Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of City of Dripping Springs was held Tuesday, March 18, 2014, beginning at 6:00 PM in the 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez City Treasurer Gina Gillis Mayor Purcell calls the meeting to order 6:00 p.m. All present except Councilman Kroll and Planning Director Jon Thompson. II. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). Convened to Executive Session at 6:25 p.m. Those present: Mayor Purcell, Mayor Pro Tem Foulds, Councilman Busbey, Councilman Alba, Councilman Kroll, Councilman King, City Administrator Michelle Fischer, and Ginger Faught. Reconvened to Regular Session at 6:38 p.m. A. Consultation with City Attorney regarding Potential Change Orders to the Contract between the City of Dripping Springs and Myers Concrete Construction for the Mercer Street Pedestrian Improvement Project (551.071, Consultation with Attorney) B. Consultation with City Attorney regarding Agreement for Consulting Services between the City of Dripping Springs and Klotz Associates, Inc. for Mercer Street Bicycle and Pedestrian Improvements (Mercer Street Pedestrian Improvement Project) (551.071, Consultation with Attorney) III. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of Special Meeting Minutes, February 25, 2014 B. Approval of Regular Meeting Minutes, March 4, 2014 C. Proclamation Declaring the Week of April 20-25, 2014, "Givin' Where I'm Livin' Week" Councilman Alba motions to approve items B and C. Motion passes, 4-0. Mayor Pro Tem Foulds motions to approve item A. Councilman Alba seconds. Councilman Busbey abstains. Motion passes, 3-0-1. IV. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. No one speaks. V. BUSINESS ITEMS Consideration and Possible Action On: A. Fiscal Year 2013 Annual Audit Report, Don Allman, C.P.A. (Sponsor: Councilman Busbey) 1. Presentation on Audit, Don Allman, C.P.A. – Don Allman presents 2013 Audit (on file). John Kroll enters meeting at 6:15 p.m. 2. Acceptance of Audit – Councilman Busbey motions to accept audit. Councilman Alba seconds. Motion passes, 5-0. B. Special Event Co-Sponsorship Application from Texas Section of the International Dark-Sky Association (Sponsor: Mayor Purcell) – City Administrator Michelle Fischer states report is on file. Cindy Luango Cassidy present and available for questions. Mayor Pro Tem Foulds motions to accept with staff recommendations. Councilman King seconds. Motion passes, 5-0. C. Reconsideration of Wastewater Service and Fee Agreement Between the City of Dripping Springs and Norwood Capital, Inc. for the Property Located at 29220 Ranch Road 12, Approximately 102.35 acres out of the P.A. Smith Survey, Abstract A-415, (aka Linwood) (Sponsor: Mayor Pro Tem Foulds) – Deputy City Administrator Ginger Faught states report is on file. Mayor Pro Tem Foulds motions to approve. Councilman Alba seconds. Motion passes, 5-0. D. Ordinance No. 5100.1 - An Ordinance Enacting Article 10.03, Chapter 10 of the Dripping Springs Code of Ordinances; Establishing Regulations for Prohibiting Litter and Dumping; Providing Procedures for Solid Waste Disposal; Providing for the Following: Findings of Fact; Enforcement, Including Criminal Fines not to Exceed $2,000.00 Per Violation and Civil Remedies; Enactment; Repealer; Severability; Codification; Effective Date; and Proper Notice and Meeting (Sponsor: Mayor Purcell) - – Mayor Pro Tem Foulds motions to approve. Councilman Alba seconds. Motion passes, 5-0. E. Ordinance No. 8000.1 - An Ordinance Enacting Article 14.03, Chapter 14 of the Dripping Springs Code of Ordinances; Establishing Regulations for Prohibiting and Abating Graffiti; Providing for the Following: Findings of Fact; Enforcement, Including Criminal Fines not to Exceed $500.00 Per Violation and Civil Remedies; Enactment; Repealer; Severability; Codification; Effective Date; and Proper Notice and Meeting (Sponsor: Mayor Purcell) - Councilman Busbey motions to approve. Councilman Alba seconds. Motion passes, 5-0. F. Ordinance No. 1630.31 - An Ordinance Cancelling the May 10, 2014 General Election and Declaring Each Unopposed Candidate Elected To Office; Providing That This Ordinance Shall Be Cumulative of all Ordinances; Providing a Severability Clause and Providing an Effective Date Ordenanza No 1630.31- Una Ordenanza de la Ciudad de Dripping Springs Cancela las Elecciones Generales del dia 10 de Mayo, 2014 y Declara Cada Candidato sin Oposición Decidido a Oficina; Disponer que esta Ordenanza será Acumulativa de todas las Ordenanzas; el Suministro de una Cláusula Severability y Proporcionando una Fecha de Vigencia Mayor Pro Tem Foulds motions to approve.
