Commissioner MeClung calls the meeting to order at 7:00 p.m. All present except
Commissioner James and Plarming Director Jon Thompson.
II. PLEDGE OF ALLEGIANCE - Commissioner Hubbard leads the pledge.
III. PRESENTATIONS BY CITIZENS
Floor open to discussion on any subject. No action may be taken by law. Citizens
wishing to speak shall do so after being recognized by the Chairman. The Chairman
and Commission may establish a time limit as necessary.
No one speaks.
IV. MINUTES
A. Approval of Regular Meeting Minutes, April 23,2013 - Commissioner Hubbard
motions to approve. Commissioner Martin seconds. Motion passes, 5-0.
V. SITE DEVELOPMENTS/SUBDIVISIONS/ZONING/ON SITE SEWAGE
FACILITIES/SIGNSAARIANCESAVAIVERS/ALTERNATE
STANDARDS/DEVELOPMENT AGREEMENTS
Consideration and Possible Action on:
A. Vacation of a drainage easement, Lot 1B2,171 Springs Lane,Ben Sorrell,
Applicant
1. Presentation - Hugo Elizondo, P.E., states request and is available for
questions.
2. Plarming Director's Report- Rick Coneway gives report on behalf of
Plarming Director Jon Thompson.
3. Public Hearing - No one speaks.
4. Vacation of Drainage Easement- Commissioner Hubbard motions to
approve staff recommendations. Commissioner Smith seconds. Motion
passes, 5-0.
B. Replat - Howard Ranch Commercial, Lot 63, Block B located at 23455 FM 150
West, Erik Howard, Applicant
1. Presentation - Jeff Guerrero, P.E., states request and is available for
questions.
2. Plarming Director's Report- Riek Coneway gives report on behalf of
Plarming Director Jon Thompson.
3. Public Hearing - No one speaks.
4. Replat- Commissioner Hubbard motions to approve. Commissioner
Burgeson seconds. Motion passes, 5-0.
C. Special Exception - 511 Old Fitzhugh, Request for Special Exception from City
of Dripping Springs Code of Ordinances, Chapter 30(Zoning), Exhibit A,
Section 3.10.4(f) to operate a business out ofa travel trailer for a non-residential
purpose, Deborah Carter, Applicant
1. Presentation -Attorney Rick King, representing Pink West and Karen Moss.
States request.
2. Planning Director's Report- Rick Coneway gives report on behalf of
Planning Director Jon Thompson.
3. Public Hearing - Citizen James Martin inquires of septic requirements for
the travel trailer.
4. Special Exception - Commissioner Martin motions to approve with staff
recommendations. Commissioner Burgeson seconds. Commissioner
McClung inquires regarding septic. Mr. King states that clientele will use
facilities at Pink West. Commissioner McClung inquires regarding parking.
Motion passes, 5-0.
D. Ordinance No. 1220.84-An Ordinance Amending the City of Dripping Springs
Code of Ordinances, Chapter 30,Zoning; to define a Home Business that
includes occupations carried on in a dwelling unit, amend the land use chart to
establish the residential districts where the use is conditionally permitted, and
define such conditions
1. Planning Director's Report- Rick Coneway gives report on behalf of
Planning Director Jon Thompson.
2. Public Hearing - No one speaks.
3. Ordinance No. 1220.84- Commissioner Hubbard motions to approve as
drafted. Commissioner Burgeson seconds. Commissioner McClung states
section 3.17.7- inquires of rational, and also inquires regarding limitations
offour clients per day. Commission discusses hours and parking.
Commissioner Burgeson removes his second. Commissioner Hubbard
motions to approve with removing number of patrons allowed per day and
adding hours of operation from 8:00 to 6:00. Commissioner Burgeson
seconds. Motion passes, 5-0.
E. Conditional Use Permit, 104A Grand Prairie, to allow the operation of an
acupuncture clinic in a SF-4(Two-Family Residential)zoned district, Elizabeth
Yeh, Applicant
1. Presentation - None.
2. Planning Director's Report- Rick Coneway gives report on behalf of
Planning Director Jon Thompson.
3. Public Hearing - Sharon Eastman, states from her observation that four cars
carmot fit in the driveway.
4. Conditional Use Permit- Commissioner Martin motions to approve with
staff recommendations. Commissioner Smith seconds and clarifies that
"hours posted on website" would be hours in ordinance. Commissioner
Martin withdraws motion. Commissioner Burgeson motions to approve in
accordance with staff recommendations except for number one and two.
Commissioner Burgeson withdraws motion. Commissioner Martin motions
to approve the request with staff recommendations and where there is a
conflict defer to the ordinance. Commissioner McClung seconds. Motion
passes, 5-0.
VI. BUSINESS
No Action To Be Taken:
A. Request from Grand Prairie Subdivision Property Owners for the Planning &
Zoning Commission to Initiate a Zoning Amendment to Change the Zoning
Classification of 3.465 acres and 1.72 acres out ofthe A0415 Philip A Smith
Survey, Hays County, Texas(R17944 and R18128),from Commercial Services
(CS)to less intensive Zoning Classification Districts, Art Juarez, Requestor
1. Public Hearing - Art Juarez, 801 Grand Prairie Circle, states that
through process ofitem for 104 Grand Prairie, became aware ofthe
property across the street being zoned Commercial Services.
Sharon Eastman, states concern for the building height allowable within
Commercial Services district. Ms. Eastman also states concern for egress
into the property and type of businesses and aspect of emergency exit
onto Grand Prairie Road.
Orlando Castillo, 400 Grand Prairie, states appreciation for sewer
service and road improvements. Mr. Castillo states concern for
business/thru traffic and amount of traffic that Commercial Services
could generate and is supportive of limited zoning to preserve family life
in the neighborhood.
Juan Garcia, 801 Grand Prairie, states concern for drainage as it is
already an issue.
2. Discussion - Commissioner McClung opens item for discussion.
Commissioner Martin states understanding for neighbor's concerns and
rights of property owner. Commissioner McClung states that property
owner will have to be involved before anything is initiated in regard to
zoning. Commissioner McClung directs staffto research whether there
was zoning when the neighbors purchased their homes. Commissioner
McClung directs staff to speak to the property owner(s) and research
some options.
VII. EXECUTIVE SESSION
The Planning & Zoning Commission for the City of Dripping Springs reserves the
right to adjourn into executive session at any time during the course ofthis meeting to
discuss any ofthe matters listed above, as authorized by Texas Government Code
Sections 551.071 (Consultation with Attorney), 551.072(Deliberations about Real
Property), 551.073 (Deliberations about Gifts and Donations), 551.074(Personnel
Matters), 551.076 (Deliberations about Security Devices), and 551.086(Economic
Development)
