City Council Regular Meeting Minutes May 21, 2019 at 6:00 p.m. A Regular Meeting of the City Council of Dripping Springs, Texas, was held Tuesday, May 21, 2019 at 6:00 p.m. in the City Hall Council Chambers, located at 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Mayor & City Council Members present were: Mayor Todd Purcell Mayor Pro Tem Bill Foulds Council Member Travis Crow Council Member Wade King Council Member Taline Manassian City Council Members absent were: Council Member John Kroll City Staff/Appointed Of(icials/Consultants present were: City Administrator Michelle Fischer Deputy City Administrator Ginger Faught City Secretary Andrea Cunningham Building Official Sarah Cole Code Enforcement Officer Aaron Reed Assistant City Attorney Laura Mueller Legal Counsel Alessandra Gad Municipal Court Judge Marilyn Miller With a quorum of the City Council present, Mayor Purcell called the meeting to order at 6:02 p.m. The Mayor proceeded to lead the Council Chambers in the Pledge of Allegiance to the Flag. II. WORKSHOP No action will be taken in the Workshop. City Council may discuss and provide direction to staff regarding items listed in the Workshop. A. Discussion regarding the regulation of Fireworks in the City. Sponsor: Mayor Purcell B. Discussion regarding the regulation of Noise in the City. Sponsor: Mayor Purcell C. Discussion regarding the regulation of Outdoor Burning in the City. Sponsor: Mayor Purcell City Council May 21, 2019 Regular Meeting Minutes Page 1 o/7 The City Council did not discuss the Workshop items and directed staff to place these items on the June 11, 2019 City Council Workshop. III. PLEDGE OF ALLEGIANCE Mayor Purcell led the Pledge of Allegiance earlier in the agenda. Mayor Purcell proceeded with the Presentation of Citizens. Presentation of Citizens: No one spoke during Presentation of Citizens. IV. PROCLAMATIONS & PRESENTATIONS No action to be taken on proclamations and presentations. The City Council may choose to discuss and take public comment on these items as necessary. A. Presentation of Statement of Elected Officers and Oaths of Office for Place 1, Place 3 and Place 5 of the City of Dripping Springs City Council Members Elect resulting from May 4, 2019 General Municipal Election. Municipal Court Judge Marilyn Miller administered the Oath of Office and presented the Statement of Elected Official to Council Member Elect Place 1 Taline Manassian, Place 3 Bill E. Foulds and Place 5 Wm Travis Crow. B. Proclamation proclaiming May 2019 as "Mental Health Month" in the City of Dripping Springs. Sponsor: Taline Manassian This item was taken up following the Executive Session. V. PRESENTATION OF CITIZENS The floor is open for Citizens wishing to speak on items that are not on the posted agenda or do not have a public hearing, and speakers are encouraged to sign in prior to speaking. Citizens wishing to speak shall do so after being recognized by the Mayor. Speakers are allowed two (2) minutes to speak, which the Mayor or City Council may extend. By law no action may be taken during Presentations of Citizens. This item was taken up earlier in the agenda. VI. CONSENT AGENDA The following items are anticipated to require little or no individualized discussion due to their nature being clerical, ministerial, mundane or routine. In an effort to enhance the efficiency of City Council meetings, it is intended that these items will be acted upon by the City Council with a single motion because no public hearing or determination is necessary. However, a City Council Member or citizen may request separate deliberation/or a specific item, in which event those items will be removed from the consent agenda prior to the City Council voting on the consent agenda as a collective, singular item. Prior to voting on the consent agenda, the City Council may add additional items that are listed elsewhere on the same agenda. City Council May 21, 2019 Regular Meeting Minutes Page 2 o/7 A. Approval of a Request for Reduced Fees from The Collie Club of Austin to hold a show at Dripping Springs Ranch Park on January 4 and 5, 2020. Sponsor: Council Member Wade King B. Approval of the Appointment of Marilyn Miller, Attorney at Law, as the City of Dripping Springs Municipal Court Judge for a term ending June 2021. A motion was made by Mayor Pro Tern Foulds to approve Consent Agenda Items A - B. Council Member King seconded the motion which carried unanimously 4 to 0. VII. BUSINESS A. Discuss and consider the selection of Mayor Pro Tern for a term ending May 1, 2020. A motion was made by Council Member Manassian to select Bill Foulds as Mayor Pro Tern for a term ending May 1, 2020. Council Member King seconded the motion which carried unanimously 4 to 0. B. Discuss and consider the appointment of City Council Member Liaisons to the City of Dripping Springs' Committees; and the assignment of City Council Members to Areas of Oversight. 1. Finance 2. Public Health 3. Utilities 4. City Beautification 5. Public Health 6. Parks, Recreation & Community 7. Transportation Committee 8. Economic Development Committee 9. Additional Recommendations A motion was made by Mayor Pro Tern Foulds to table the appointment of City Council Member Liaisons to the City of Dripping Springs' Committees; and the assignment of City Council Members to Areas of Oversight. Council Member King seconded the motion which carried unanimously 4 to 0. C. Discuss and consider approval of the Appointment of five (5) individuals to the Economic Development Committee for terms ending June 1, 2021. Economic Development Committee Chair Kim Fernea spoke regarding the item and recommended the reappointment of Keenan Smith, Melanie Fenelon, Whit Hanks, and Dave Edwards, and the appointment of Jeff Nydegger as an Advisory Committee Member. A motion was made by Mayor Pro Tern Foulds to appoint Kim Fernea, Keenan Smith, Melanie Fenelon, Whit Hands and Dave Edwards to the Economic Development Committee City Council May 21, 2019 Regular Meeting Minutes Page3 o/7 for terms ending June 1, 2021, and to appointment Jeff Nydegger as an Advisory Committee Member. Council Member King seconded the motion which carried unanimously 4 to 0. D. Discuss and consider approval of the selection of HDR Engineering, Inc. for Engineering Services regarding the TxDOT CSJ 0914-33-079 Sportsplex Drive TASA Sidewalk Project, subject to TxDOT concurrence; and the authorization of the City Administrator to negotiate the contract. Sponsor Mayor Pro Tern Foulds A motion was made by Council Member King to approve the selection ofHDR Engineering, Inc. for Engineering Services regarding the TxDOT CSJ 0914-33-079 Sportsplex Drive T ASA Sidewalk Project, subject to TxDOT concurrence; and the authorization of the City Administrator to negotiate the contract. Discuss and consider approval of an Agreement between the City of Dripping Springs and ETS Elavon regarding Credit Card Processing Services. Sponsor: Mayor Pro Tern Foulds Sarah Cole presented the staff report which is on file. Staff recommends approval of the item. A motion was made by Council Member King to approve an Agreement between the City of Dripping Springs and ETS Elavon regarding Credit Card Processing Services. Mayor Pro Tern Foulds seconded the motion which carried unanimously 4 to 0. F. Discuss and consider approval of a Professional Services Agreement between the City of Dripping Springs and HDR Engineering, Inc. regarding Easement Acquisition Services, Easement Appraisal Services and Appraisal Review Services related to Wastewater System Improvements to be funded by the Texas Water Development Board. A motion was made by Council Member King to approve a Proposal to the City of Dripping Springs from SAM, LLC regarding Surveying Services related to Wastewater System City Council May 21, 2019 Regular Meeting Minutes Page 4 o/7 Improvements to be funded by the Texas Water Development Board and to authorize the Mayor and Ginger Faught to negotiate the agreement. Mayor Pro Tern Foulds seconded the motion which carried unanimously 4 to 0. H. Discuss and consider approval of a Construction Contract between the City of Dripping Springs and Ground Exchange, LLC regarding Low Water Crossing Emergency Repairs at Dripping Springs Ranch Park. Sponsor: Mayor Purcell Laura Mueller presented the staff report which is on file. Staff recommends approval of the item. Council Member Crow seconded the motion which carried unanimously 4 to 0. I. Discuss and consider approval of the Appointment of five (5) individuals to the Utility Commission for staggering terms. This item was tabled to after the Executive Session. J. Update and possible action regarding Implementation of the City of Dripping Springs Agenda Sofhvare Program Peak Agenda (Granicus). Sponsor: Mayor Pro Tern Foulds A motion was made by Mayor Pro Tem Foulds to table possible action regarding Implementation of the City of Dripping Springs Agenda Software Program Peak Agenda (Granicus). Council Member Crow seconded the motion which carried unanimously 4 to 0. A motion was made by Mayor Pro Tern Foulds to adjourn into Executive Session under Texas Government Code Sections 551.071, Consultation with City Attorney and 551.072, Deliberation of the Purchase, Exchange, Lease or Value of Real Property and regarding Executive Session Agenda Items A - C and Business Agenda Item I. Consultation with City Attorney, 551.071 Business Agenda Item: I. Discuss and consider approval of the Appointment of five (5) individuals to the Utility Commission for staggering terms. The City Council met in Executive Session from 6:23 p.m. - 7:00 p.m. No vote or action was taken in Executive Session. Mayor Purcell returned the meeting to Open Session at 7:00 p.m. OPEN SESSION Proclamations & Presentations B. Proclamation proclaiming May 2019 as "Mental Health Month" in the City of Dripping Springs. Sponsor: Taline Manassian Council Member Manassian read and presented the Proclamation proclaiming May 2019 as "Mental Health Month" in the City of Dripping Springs to Lettie Hastings. Business Agenda I. Discuss and consider approval of the Appointment of five (5) individuals to the Utility Commission for staggering terms. A motion was made by Council Member King to appoint the following individuals to the Utility Commission for seats and terms as listed: • City Representatives - 3 Seats o Chair, Jim Langford for a term ending June 30, 2021 o Meghan Lind for a term ending June 30, 2021 o Chuck Miller for a term ending June 30, 2020 • Hays Trinity Groundwater Conservation District - 2 Seats o Roger Kew for a term ending June 30, 2021 o Troy Jamail for a term ending June 30, 2020 Council Member Crow seconded the motion which carried unanimously 4 to 0.
