Planning & Zoning Commission Regular Meeting Minutes February 25, 2020 at 6:30 p.m. A Regular Meeting of the Planning & Zoning Commission was held Tuesday, February 25, 2020 beginning at 6:30 p.m. in in the City Hall Council Chambers located at 511 Mercer Street, Dripping Springs, Texas. I. CALL TO ORDER AND ROLL CALL Commission Members present were: Mim James, Chair James Martin, Vice Chair Christian Bourguignon Roger Newman John McIntosh Evelyn Strong Commission Member absent was: Martin Garza City Staff/Appointed Officials present were: Michelle Fischer, City Administrator Ginger Faught, Deputy City Administrator Amanda Padilla, Senior Planner Chad Gilpin, City Engineer Laura Mueller, City Attorney Robyn Miga, Planning Consultant Keenan Smith, Architectural Consultant With a quorum of the Commission present, Chair James called the meeting to order at 6:31 p.m. II. PLEDGE OF ALLEGIANCE Vice Chair Martin led the Pledge of Allegiance to the Flag. III. PRESENTATION OF CITIZENS A member of the public who desires to address the Commission regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or at a public hearing for an item during the Commission’s consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time allotted for presentation of citizens. Speakers are allowed two (2) minutes to speak during presentation of citizens or during each public hearing. Speakers may not cede or pool time. Members of the public requiring the assistance of a translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the Commission. It is the request of the Commission that members of the public wishing to speak on item(s) on the agenda with a noticed Public Hearing hold their comments until the item(s) are presented for consideration. Speakers are encouraged to sign in. By law no action may be taken during Presentations of Citizens. No one spoke during Presentation of Citizens. IV. BUSINESS A. Discuss and consider approval of the January 28, 2020 Planning & Zoning Commission regular meeting minutes. A motion was made by Vice Chair Martin to approve the January 28, 2020 Planning & Zoning Commission regular meeting minutes. Commissioner Newman seconded the motion which carried unanimously 6 to 0. B. Public Hearing and consideration of recommendation regarding PDD2019-0001: Application for Planned Development District to allow General Retail & Multi-Family land uses, up to 4 stories, and an excess of 40’ feet in height for property located at 27110 Ranch Road 12 (Terry’s Mobile Home Park), Dripping Springs, TX (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 5.34, Hays County, TX) and a portion of property located at 230 Sport Park Road (Legal Description: A0415 PHILIP A SMITH SURVEY, ACRES 4.27, Hays County, TX). Applicant: Phil Roesel, CRTX Development LLC 1. Presentation Property Owner Mike Sledge introduced the item. Andrea Fayburger presented the architectural overview which is on file, and Applicant Phil Roesel was available for questions. 2. Staff Report Robyn Miga and Keenan Smith presented the staff report which is on file. Staff recommends approval of the item. 3. Public Hearing Chris Pesek spoke in favor of the item during the Public Hearing. 4. Planned Development District A motion was made by Vice Chair Martin to postpone the item to the March 24, 2020 regular Planning & Zoning Commission meeting. Commissioner Strong seconded the motion which carried unanimously 6 to 0. Vice Chair Martin directed staff to invite the City’s Transportation Engineer to March Planning & Zoning Commission meeting. Chair James directed staff come back with the following items in place: Planning & Zoning Commission February 25, 2020 Regular Meeting Minutes Page 2 of 8 1. Wastewater Utility Agreement 2. Affordable Housing Component 3. Improved Exhibit H to include a narrative from HDR Engineering. C. Public Hearing and consideration of recommendation regarding ZA2020-0002: Application for Zoning Amendment from Agricultural (AG) to Commercial Services (CS) for an approximately 8.546 acre tract of land situated in the Benjamin F. Hanna Survey, Abstract No. 222, Section No. 28, Hays County, Texas. The property is generally located north of U.S. Hwy 290, and west of Bell Springs Road. Applicant: Rusty Staudt 1. Presentation No presentation was given. 2. Staff Report Robyn Miga presented the staff report which is on file. Staff recommends approval of zoning amendment. 3. Public Hearing Granger MacDonald spoke during the Public Hearing and expressed concerns with other possible uses that could occur with the CS zoning and would like to see that Storage be the only use, and that staff complete a drainage study of the property. 4. Zoning Amendment Applicant Glenda Jacoby spoke and agreed to discuss options related to a Conditional Overlay. A motion was made by Vice Chair Martin to postpone the item the March 24, 2020 regular Planning & Zoning Commission meeting and to include a Conditional Overlay with the Amendment. Commissioner Newman seconded the motion which carried unanimously 6 to 0. D. Public Hearing and consideration of recommendation regarding SD2020-0002: Application for a Site Development Permit for property located on Hwy 290, between Ledgestone Drive and Four Star Boulevard, Dripping Springs, TX 78620 (Legal Description: A0245 William S Holton Survey, Acres 3.07). The Site Development application is for a Firestone Service Center. Applicant: Felix Manka, P.E., CMA Engineering, INC 1. Presentation No presentation was given. 2. Staff Report Planning & Zoning Commission February 25, 2020 Regular Meeting Minutes Page 3 of 8 Amanda Padilla presented the staff report which is on file. Staff recommends approval on the condition that the applicant address comments prior to City signatures. 3. Public Hearing No one spoke during the Public Hearing. 4. Site Development A motion was made by Vice Chair Martin to recommend approval of SD2020-0002: Application for a Site Development Permit for property located on Hwy 290, between Ledgestone Drive and Four Star Boulevard, Dripping Springs, TX 78620 (Legal Description: A0245 William S Holton Survey, Acres 3.07), with the condition that the applicant address staff comments prior City signatures. Commissioner McIntosh seconded the motion which carried unanimously 6 to 0. E. Public hearing and recommendation regarding VAR2020-0001: Variance Application to consider a special exception to Chapter 30 Zoning, Exhibit A Zoning Ordinance, Section 5 Development Standards, Subsection B 5.10.1 Screening of Non-residential & Multiple-Family for property located at the southwest intersection of Hwy 290 and Bunker Ranch Rd., Dripping Springs, TX (Legal Description: Lot 1A & 1B, Phase 1, Block 2 of the Bunker Ranch Subdivision) Applicant: Mario Castillo, KBGE, a Part of Civil & Environmental Consultants, Inc 1. Presentation No presentation was given. 2. Staff Report Amanda Padilla presented the staff report which is on file. Staff recommends approval of the special exception with the following conditions: • That the new fence along US Highway 290 be reviewed and approved by staff prior to approval of the site development permit; and • The fence be constructed of a masonry material. 3. Public Hearing No one spoke during the Public Hearing. 4. Commissioner McIntosh recused from the item. 1. Staff Report Laura Mueller presented the staff report which is on file. Staff requests that the Commission make a recommendation on each ordinance for City Council review. 2. Public Hearing No one spoke during the Public Hearing. 3. Zoning Text Amendment A motion was made by Vice Chair Martin to recommend approval ZA2019-0011: Ordinance to Amend the City of Dripping Springs Code of Ordinances Chapter 6: Business Regulations, Article 6.04: Alcoholic Beverages, and Chapter 30: Zoning, Exhibit A: Zoning Ordinance, Section 1.6: Definitions and Section 3.17: Conditional Use Permit (CUP), with selection of Amendment Ordinance Option B as on file. Chair James seconded the motion which carried 3 to 1 to 1 to 1, with Commissioner Strong opposed, Commissioner Newman abstaining, and Commissioner McIntosh recused. G. Public hearing and consideration of approval regarding SUB2019-0063: Application for Replat for property located 14101 Canonade Dr., Austin, TX 78737 (Legal Description: Lot B-1 of the Key Ranch At The Polo Club Subdivision, Hays County, TX). The proposed replat would subdivide an existing lot into two lots. Applicant: Jon Thompson 1. Presentation No presentation given; Jon Thompson was available for questions. 2. Staff Report Amanda Padilla presented the staff report which is on file. Staff recommends approval of the replat. 3. The proposed replat would subdivide an existing lot into two lots. Commissioner Newman seconded the motion which carried unanimously 6 to 0. H. Public hearing and consideration of approval regarding SUB2019-0064: Application for Replat for property located 19050 W. FM-150, Driftwood, TX 78619 (Legal Description: Part of Lot 8 of the JV Ash, Jr. Subdivision, Hays County, TX). The proposed replat would create a legal lot. Applicant: Jon Thompson 1. Presentation Jon Thompson presented the item. 2. Staff Report Amanda Padilla presented the staff report which is on file. Staff recommends approval of the replat. 3. Public Hearing No one spoke during the Public Hearing. 4. Replat A motion was made by Vice Chair Martin to approve SUB2019-0064: Application for Replat for property located 19050 W. FM-150, Driftwood, TX 78619 (Legal Description: Part of Lot 8 of the JV Ash, Jr. Subdivision, Hays County, TX). The proposed replat would create a legal lot. Commissioner Newman seconded the motion which carried unanimously 6 to 0. I. Public hearing and consideration of recommendation regarding a Sign Variance Request for an additional wall sign for The Home Depot's Rental Center, located at 260 E. Highway 290, Dripping Springs, TX. Applicant: Rosalyn Holderfied, ID Associates, on behalf of The Home Depot 1. Presentation Rosalyn Holderfied presented the item. 2. Sign Administrator's Report Planning & Zoning Commission February 25, 2020 Regular Meeting Minutes Page 6 of 8 Michelle Fischer presented the sign administrator report which is on file. Approval is recommended with the condition that the noncompliant flag lights be brought into compliance. 3. Public Hearing No one spoke during the Public Hearing. 4. Variance Request to Allow an Additional Wall Sign A motion was made by Vice Chair Martin to recommend approval of a Sign Variance Request for an additional wall sign for The Home Depot's Rental Center, located at 260 E. Highway 290, Dripping Springs, TX with the condition that the noncompliant flag lights be brought into compliance. Commissioner Bourguignon seconded the motion which carried unanimously 6 to 0. V. REPORTS OF STAFF AND AGENCIES No action to be taken. A. Planning Projects VI. EXECUTIVE SESSION The Planning and Zoning Commission for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). The Planning and Zoning Commission for the City of Dripping Springs may act on any item listed in Executive Session in Open Session or move any item from Executive Session to Open Session for action.
