A Regular Meeting of the City Council of Dripping Springs, Texas, was held Tuesday, April 9, 2019 at 6:00
p.m. in the City Hall Council Chambers, located at 511 Mercer Street, Dripping Springs, Texas.
I. CALL TO ORDER AND ROLL CALL

With a quorum of the City Council present, Mayor Pro Tern Foulds called the meeting to order at 6:00
p.m.
II. PLEDGE OF ALLEGIANCE
Council Member Manassian led the Pledge of Allegiance to the Flag.
III. PROCLAMATIONS & PRESENTATIONS
No action to be taken on proclamations and presentations. The City Council may choose to discuss
and take public comment on these items as necessary.
A. Proclamation of the City of Dripping Springs recogmzmg Reba Byrd for her
contributions to the Dripping Springs Community and Declaring April 16, 2019 as
"Reba Byrd Day".

Council Member Manassian read the Proclamation and presented it Reba Byrd.
B. Presentation and Update rega rding the Texas Water Development Board Loan.
Ginger Faught presented a summary of the project which is on file. Financial Advisor Chris
Lane and Robbie Callagari w ith CMA E ngineering were availab le for questions.
IV. PRESENTATION OF CITIZENS
The floor is open for Citizens wishing to speak on items that are not on the posted agenda or do not
have a public hearing, and speakers are encouraged to sign in prior to sp eaking. Citizens wishing to
speak shall do so after being recognized by the Mayor. Speakers are allowed two (2) minutes to speak,
which the Mayor or City Council may extend. By law no action may be taken during Presentations of
Citizens.
No one spoke during Presentation of Citizens.
V. CONSENT AGENDA
A. Approval of a Resolution Accepting Substantial Completion of Improvements and
Approving and Accepting Maintenance Bond for Caliterra Phase 2, Section 8
wastewater improvements.

C. Approval of an Ordinance Amending the Fee Schedule for Dripping Springs Ranch
Park Fees.

A motion was made by Counc il Member Manass ian to approve Consent Agenda Items A -
C . Council Member King seconded the motion which carried unanimously 4 to 0.
VI. BUSINESS
A. Discuss and consider approval of Professional Service Agreement between the City of
Dripping Springs and Carollo Engineers Inc. for Wastewater System Improvements
to be fund ed by the Texas Water Development Board.

Ginger Faught presented the item. T he C ity Council previously authorized the negotiations
of contracts regarding the Texas Development Water Board Project for Wastewater System

Improvements. Staff recommends the approval contract w ith Carollo E ngineers for
Engineering Services.
A motio n was made by Mayor Pro Tem Foulds to approve a Professio nal Service Agreement
between the City of Dripping Springs and Carollo Engineers Inc. fo r Wastewater System
Improvements to be funded by the Texas W ater Development Board. Counc il Member King
seconded the motion w hich carried unanimously 4 to 0.
B. Discuss and consider approval of an Ordinance Amending the current Fiscal Y car
Budget; Finding Municipal Purposes; Authorizing Expenditures; Providing for
Severability Clause; and Providing for an Effective Date.
G ina G illis presented the staff report which is on fil e. Staff recommends approval of the
item.
A motion was made by Counci l Member Manassian to approve an Ordinance Amending the
current Fiscal Year Budget; Finding Municipal P urposes; A uthoriz ing Expenditures;
Providi ng fo r Severability C lause; and Provid ing fo r an Effective Date. Council Member
Crow seconded the motio n wh ich carried unanim ously 4 to 0.

C. Discuss and consider approval of a Resolution of the City of Dripping Springs
establishing the City of Dripping Springs Agenda, Meetings, and Minutes Policy.

A motion was made by Council Member K ing to approve a Resolution of the City of
Dripping Springs establishing the C ity of Dripping Springs Agenda, Meetings, and M inutes
Policy. Council Member Manassian seconded the motion which carried unanimously 4 to
0.

D. Discuss and consider approval of Right of First Refusal to Purchase Real Estate
between Grantor: City of Dripping Springs and Grantee: Oryx Development, LLC
regarding 1.00 acre of Land out of the William Walker Survey No. 130, Abstract No.
437 in Hays County, and Being a Portion of the 24.07 Acre R emainder of a 1539.45
Acre Tract of Land Conveyed to Paul Pressler Family Generation Skipping Trust, et.
al., by Deed of Record in Volume 1911, Page 481 of the Official Public Records of Hays
County, Texas.

Council Member Crow seconded the motion which carri ed unanimously 4 to 0.

between the City of Dripping Springs and AGICM regarding Preconstruction Services
related to the TIRZ Town Center Project. Counc il member Crow seconded the motio n
which carried unanimously 4 to 0.
G. Discuss and consider approval of a Resolution Approving Expenditure of TIRZ No. 2
funds in amount consistent with the TIRZ Project Plan including but not limited to the
Town C enter Project, Triangle Project, Public Parking and Other Approved Projects.

Laura M ueller presented the item. T he resolution w ill authorize the expenditure of TIRZ
No. 2 funds for projects in TTRZ No. 1 as outlined in the original T IRZ P roject Plan.
A mo tion was made by Council Member King to approve a Resolution Approving

The City Council for the City of Dripping Springs has the right to adjourn into executive session at

551 .073 Deliberations about Gifts and Donations), 551.074 (Personnel 1\1atters), 551.076
(Deliberations about Security Devices), and 551.086 (Economic Development). The City Council for
the City a/Dripping Springs may act on any item listed in Executive Session in Open Session or move
any item fi'om Executive Session to Open Session for action.
A. Consultation with City Attorney regarding legal issues related to s ubdivision and street
requirements for property at Gateway 26 doors.

A motion was made by Mayor Pro Tern Foulds to recess into Executive Session under Texas
Government Code Section 55 1.07 1 (Consu ltation w ith City Attorney) and regarding
Executive Session Agenda Items A - B. Council Member Crow seconded the motion which
carried unanimously 4 to 0.
The City Council met in Executive Session from 6:44 p.m. - 7:02 p.m.
No action or vote was taken in Executive Session. Mayor Pro Tern Foulds returned the
meeting to open session at 7:02 p.m.
A motion was made by Council Member Manassian to pull Executive Session Agenda Item
B into open session and direct the 20 19 Legislative Committee to file a Resolution opposing
House Bill 4 I 16 and to seek clarification from the author. Counc il Member King seconded
the motion which carried unanimously 4 to 0.
