Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, September 17, 2013, beginning at 6:00 PM in the 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez Mayor Pro Tem Foulds calls meeting to order at 6:02 p.m. All present except Mayor Purcell and Ginger Faught. II. EXECUTIVE SESSION The Planning and Zoning Commission for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). No executive session held. III. PLEDGE OF ALLEGIANCE A. Pledge of Allegiance – Councilman Busbey leads the pledge. IV. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. Mr. Bruce Turbow, citizen, states support for the City and Dripping Springs Water Supply Corporation being one entity and would like to further discussions with the Council to this effort. Mr. Turbow compliments the Mayor for his vision of DSRP and states the recent Chamber event was a great success at the new venue. Mr. Glenn Goode, resident/neighbor of DS Ranch Park, states that he would like to meet directly with Mayor, Council or Council Member to discuss an oak grove that was destroyed during construction and the development agreement that outlined the protection of the grove. Mayor Pro Tem Foulds states that someone will meet with Mr. Goode and directs staff to relay that communication to Mr. Goode. V. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE FACILITIES/SIGNS/VARIANCES/WAIVERS/ALTERNATE STANDARDS/ANNEXATIONS Consideration and Possbile Action On: A. Final Plat & Construction Plans – Counts Ranch, Phase 2 located at the east end of Blue Ridge Drive, and south of Butler Ranch Drive, 134.4686 acres out of the P.A. Smith Survey and C.H. Mallot Survey, Hays County, Texas, John Lloyd, Applicant 1. Presentation – Ken Martin, P.E., Murphee Engineering, states request and is available for questions. 2. Planning Director's Report – Planning Director Jon Thompson, report on file. Staff recommends approval. 3. Final Plat & Construction Plans – Councilman Alba motion to approve staff recommendations. Councilman Kroll seconds. Councilman Kroll inquires regarding connectivity. Motion passes, 5-0. VI. BUSINESS Consideration and Possible Action On: A. Ordinance No. 1110.11 - An Ordinance of the City of Dripping Springs, Texas, Approving the 2013 Ad Valorem Tax Rate And Levy of Fifteen Thousandth Cents ($0.15) Per One Hundred Dollars ($100) of Assessed Valuation of All Taxable Property Within the Corporate Limits of the City; Providing for an Exemption on Residence Homesteads of Persons Who are Disabled or 65 Years of Age or Older; Providing for Penalties and Interest; Providing That This Ordinance Shall Be Cumulative of All Ordinances; Providing For a Severability Clause; Providing for a Savings Clause; Providing for Engrossment and Enrollment; Providing for Publication; and Providing an Effective Date 1. Public Hearing – Mr. Bruce Turbow asks Council to please keep tax rate low for citizens as it keeps creeping higher and needs to be kept in check. 2. Adoption of Ordinance No. 1110.11 – Councilman Busbey motions to reconsider at council meeting scheduled for Monday, September 23rd. Councilman King seconds. Motion passes, 5-0. B. Ordinance No. 1100.56 – An Ordinance of the City of Dripping Springs, Texas, Adopting the Budget for the City of Dripping Springs, Texas, for the Fiscal Year Beginning October 1, 2013 and Ending September 30, 2014; Providing for an Intrafund and Interfund Transfers; and Declaring an Effective Date 1. Public Hearing – No one speaks. 2. Adoption of Ordinance No. 1100.56 – Mayor Pro Tem Foulds motions to postpone action until meeting on Monday, September 23rd. Councilman Busbey seconds. Motion passes, 5-0. VII. ADJOURN – Councilman Alba motions to adjourn. Commissioner Kroll seconds. Motion passes, 5-0. Meeting adjourned at 6:26 p.m.
