Minutes City of Dripping Springs City Council & Board of Adjustment Special Meeting September 23, 2014 A Special Meeting of the City of Dripping Springs City Council was held Tuesday, September 23, 2014, beginning at 6:00 PM at 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor Purcell calls the meeting to order at 6:00 pm and City Administrator Michelle Fischer calls roll. Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell-present Mayor Pro Tem Bill Foulds-present Council Member Santos Alba-present Council Member Charles Busbey-present Council Member John Kroll-present Council Member Wade King-present City Staff/Appointed Officials City Administrator Michelle Fischer-present Deputy City Administrator Ginger Faught-absent Planning Director Jon Thompson-present City Attorney Alan Bojorquez-present City Treasurer Gina Gillis-absent II. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). Mayor Purcell states that the City Council does not need to go into executive session at this time. III. BUSINESS Consideration and Possible Action On: A. Appointment of City Secretary Mayor Pro Tem Foulds makes a motion to appoint Kerri Craig as City Secretary, with a salary as recommended by the City Administrator, and effective October 10th. Councilman Alba seconds the motion. VOTE: all in favor. The motion is carried. B. Request to Use Dripping Springs Ranch Park to Hold "Lighting of the Spirit Letters" Event on October 8, 2014, Lexa Wetterman, Dripping Springs Pig Skins Mayor Purcell states that this item has been withdrawn. No action taken. C. Land Use: Evaluation of Mercer Street area and Historic District; assessment of impact of surrounding structures and uses on historic preservation and maintenance of places of architectural and/or historical significance; temporary cessation of processing certain permits in proximity to Mercer Street; review of Historic Preservation Implementation Manual as relates to Site Development and Design Standards as applied in and around Historic District. Mayor Purcell states that he understands that the Dripping Springs Chamber of Commerce Board support the City Council’s intentions and approval of the moratorium. Mayor Pro Tem Foulds modifies the map showing the area affected by the moratorium to include some additional properties. City Attorney Alan Bojorquez recommends adding certificates of occupancy to the moratorium prohibitions. Mayor Pro Tem Foulds makes a motion to approve the Evaluation of the Mercer Street area and Historic District; assessment of impact of surrounding structures and uses on historic preservation and maintenance of places of architectural and/or historical significance; temporary cessation of processing certain permits in proximity to Mercer Street subject to the revised map of the area and the changes to the ordinance recommended by the City Attorney; and the review of Historic Preservation Implementation Manual as relates to Site Development and Design Standards as applied in and around Historic District. Councilman Busbey seconds the motion. VOTE: all in favor. The motion is carried. Mayor Pro Tem Foulds makes a motion to go into executive session to consult with the City Attorney on item D, seconded by Councilman Busbey. VOTE: Al in favor. The motion is carried. The City Council goes into executive session at 6:15 pm. The City Council comes out of executive session at 6:22 pm. D. Utilities: Evaluation of potential transaction with Dripping Springs Water Supply Corporation involving possible Real Estate acquisition and procurement or conveyance of other assets, and provision for limited nondisclosure of certain information necessary to facilitate due diligence and further negotiations. Councilman Busbey makes a motion to approve the non-disclosure agreement in accordance with any changes recommended and agreed upon by the City Attorney and the Corporation’s attorney. Mayor Pro Tem Foulds seconds the motion. VOTE: all in favor. The motion is carried. IV. ANNOUNCEMENTS A. City Council Meeting, October 14, 2014, at 5:30 p.m. B. Regular Planning & Zoning Commission Meeting, September 23, 2014 at 7:00 p.m. C. Regular Historic Preservation Commission Meeting, October 6, 2014 at 5:30 p.m. D. Regular Parks & Recreation Meeting, October 6, 2014 at 6:00 p.m. E. Regular Farmers Market Board Association Meeting, October 14, 2014 at 10:00 a.m. F. Regular Founders Day Commission Meeting, TBD V. ADJOURN Councilman Alba makes a motion to adjourn, seconded by Councilman Kroll. VOTE: all in favor. The motion is carried. The meeting is adjourned at 6:24 pm.
