Minutes of Regular Meeting City Council City of Dripping Springs A Regular Meeting of the City Council of the City of Dripping Springs was held Tuesday, October 21, 2014, beginning at 6:00 PM at City Hall, 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members/Board of Adjustment Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Santos Alba Council Member Charles Busbey Council Member Wade King Council Member John Kroll City Staff/Appointed Officials City Administrator Michelle Fischer Deputy City Administrator Ginger Faught City Secretary Kerri Craig Planning Director Jon Thompson Planning and Zoning Chair Larry McClung City Attorney Alan Bojorquez City Treasurer Gina Gillis DS Ranch Park Coordinator Lynne Dickinson Mayor Purcell calls the meeting to order at 6:00 p.m.. All present except Deputy City Administrator Ginger Faught, Planning Director Jon Thompson, Planning and Zoning Chair Larry McClung, City Treasurer Gina Gillis, and DS Ranch Park Coordinator Lynne Dickinson. II. PLEDGE OF ALLEGIANCE – Mayor Purcell leads the pledge. Mayor requests a moment of silence for Nancy Glosson. III. PRESENTATION OF CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Mayor. The Mayor and City Council may establish a time limit as necessary. Terrence Tull – Submits to the Mayor and City Council a letter regarding the Proposed Expansion of Dripping Springs Waste Water Treatment Plant, and an article from the Texas Water Development Board website titled “Texas Water Development Board approves $33,797,597 in financial assistance to the City of Wichita Falls (Wichita County) for an indirect potable reuse system”. (Letter and Article on file) Mr. Tull says he is not opposed to expanding the plant, but to never discharge into the recharge zone (Onion Creek and Underlying Aquifer) 1  unless it will improve the quality of the water. Talley Williams – Representing the Heritage PID, asks the City Council to approve Resolution 2015-2 Heritage PID. She states that she is there to answer any questions regarding Resolution 2015-2 Heritage PID. IV. CONSENT ITEMS The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation for a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. A. Approval of Dripping Springs Ranch Park-- Phase 3: Change Order No. 2 to Contract between the City of Dripping Springs and Waldrop Construction for Site Work which will increase the contract amount by $35,000 (Sponsor: Mayor Purcell) B. Approval of Proposal for Historic Resources Survey and Consulting Services, Eugene Foster, Roark-Foster Consulting Councilman Kroll motions to approve items A and B. Councilman Alba seconds.VOTE: 5-0 in favor, motion passes. V. EXECUTIVE SESSION - NONE The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). A. Consultation with City Attorney regarding potential alternatives and options to currently planned wastewater discharge permitting plans, including potential additional area needed to meet wastewater service needs (551.071 Consultation with Attorney and 551:072 Purchase, Exchange, Lease or Value of Real Property) B. Consultation with City Attorney Regarding Update on Dripping Springs Water Supply Corporation Exploratory Committee (551.071 Consultation with City Attorney) VI. BUSINESS Consideration and Possible Action On: A. Request from Bluebonnet Flea to Hold Monthly Markets at The Triangle for a Reduced Rental 2  Fee, Anya Whatley, Owner City Administrator Michelle Fischer states that the applicant asked for this item to be tabled until the next City Council meeting on November 11, 2014. Councilman Kroll recused himself and left the room – potential Conflict of Interest Affidavit on file. B. Resolution No. 2015-2: A Resolution Commencing Evaluation Of The Proposed Creation Of The Heritage Public Improvement District (“PID”); Authorizing The Staff To Review The PID Petition, The Feasibility Analysis, The Service And Assessment Plan, The PID Financing Agreement And All Related Materials (Sponsor: Mayor Purcell) Talley Williams, representing the Heritage PID, states that a PID is a good financing tool for the City and will fund various public improvements such as wastewater infrastructure, roads, parks, and drainage facilities. She refers to the draft term sheet that was submitted with the agenda back up materials. Jana Edwards, Special Counsel, gives an overview of the Resolution. City Administrator Michelle Fischer states that she recommends that a committee review the PID application and that the committee should consist of Councilman Charles Busbey, Deputy City Administrator Ginger Faught, City Attorney Alan Bojorquez, Financial Advisor Chris Lane, Special Counsel Jana Edwards, City Treasurer Gina Gillis, and City Administrator Michelle Fischer. City Attorney Alan Bojorquez states that he has prepared a Draft C of the Resolution and has removed the draft term sheet as an attachment. Mayor Pro Tem Foulds motions to approve item B. Councilman Alba seconds. VOTE: 4-0 in favor, motion passes. Councilman Kroll returned to the meeting. C. Request from Dripping Springs Presbyterian Church for Reduction of City Hall Meeting Room Rental Fees, Mitch Kolls, Director of Student Ministries (Sponsor: Mayor Purcell) City Administrator Michelle Fischer states the rental fee is currently $100 for a four hour period. She recommends allowing a pro-rated rental fee of $25 per hour. Mayor Pro Tem Foulds motions to approve item C. Councilman Busbey seconds. VOTE: 5-0 in favor, motion passes. D. Agreement with Gary Keller regarding Funding of Direct Potable Reuse Feasibility Study by Carollo Engineers, Inc. (Sponsor Mayor Purcell) Mayor Purcell asks if there is a refund mechanism in the agreement. Mayor Pro Tem Foulds says there is not. Mayor Pro Tem Foulds motions to approve item D. Councilman Alba seconds. VOTE: 5-0 in 3  favor, motion passes. Mayor Pro Tem Foulds thanks Gary Keller. Terrence Tull confirms we did not have public comment on this item. Mayor Pro Tem Foulds said public comment was not received because there was no public hearing during the meeting. E. Change Order No. 1 to Contract between the City of Dripping Springs and Ross Construction for the Western Interceptor and Lift Station, Segment 1, Wastewater Collection System Extension to Serve Caliterra (Sponsor: Mayor Pro Tem Foulds) Mayor Pro Tem Foulds motions to approve Change Order No. 1 which will increase the contract by $85,718.53 which includes generator costs. Councilman Alba seconds. VOTE: 5-0 in favor, motion passes. F. Administrative Assistant Position: Creation, Job Description, Pay, Benefits, and Hiring (Sponsor: Mayor Purcell) Councilman Busbey asks if the position is set at 32 hours per week in order for the employee to receive benefits. City Administrator Michelle Fischer said the employee asked to have her hours reduced by 8 hours per week, and that 32 hours per week is considered full time; however the employee will be paying a portion of her medical benefits. Mayor Pro Tem Foulds motions to approve the job description and offer of employment. Councilman Alba seconded. VOTE: 5-0 in favor, motion passes. G. Receptionist/Administrative Assistant Position: Revised Job Description, Pay, Benefits, and Hiring (Sponsor: Mayor Purcell) City Administrator Michelle Fischer asks to be authorized to hire someone for this position. Mayor Pro Tem Foulds motions to approve the revised job description and authorizes staff to hire for this position. Councilman Alba seconds. VOTE: 5-0 in favor, motion passes. VII. ANNOUNCEMENTS A.
