SPECIAL MEETING DUNCAN PUBLIC UTILITIES AUTHORITY CITY COUNCIL CHAMBERS, DUNCAN, OKLAHOMA APRIL 4, 2025 2:00 P.M. '- ITEM#1:. ROLL CALL Chairman Robert Armstrong General Manager Chris Deal Vice-Chairman Gene Brown Authority Attorney David Hammond Trustee Nick Fischer ABSENT Trustee Patty Wininger Trustee Jimmy Peters ITEM #2: Consider discussion, action, and passing of a Resolution to sign and approve the Legal Services Agreement retaining Fulmer Sill and McAfee & Taft, A Professional Corporation for the purpose of pursuing certain legal claims against manufacturers, distributors, and potentially other third parties regarding polyfluoroalkyl substances (PFAS), Aqueous Film-Forming Foams (AFFF's) and other hazardous water contaminants causing harm to Duncan Public Utilities Authority. This item was presented by Authority Attorney, David Hammond, who explained that the PFAS Litigation and the class action. \_.. Mr. Hammond advised that Fu lmer Sill Law Firm has requested permission to represent the Duncan Public Utilities Authority (DPUA) in this litigation class action on companies that manufacture PFAS chemicals. Mr. Hammond explained that it was necessary to pass a Resolution and sign a Legal Services Agreement to pursue this claim. Mr. Hammon noted that settlement proceeds would be used for costs in the case if the Environmental Protection Agency (EPA) requires corrective action. Judith-Ward Mariner, Citizen of Duncan, addressed the Chairman and Trustees stating her concern about the safety of the water. It was explained that the water was safe and if there were any amounts of PFA's in the water it would be minimal. A motion was made by trustee Fischer, seconded by Vice-Chairman Brown to approve passing of a Resolution to sign and approve the Legal Services Agreement retaining Fulmer Sill and McAfee & Taft, A Professional Corporation for the purpose of pursuing certain legal claims against manufacturers, distributors, and potentially other third parties regarding polyfluoroalkyl substances (PFAS), Aqueous Film-Forming Foams (AFFF's) and other hazardous water contaminants causing harm to Duncan Public '\..._, Utilities Authority.
