Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, March 4, 2014, beginning at 5:30 PM in the 511 Mercer Street, Dripping Springs, Texas. I. Also present City Attorney Jill Hoffman. Mayor Purcell enters meeting at 5:37 p.m. II. WORKSHOP No action to be taken. Staff Reports regarding Consent, Site Developments, Subdivisions, Zoning, On Site Sewage Facilities, Signs, Variances, Waivers, Special Exceptions, Annexations, Alternate Standards, Business, and Other Agenda Items listed below. Councilman Kroll enters meeting at 5:40 p.m. III. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development).  Convened to Executive Session at 5:50 p.m. Those present: Mayor Purcell, Mayor Pro Tem Foulds, Councilman Alba, Councilman Busbey, Councilman King, Councilman Kroll, City Administrator Michelle Fischer, Deputy City Administrator Ginger Faught, City Secretary Jo Ann Touchstone, City Attorney Jill Hoffman and Kevin Hoffman with Klotz Associates. Reconvened to Workshop at 6:40 p.m. and went directly to Recess. Business items Discussed: Potential Change Orders to the construction contract between Myers Concrete Inc. and the City of Dripping Springs for the CAMPO sidewalk project CSJ 9014-36- 065 IV. RECESS V. RECONVENE AT 7:00 p.m. Commissioner McClung present. VI. PLEDGE OF ALLEGIANCE A. Pledge of Allegiance – Mayor Purcell leads the pledge. VII. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. A. Presentation of Flag by Representative Jason Isaac to Tami Burkland for Induction Into the Texas Race Horsing Hall of Fame Mayor Purcell introduces Tami Burkland and State Representative Jason Isaac presents resolution and flag to Tami Burkland for induction into Texas Horse Racing Hall of Fame. VIII. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of Regular Meeting Minutes, February 11, 2014  B. Update on City of Dripping Springs Application to the Rivers, Trails, and Conservation Assistance (RTCA) Program of the National Park Service, Michelle Fischer, City Administrator – Michelle Fischer reads letter from National Park Service (on file.) X. BUSINESS Consideration and Possible Action On: A. Request from Relay for Life for Waiver of Banner Permit Fees Related to "Paint the Town Purple" from March 21st through May 3rd, 2014 – Mayor Pro Tem Foulds motions to approve waiver of all fees except for banner permit fee for Triangle. Councilman Busbey seconds. Motion passes, 5-0. B. Request from Veterans of Foreign Wars Post 2933 and American Legion Post 290 to install two flag poles at Veterans Memorial Park, Shorty Barnett, Commander, VFW Post 2933 (Sponsor: Councilman Busbey) – City Administrator Michelle Fischer states Parks & Recreation Commission recommended approval. Commander Shorty Barnett states request. Mayor Pro Tem Foulds motions to approve. Councilman Alba seconds. Motion passes, 5- 0. C. Proposed Transportation Plan for the City of Dripping Springs 1. City Staff Report – Planning Director Jon Thompson, report on file. Staff recommends approval as dated January 10, 2014. 2. Public Hearing – No one speaks. 3. Approval of Resolution No. 2014-14 - A Resolution of the City of Dripping Springs Approving the City of Dripping Springs 2014 Transportation Plan for Purposes of Conceptualizing the Potential of Proximity of Future Streets and Other – Councilman Busbey motions to approve. Councilman King seconds. Motion passes, 5-0.  D. Updated City of Dripping Springs Comprehensive Plan Recommended Projects and Implementation Guide 1. Presentation by Chris Holtkamp – Mr. Holtkamp not present. City Administrator Michelle Fischer, report on file. 2. Planning & Zoning Commission Report - City Administrator Michelle Fischer states they recommended inclusion of transportation plan committee recommendations. 3. Public Hearing – No one speaks. 4. Approval of Updated Recommended Projects and Implementation Guide – Mayor Pro Tem Foulds motions to approve with Planning & Zoning Commission recommendations. Councilman Alba seconds. Motion passes, 5-0. E. Engineering Services Agreement for South Regional Wastewater System Phase 1 West Wastewater Lift Station and Segment 1 Interceptor Design and Construction Phase Services CMA Job Number 1645, CMA Engineering (Sponsor: Mayor Pro Tem Foulds) – Councilman Alba motions to approve. Mayor Pro Tem Foulds seconds. Motion passes, 5-0. F. Potential Change Orders to the construction contract between Myers Concrete Inc. and the City of Dripping Springs for the CAMPO sidewalk project CSJ 9014-36-065 (Sponsor: Mayor Purcell) –Mayor Pro Tem Foulds motions to pre- approve a change order for the bridge retaining wall and footing (Item #15) for up to $21,699 with a preference for option #2 in the change order, which is for the concrete block wall. By pre-approving such change order, the City does not waive the City’s ability to dispute the City’s obligation to pay the pre-approved change order amount. Councilman Alba seconds. Motion passes, 5-0. G. An Ordinance of the City of Dripping Springs Regulating Animals Within the City Limits of the City of Drippings Springs and Providing for the Following: A Penalty Not to Exceed $500 for Each Violation; Findings of Fact; Enactment; Repealer; Severability; Codification; and an Effective Date (Sponsor: Mayor Pro Tem Foulds) – Mayor Purcell requests council to review draft and offer feedback to the City Attorney.
