Minutes of Special Meeting City Council City of Dripping Springs A Special Meeting of the City Council of City of Dripping Springs was held Monday, September 23, 2013, beginning at 5:30 PM in the 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez City Treasurer Gina Gillis Mayor Purcell calls the meeting to order at 5:30 p.m. All present except City Attorney Alan Bojorquez. Also present Lynne Dickinson. II. WORKSHOP No action to be taken. Staff Reports regarding Consent, Site Developments, Subdivisions, Zoning, On Site Sewage Facilities, Signs, Variances, Waivers, Special Exceptions, Annexations, Alternate Standards, Business, and Other Agenda Items listed below. A. Proposed Fiscal Year 2014 Budget 1. Review and Discuss Proposed FY 2014 Budget 2. Review and Discuss Commission/Committee Budget Requests 3. Review and Discuss Budget Requests III. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). A. Deliberation regarding Personnel Matters related to salaries, benefits, and compensation of specific employees: City Administrator, Deputy City Administrator, City Secretary, Planning Director, Municipal Court Clerk/Utilities Coordinator, Receptionist/Administrative Assistant, City Treasurer and Dripping Springs Ranch Park Coordinator 551.074 (Personnel Matters) Convened to Executive Session at 7:04 p.m. Those present: Mayor Purcell, Councilman Alba, Councilman Busbey, Councilman King and Councilman Kroll. Reconvened to Regular Session at 7:31 p.m. IV. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of Appointment of Aubrey Munguia to the Farmers Market Board, Term to Expire June 2014 B. Approval of Agreement Between the City of Dripping Springs and the Dripping Springs Lions Club for the 9th Annual Christmas on Mercer Street Event to be Held Saturday, December 7, 2013 C. Approval of Request from Van Granger with Frosty's Trees to Rent a Portion of the Triangle for $625.00 on November 22, 2013 through December 22, 2013 for Annual Christmas Tree Sales D. Approval of Proclamation Declaring September 7, 2013 "Burke Foundation 40th Anniversary" Councilman Kroll motions to approve items A through C. Councilman King seconds. Motion passes, 5-0. Councilman Alba motions to approve item D. Councilman Busbey seconds. Motion passes, 5-0. Mayor Purcell reads Proclamation declaring September 7, 2013 “Burke Foundation 40th Anniversary” with Mr. Campise of the Burke Foundation. V. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE FACILITIES/SIGNS/VARIANCES/WAIVERS/ALTERNATE STANDARDS/ANNEXATIONS Possible Action and Consideration On: A. Variance Request for Valero, located at 13810 Sawyer Ranch Road, from the City Code of Ordinances, Article 20.03; On Site Sewage Facilities, for Reduced Setback, David Price, P.E., Applicant 1. Presentation – David Price, P.E., states request and is available for questions. 2. City Sanitarian Report – Report from Kyle Dehart on file. 3. Variance – Councilman Kroll motions to approve. Councilman King seconds. Motion passes, 5-0. VI. BUSINESS Consideration and Possible Action On: A. Request from the Dripping Springs Youth Sports Association to build a CMU block wall around three sides of the existing green sports container at Founders Memorial Park and to display athletic sponsorship signage on the wall, Troy Jamail, DSYSA Lacrosse (Sponsor: Councilman Alba) – Troy Jamal, President of DSYSA Lacrosse, available for questions. Councilman Alba states he would like all of the exterior painted so that no bare concrete shows. Councilman Alba also states preference that the tin roof not be the shiny tin. Mr. Jamal states they can look at alternatives. Councilman Kroll motions to approve. Councilman King seconds. Councilman Kroll accepts friendly amendment from Councilman Alba to have roofing materials approved by staff. Motion passes, 5-0. B. Award of a Construction Contract for CAMPO Mercer Street Sidewalk Construction Project CSJ 0914-33-065 between the City of Dripping Springs and Myers Concrete Construction Following Texas Department of Transportation Concurrence of the City's Bid Recommendation – Councilman Alba motions to approve. Mayor Pro Tem Foulds seconds. Motion passes, 5-0. C. Creation of Dripping Springs Ranch Park Maintenance Position (Sponsor Mayor Purcell)- Councilman Alba motions to approve. Councilman Kroll seconds. Motion passes, 5-0. D. Creation of Dripping Springs Ranch Park Event Center Arena Memberships (Sponsor: Mayor Purcell) – Councilman King motions to approve. Councilman Alba seconds. Councilman Busbey inquires if this is to create revenue. Lynne Dickinson states that people are inquiring of use and it is revenue. Councilman Kroll inquires if we have an estimate of the revenue this will generate. Motion passes, 5-0. E. Dripping Springs Ranch Park Event Center Arena Sponsorship Signage Program (Sponsor: Mayor Purcell) – Councilman Busbey motions to adopt program. Councilman King seconds. Motion passes, 5-0. F. City of Dripping Springs Special Event Co-sponsorship Application from D Bar S Roping Club (Sponsor: Mayor Purcell) - Councilman Alba motions to approve. Councilman Kroll seconds. Councilman Kroll inquires if City has language within agreement to audit. Councilman Alba accepts friendly amendment to include language to give City authority to audit. Motion passes, 5-0. G. City of Dripping Springs Special Event Co-sponsorship Application from Texas Hill Country Barrel Racing Association (Sponsor: Mayor Purcell) – Councilman King motions to approve with langue to allow City to audit. Councilman Alba seconds. Motion passes, 5-0. H. Approval of Form Lease Agreement for VIP Suites at Dripping Springs Ranch Park Event Center and Authorization for the Mayor to Execute Lease Agreements (Sponsor: Mayor Purcell) – Councilman King motions to approve with Mayor to have authorization to execute. Councilman Alba seconds. Motion passes, 5-0. I. City of Dripping Springs Special Event Co-sponsorship Application from the Brittany Tuck Memorial Scholarship, Benefit Concert, and Barbeque Cook-Off (Sponsor: Mayor Purcell) – Councilman Kroll motions to approve with language added to allow City authority to audit. Councilman Alba seconds. Motion passes, 3-1. Councilman Busbey opposed. Mayor Pro Tem Foulds exits the meeting at 6:13 p.m. J. Ordinance No. 1110.11 - An Ordinance of the City of Dripping Springs, Texas, Approving the 2013 Ad Valorem Tax Rate And Levy of Fifteen Thousandth Cents ($0.15) Per One Hundred Dollars ($100) of Assessed Valuation of All Taxable Property Within the Corporate Limits of the City; Providing for an Exemption on Residence Homesteads of Persons Who are Disabled or 65 Years of Age or Older; Providing for Penalties and Interest; Providing That This Ordinance Shall Be Cumulative of All Ordinances; Providing For a Severability Clause; Providing for a Savings Clause; Providing for Engrossment and Enrollment; Providing for Publication; and Providing an Effective Date 1. Adoption of Ordinance No. 1110.11 – Councilman Alba motions to approve. Councilman King seconds. Motion passes, 4-0. K. Ordinance No. 1100.56 – An Ordinance of the City of Dripping Springs, Texas, Adopting the Budget for the City of Dripping Springs, Texas, for the Fiscal Year Beginning October 1, 2013 and Ending September 30, 2014; Providing for an Intrafund and Interfund Transfers; and Declaring an Effective Date 1. Adoption of Ordinance No. 1100.56 – Councilman Busbey motions to approve ordinance to include recommendations by City Administrator on proposed salaries; 2% cola, no phone reimbursement, increase for Treasurer’s to 45, approval of award to City Secretary for her degree, performance pay incentive for Deputy City Administrator, Lynne Dickinson full time position as Dripping Springs Ranch Park Coordinator, and time position created. Councilman King seconds, Motion passes, 4-0. VII. ADJOURN – Councilman Alba motions to adjourn. Councilman King seconds. Motion passes, 4-0. Meeting adjourned at 7:40 p.m.
