Minutes of Special Meeting City Council City of Dripping Springs A Special Meeting of the City Council of City of Dripping Springs was held Thursday, April 25, 2013, beginning at 6:00 PM in the 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez Mayor Purcell calls the meeting to order at 6:00 p.m. All present except Councilman Kroll and Alan Bojorquez. Also present Attorney Jill Hoffman and Treasurer Gina Gillis. II. PLEDGE OF ALLEGIANCE A. Pledge of Allegiance – Councilman King leads the pledge. III. BUSINESS Consideration and Possible Action On: A. Ordinance No. 1720.12 - An Ordinance of the City of Dripping Springs Amending the Dripping Springs Code of Ordinances, Article 20.02 Section 20.02.006(c) (wastewater service rates) to provide for an excess use base charge (Sponsor: Mayor Pro Tem Foulds) 1. Public Hearing – No one speaks. 2. Ordinance No. 1720.12 – Councilman Alba motion to approve the ordinance and to waive excess use fees for residential customers until excess use exceeds 1500 gallons per month. Councilman Busbey seconds. Motion passes, 4-0. B. Gross Maximum Price(s) proposed by Waldrop Construction for Construction Manager at Risk services to construct all or specified phases of the Dripping Springs Ranch Park Event Center and Related Improvements, including Phase II (Sponsor: Mayor Purcell) – Mayor Pro Tem Foulds motions to accept the guaranteed maximum price (GMP) of $1,502,798.91 proposed by Waldrop Construction for Phase II of the Dripping Springs Ranch Park Event Center and related improvements and as a result, to amend the contract between the city and Waldrop Construction to incorporate the GMP of Phase II into the contract. C. Selection of a Financing Option for Phase II of the Dripping Springs Events Center and Related Improvements (Sponsor: Mayor Purcell)- Councilman King motions to authorize the Mayor to execute the funding contract with Hays County. Mayor Pro Tem Foulds seconds. Motion passes, 4-0. D. Proposal for City Hall Building Roof Replacement (Sponsor: Mayor Pro Tem Foulds) – Mayor Pro Tem Foulds motions to approve the bid for roof replacement with shingles from TEK Construction. Councilman King seconds. Motion passes, 4-0. E. Acceptance of Bid and Possible Award of Contract for the City of Dripping Springs South Regional Wastewater System Wastewater Collection System Extension to Serve Dripping Springs Independent School District's Dripping Springs Elementary School – Councilman Busbey motions to accept the bid and authorize Mayor Pro Tem Foulds and staff to negotiate the contract in Item III. E. IV. WORKSHOP No Action to be Taken: A. Letter of Intent with Doyle Fellers for Lease of Stephenson Building for Texas Longhorn Cattle and Trail Drivers Museum – No action taken. V. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). Adjourned to Executive Session at 6:15 p.m. Those present: Mayor Purcell, Councilman Alba, Councilman Busbey, Councilman King, Mayor Pro Tem Foulds, Michelle Fischer, Ginger Faught, Jo Ann Touchstone and Jill Hoffman. Reconvened to Regular Session at 6:45 p.m. A. Consultation with City Attorney regarding the status of pending Agreements between the City of Dripping Springs, Texas and Headwaters Municipal Utility District of Hays County, Texas; Robert Pittenger Co.; and Austin Highway 290, LLC, that were approved with certain conditions by City Council on October 12, 2010, regarding water service to be provided by the City (551.071: Consultation with Attorney) B. Consultation with City Attorney regarding rights and obligations of the contracting parties under the following agreements which were assigned to the West Travis County Public Utility Agency as of March 19, 2012: 1. "Wholesale Water Services Agreement between the Lower Colorado River Authority and the City of Dripping Springs, Texas, for Headwaters Municipal Utility District" dated September 15, 2008; and 2. "Wholesale Water Supply Agreement between the Lower Colorado River Authority and the City of Dripping Springs" dated March 11, 2003 VI. ADJOURN – Councilman Busbey motions to adjourn. Councilman Alba seconds. Motion passes, 4-0. Meeting adjourned at 6:49 p.m.
