CITY OF DRIPPING SPRINGS PLANNING AND ZONING COMMISSION Regular Meeting Minutes April 23,2013 7:00 p.m. 511 Mercer Street, Dripping Springs,Texas Thisfacility is wheelchair accessible. CALL TO ORDER AND ROLL CALL Commission Members Larry McClung - Chair Mim James Josef Martin Vacancy Danny Hubbard- Vice Chair Whit Smith Erik Burgeson City Staff/Appointed Officials City Administrator Michelle Fischer Planning Director Jon Thompson City Secretary Jo Ann Touchstone City Attorney Alan Bojorquez City Engineer Rick Coneway Commissioner McClung calls the meeting to order at 7:00 p.m. All present except Commissioner Burgeson and Rick Coneway. II. PLEDGE OF ALLEGIANCE- Jon Thompson leads the pledge. III. PRESENTATIONS BY CITIZENS Floor open to discussion on any subject. No action may be taken by law. Citizens wishing to speak shall do so after being recognized by the Chairman. The Chairman and Commission may establish a time limit as necessary. No one speaks. IV. MINUTES A. Approval of Regular Meeting Minutes, March 26, 2013- Commissioner Martin motions to approve. Commissioner McClung seconds. Motion passes, 5-0. V. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE FACILITIES/SIGNSAARIANCESAVAIVERS/ALTERNATE STANDARDS/DEVELOPMENT AGREEMENTS Consideration and Possible Action on: A. Ordinance No. 1220.85 -An Ordinance ofthe City of Dripping Springs Changing the Zoning Classification ofthe following property: 104-A Grand Prairie Circle(Grand Prairie Subdivision, Lot 2)to be amended fi-om SF-4 (Two Family Residential - Duplex)to SF-4(Two Family Residential - Duplex)and O (Office), ???, Applicant 1. Presentation - Mr. Lopez is present and available for questions. 2. Planning Director's Report-Planning Director Jon Thompson,report on file. 3. Public Hearing - Bob Farber, 808 Grand Prairie Circle, states he is here to inquire ofthe process and what can come down in further down the street. Mr. Farber inquires of the zoning ofthe vacant lot as well. Loma Rogers, 807 Grand Prairie, states opposition as what is done for one could be honored for the next and multiple requests could be made. Ms. Rogers states there are many small children in the neighborhood and states concern for traffic. Juan Garcia, 804 Garcia, states concern for commercial development encroaching further down into the neighborhood. Art Juarez, 801 Grand Prairie, new resident. Mr. Juarez states concern for further development encroaching down into the neighborhood and possibly affecting property values. 4. Ordinance No. 1220.85 - Commissioner James motions to consider. Commissioner McClung seconds. Commissioner James inquires of Planning Director Jon Thompson to clarify the zoning differences of"O" - Office and "C.S." Commercial. Planning Director Jon Thompson states what is allowable within each zoning. Commissioner Martin inquires ofPlanning Director Jon Thompson what parking requirements there are with the property. Commissioner McClung states zoning is one ofthe most important considerations ofthe Commission, especially in a residential area. Commissioner Hubbard states he does not have a problem with the request. Commission discusses concems stated in public hearing and options to allow this use at this location, whether it be through zoning or conditional use permit or home occupation. Commissioner McClung motions to deny the zoning request and direct staff to initiate a zoning amendment to the zoning ordinance to allow this as a conditional use in certain zoning districts to allow the applicant to apply for a conditional use permit. Commissioner McClung also suggests staff waive fee for conditional use permit request. Commissioner Martin seconds. Motion passes, 5-0. B. Master Signage Plan & Sign Variance Requests to Allow OffPremise Directional and Informational Signs in the Belterra Subdivision, Eric Willis, President, Natural Development 1. Presentation -Paul Cozzolino, with RVi, presents plan and is available for questions. 2. Sign Administrator's Report- City Administrator Michelle Fischer, report on file. 3. Public Hearing - No one speaks. Commissioner Hubbard motions to approve staff recommendations. Commissioner James seconds. Motion passes, 5-0. 4. Sign B1 - Southbound Belterra Drive, Informational 5. BUSINESS Consideration and Possible Action On: A. Ordinance No. 1250.26-An Ordinance of the City of Dripping Springs Amending the City of Dripping Springs Sign Ordinance 1. Sign Administrator's Report- None. 2. Public Hearing - No one speaks. 3. Ordinance No. 1250.26- City Attorney inquires of Commission for feedback to clarify points previously discussed to formulate a final draft ordinance for future consideration. VII. EXECUTIVE SESSION The Planning & Zoning Commission for the City of Dripping Springs reserves the right to adjourn into executive session at any time during the course ofthis meeting to discuss any of the matters listed above, as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072(Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074(Persormel Matters), 551.076 (Deliberations about Security Devices), and 551.086(Economic Development) VIII.
