A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, August
20, 2013, beginning at 5:30 PM in the 511 Mercer Street, Dripping Springs, Texas.
I. CALL TO ORDER AND ROLL CALL

Mayor Pro Tem Foulds calls meeting to order at 6:00 p.m. All present except Mayor
Purcell, Ginger Faught and Larry McClung.
II. WORKSHOP
No action to be taken. Staff Reports regarding Consent, Site Developments,
Subdivisions, Zoning, On Site Sewage Facilities, Signs, Variances, Waivers,
Special Exceptions, Annexations, Alternate Standards, Business, and Other
Agenda Items listed below.
A. Proposed Fiscal Year 2014 Budget
1. Review and Discuss Proposed FY 2014 Budget
2. Review and Discuss Commission/Committee Budget Requests
3. Review and Discuss Budget Requests
Workshop begins at 6:50 p.m. Mayor Pro Tem Foulds exits meeting.
Councilman Busbey chairs workshop.
III. EXECUTIVE SESSION
The City Council for the City of Dripping Springs has the right to adjourn into
executive session at any time during the course of this meeting to discuss any matter
as authorized by Texas Government Code Sections 551.071 (Consultation with
Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations
about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations
about Security Devices), and 551.086 (Economic Development).
Convened to Executive Session at 6:14 p.m. Those present: Mayor Pro Tem Foulds,
Councilman Kroll, Councilman King, Councilman Alba, Councilman Busbey, City
Administrator Michelle Fischer, Gina Gillis, City Secretary Jo Ann Touchstone,
Gandolf Burrus and Kevin Hoffman. Reconvened to Regular Session at 6:45 p.m.
Consultation with City Attorney Regarding Receive Report of Bid Opening for the
CAMPO Mercer Street Sidewalk Construction Project CSJ 0914-33-065 and
Recommendation of Award to Apparent Low Bidder from Klotz Associates
(Consultation with City Attorney; 551:071)
IV. PLEDGE OF ALLEGIANCE
A. Pledge of Allegiance – Councilman Busbey leads the pledge.
V. PRESENTATION OF CITIZENS
Floor open to discussion on any subject. No action may be taken by law. Citizens
wishing to speak shall do so after being recognized by the Mayor. The Mayor and
City Council may establish a time limit as necessary.
Mark Key – States support for project. Mr. Key states that we do not need to answer
to the City of Austin.
Ron Crain – with Dripping Springs Ag Boosters Club. Mr. Crain submits request to
hold annual Bon Fire at DSRP and requests Council to approve putting materials at
DSRP prior to event and states other items in the request are being addressed.
VI. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE
FACILITIES/SIGNS/VARIANCES/WAIVERS/ALTERNATE
STANDARDS/ANNEXATIONS
Consideration and Possible Action On:
A. Public Hearing on Proposed Annexation for inclusion of the Following Property
into the City of Dripping Springs Corporate City Limits: Being all of that certain
Tract or Parcel of Land out of and a Part of the Stiles Fowler Survey Number 31,
Abstract 174, Situated in Hays County, Texas, Said Tract of Land Being More
Particularly Described as Being out of and a Part of that Certain 2.804 Acre
Tract of Land Conveyed to Key Enterprises, Inc., in Volume 4479, Page 241 of
the Official Public Records of Hays County, Texas (aka Twisted X Brewery) –
No one speaks.
B. Request for termination of the Rutherford Ranch Development Agreement
between the City of Dripping Springs and Cypress Hays, L.P. (now N. Hays
Investors, L.P.) as it relates to the approximately 1,558 acres owned by N. Hays
Investors, L.P. which is located north of FM 967, east of Brangus Road, Crystal
Hills, and Goldenwood Way, south of Bear Creek and west of Little Bear Creek,
Mathew Thompson, Applicant
1. Planning Director's Report – Planning Director Jon Thompson, report on
file. Staff recommends approval.
2. Termination of Development Agreement – Councilman Busbey motions to
terminate development agreement. Councilman King seconds. Motion
passes. 5-0.
C. Preliminary Plat, Final Plat, and Construction Plans for the “O Bar Ranch”
Subdivision (15 Residential Lots and 1 ROW Lot for a Private Road), James
McCann, P.E., Pape Dawson Engineering, Applicant
1. Planning Director's Report – Planning Director Jon Thompson, report on
file. Planning Director Jon Thompson states Mr. Tull reported he had
spoken to the developer and addressed issues.
2. Waiver to length of cul-de-sac – (DS Code of Ordinances, Chapter 28,
Exhibit A, Section 11.22) – Councilman Busbey motions to approve with
compliance to City lighting ordinance. Councilman Alba seconds.
Councilman Kroll states he would be supportive of connectivity however
with 100 acre lots it may not be feasible. Motion passes, 5-0.
3. Waiver from connecting to adjacent tracts (DS Code of Ordinances, Chapter
28, Exhibit A, Section 11.9.1(b)) – Mayor Pro Tem Foulds motions to
approve. Councilman Alba seconds. Motion passes, 5-0.
4. Preliminary & Final Plat & Construction Plans – Councilman Alba motions
to approve. Councilman Kroll seconds. Motion passes, 5-0.
VII. BUSINESS
Consideration and Possible Action On:
A. Receive Report of Bid Opening for the CAMPO Mercer Street Sidewalk
Construction Project CSJ 0914-33-065 and Recommendation of Award to
Apparent Low Bidder from Klotz Associates – Kevin Hoffman gives report.
B. Consider and Possibly Take Action on Award of a Construction Contract for
CAMPO Mercer Street Sidewalk Construction Project CSJ 0914-33-065 to the
Apparent Low Bidder Pending Concurrence and Approval by the Texas
Department of Transportation – Councilman King motions to approve low
bidder, Myers Construction. Councilman Alba seconds. VOTE: Councilman
King – YES. Councilman Busbey – NO. Mayor Pro Tem Foulds – YES.
Councilman Kroll – NO. Councilman Alba – YES. Motion passes, 3-2.
C. Request from Austin Waldorf School for a Reduction of Rental Fees for the Use
of Field #6 at the Dripping Springs Sports & Recreation Park August 20th and
27th, Spetember 3rd, and October 1st and 3rd, 2013, Chad Lipscomb, Coach of
Austin Waldorf School Soccer Team (Sponsor: Councilman Alba) – Councilman
King motions to approve. Mayor Pro Tem Foulds seconds. Motion passes, 5-0.
D. Resolution No. 2013-22 - A Resolution of the City of Dripping Springs
Accepting the Maintenance and Contruction for North Rob Shelton Boulevard
(Sponsor: Mayor Purcell) – Councilman Alba motions to approve. Councilman
King seconds. Motion passes, 5-0.
VIII. ADJOURN – Councilman Kroll motions to adjourn. Councilman Alba seconds.
Motion passes, 4-0. Meeting adjourned at 7:56 p.m.
