City Council Regular Meeting Regular Meeting Minutes December 17, 2019 at 6:00 p.m. A Regular Meeting of the City Council of D ri pping Springs, Texas was held T uesday, December 17, 20 I 9 beginning at 6:00 p.m. in the City Hall Council Chambers located at 5 11 Mercer Street, Dripping Springs, Texas. I. Mayor Pro Tem Foulds seconded the motion which carried unanimously 4 to 0. II. PLEDGE OF ALLEGIANCE Mayor Pro Tem Foulds led the P ledge of Allegiance to the Flag. III. PRESENTATION OF CITIZENS A member of the public who desires to address the City Council regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or al a public hearing for an item during the City Council 's consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time a/lolled for presentation of citizens. Speakers are allowed two (2) minutes to speak during presentation ofcitizens or during each public hearing. Speakers may not cede or pool time. Members ofthe public requiring the assistance ofa translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the City Council. Speakers are encouraged to sign in. Anyone may request a copy of the City's policy on presentation of citizens from the city secretary. By law no action may be taken during Presentations of Citizens. Jay Howard with Texas Disposal Systems spoke during Presentation of Citizens. IV. CONSENT AGENDA A. Approval of a Co-Sponsorship Agreement between the City of Dripping Springs and the Dripping Springs High School Baseball Booster Club regarding the Second Annual Washer Tournament to be held on February 15, 2020. B. Approval of a Request for a Temporary Road Closure Permit for Bluff Road from 290 to Mercer Street and Wallace Street from Bluff street to College street and related to the Dripping Springs High School Baseball Booster Club Washer Tournament. A motion was made by Council Member Kroll to approve Consent Agenda Items A and B. Council Member King seconded the motion which carried unanimously 4 to 0. V. BUSINESS A. Discuss and consider approval of an Annexation Application and direction to staff to negotiate an Annexation Agreement with Owners to annex approximately 8.5 acres in the extraterritorial jurisdiction, situated in the Benjamin F Hanna Survey, ABS 222, more specifically located at 2300 W U.S. 290 (AAA Self-Storage), Dripping Springs, Texas 78620, into the city limits. Applicant: Glenda Jacoby representing Kevin Maxwell (owner). 1. Presentation No presentation was given. 2. Staff Report Jason Lutz presented the staff report which is on file. Staff recommends approval of the item. 3. Public Hearing No one spoke during the Public Hearing. 4. Annexation Application A motion was made by Council Member King to approve an Annexation Application and direction to staff to negotiate an Annexation Agreement with Owners to annex approximately 8.5 acres in the extraterritorial jurisdiction, situated in the Benjamin F Hanna Survey, ABS 222, more specifically located at 2300 W U.S. 290 (AAA Self-Storage), City Council December 17, 2019 Regular Meeting Minutes Page 2 o/7  Dripping Springs, Texas 78620, into the city limits. Council Member Kroll seconded the motion which carried unanimously 4 to 0. B. Discuss and consider approval of the revised job description for the Dripping Springs Ranch Park Event Center Coordinator (currently known as the Dripping Springs Ranch Park Facility Coordinator); and authorization of the Mayor to hire for the position. Kelly Schmidt presented the staff report which is on file. Staff recommends approval of the revised job description. A motion was made by Council Member King to approve the revised job description for the Dripping Springs Ranch Park Event Center Coordinator (currently known as the Dripping Springs Ranch Park Facility Coordinator); and authorization of the Mayor to hire for the position. Mayor Pro Tern Foulds seconded the motion which carried unanimously 4 to 0. C. Public hearing and consideration of approval of an Ordinance Amending Article 24.02 Technical Construction Codes and Standards and providing for findings of fact; adoption and amendments, repealer, severability, and enforcement; establishing an effective date; and proper notice and meeting. 1. Staff Report Sarah Cole presented the staff report which is on file. Staff recommends approval of the ordinance. 2. Public Hearing No one spoke during the Public Hearing. 3. Ordinance A motion was made by Mayor Pro Tem Foulds to approve an Ordinance Amending Article 24.02 Technical Construction Codes and Standards and providing for findings of fact; adoption and amendments, repealer, severability, and enforcement; establishing an effective date; and proper notice and meeting. Council Member King seconded the motion which carried unanimously 4 to 0. Filed as Ordinance No. 2019-48 D. Public hearing and consideration of approval of an Ordinance Amending Chapter 8 Fire Prevention and Protection and providing for findings of fact, adoption and amendments, a repealer, severability, and enforcement; establishing an effective date; and proper notice and meeting. 1. F ire Chief Scott Collard with North Hays F ire Rescue (ESD No. 6) spoke regarding the item and confirmed that Hays County has also adopted the same Fire Code. 2. Public Hearing No one spoke during the Public Hearing. 3. Ordinance A motion was made by Mayor Pro Tem Foulds to approve an Ordinance Amending Chapter 8 F ire Prevention and Protection and provid ing for findings of fact, adoption and amendments, a repealer, severability, and enforcement; establishing an effective date; and proper notice and meeting with changes submitted at the dais by Assistant C ity Attorney Laura Mueller. Council Member Kroll seconded motion which carried unanimously 4 to 0. Filed as Ordinance No. 2019-49 E. Discuss and consider approval of an Ordinance Adopting the Design and Development Standards for the Mercer Street, Old Fitzhugh Road and Hays Street Historic Districts; providing for: findin gs of fact, enactment, repealer, sever-ability, codification, effective date and proper notice and meeting. Laura Mueller presented the item. T he ordinance w ill be adopting the Design and Development Standards previously approved through resolution, thus codifying the standards. Mayor Purcell opened a Public Hearing to which there was no speakers. A motion was made by Mayor Pro Tem Fou lds to approve an Ord inance Adopting the Design and Development Standards for the Mercer Street, O ld Fitzhugh Road and Hays Street Historic Districts; providing for: findings of fact, enactment, repealer, severabil ity, codification, effective date and proper notice and meeting. Public hearing and consideration of approval of an Ordinance Amending Ch. 24: Building Regulations; Article 24.07, Division 2: Historic District of the C ity of Dripping Springs Code of Ordinances: Creating and Establishing S ection 24.07.035: Enforcement and Penalties for the violation of implementation standards; Amending Section 24.07.033 compliance, Adopting the Historic District Implementation Manual as Appendix "A" to Article 24.07; and Incentives for the Hays Street Historic District, including a criminal fine not to exceed $500.00; and also providing for: findings of fact; enactment; repealer; severability; codification; effective date; proper notice & meeting. The Manual is already in place and previously approved by reso lution and staff is requesting to adopt through resolution and clarify procedures. 2. Ordinance A motion was made by Mayor Pro Tern Foulds to approve an Ordinance A.mending Ch. 24: Building Regulations; Article 24.07, Division 2: Historic District of the City of Dripping Springs Code of Ordinances: Creating and Establishing Section 24.07.035: Enforcement and Penalties fo r the violation of implementation standards; Amending Section 24.07.033 compliance, Adopting the Historic District Implementation Manual as Appendix "A" to Article 24.07; and Incentives for the Hays Street Historic District, including a criminal fine not to exceed $500.00; and also providing for: findings of fact; enactment; repealer; severability; codification; effective date; proper notice & meeting. Council Member King seconded motion which carried unanimously 4 to 0. Council Member Manass ian directed staff to fix the footer on the ordinance. Council Member King seconded the motion which carried unanimously 4 to 0. Andrea Cunningham presented the staff report which is on file. Staff and the TIRZ No. I & No. 2 Board recommend approval of the appointment. A motion was made by Mayor Pro Tern Foulds to approve a Resolution Appointing Todd Washburn to the Tax Increment Re investment Zone (TIRZ) No. 1 & No. 2 Board as a representative of the Dripping Springs Independent School District and for a term to expire December 3 1, 2020. Counci l Member Manassian seconded the motion wh ich carried unanimously 4 to 0. Filed as Resolution No. 2019-R45 J. Discuss and consider the Appointment of Jeff Schindler to Founders Day Commission as a Representative of the Cook-Off Club, and for a term ending June 30, 2020. Andrea Cunningham presented the staff report which is on file . Staff recommends approval of the appointment. A motion was made by Mayor Pro Tem Foulds to approve the Appo intment of Jeff Schindler to Founders Day Commission as a Representative of the Cook-Off C lub, and for a term ending June 30, 2020.
