment 8. Lonnie Atkinson for Musical Entertainment 9. Jim Halfpenny for Musical Entertainment Councilman Kroll motions to approve. Councilman Alba seconds. Motion passes, 5-0. VI. BUSINESS Consideration and Possible Action On: A. Dripping Springs Ranch Park Event Center Operating Budget (Sponsor: Mayor Purcell) – Mayor Pro Tem Foulds motions to approve amended budget to send to  County. Councilman Alba seconds. Motion passes, 5-0. B. Gross Maximum Price(s) proposed by Waldrop Construction for Construction Manager at Risk services to construct all or specified phases of the Dripping Springs Ranch Park Event Center and Related Improvements, including Phase 2 (Sponsor: Mayor Purcell) - Councilman King motions “to make a minor amendment to the A133 Contract between the City and Waldrop Construction for the Dripping Springs Ranch Park Event Center & Related Improvements to change the term used in the exhibits of Section 12.2 from “sitework package improvements” to “general package improvements” so that that line item now includes the $33,964.23 initial cost of installing plumbing in the Phase I GMP instead of the Phase II GMP” Councilman Alba seconds. Motion passes, 5-0. C. Discussion and Possible Action regarding Financing Options for Phase 2 of Dripping Springs Ranch Park Event Center and Related Improvements (Sponsor: Mayor Purcell) – No action taken. D. Letter of Intent with Doyle Fellers for Lease of Stephenson Building for Texas Longhorn Cattle and Trail Drivers Museum – Mayor Pro Tem Foulds motions to approve ninety day extension. Councilman Alba seconds. Motion passes, 5-0. E. Proposal from Klotz Associates for Additional Services Associated with the Mercer Street Pedestrian Improvements Project (Sponsor: Mayor Purcell) – Mayor Pro Tem Foulds motions to approve. Councilman Alba seconds. Motion passes, 5-0. F. Dripping Springs Water Supply Corporation Water Line Construction in Mercer Street Right-of-Way (Sponsor: Mayor Purcell) – City Administrator Michelle Fischer states DSWSC had budgeted $120K, but due to improvements costs will increase with relocation of line. Cost estimates are $188K, which they have asked for a credit for development not to exceed $68K or cost of budget. Mayor Pro Tem Foulds motions to approve amount $68,000 or actual cost, whichever is less. Councilman Alba seconds. Motion passes, 4-0-1. Councilman Kroll abstains. G. Proposal for City Hall Building Roof Replacement (Sponsor: Mayor Pro Tem Foulds) – No action taken. H. Purchase of Electronic Tablets for City Council (Sponsor: Mayor Pro Tem Foulds) – Councilman King motions to approve purchase of refurbished I Pads. Councilman Alba seconds. Motion passes, 4-1. Councilman Busbey opposed. VII. ADJOURN Councilman Alba motions to adjourn. Councilman Kroll seconds. Motion passes, 5-0. Meeting adjourned at 7:20 p.m.
