Durham Planning Commission M I N U T E S December 8, 2015, 5:30 p.m. City Council Chambers – 1st Floor 101 City Hall Plaza, Durham, NC 1. Call to Order Chair Harris called the meeting to order at 5:35 p.m. 2. Approval of the Minutes MOTION: Approve the Minutes from November (Buzby, Riley 2nd). ACTION: Carried, 9-0 (Freeman not yet present). 4. Adjsutments to the Agenda Chair Harris noted for the record that the agenda reflect Ms. Huff as Vice-Chair and it should reflect Mrs. Hyman as Vice-Chair. MOTION: Approve adopted Agenda. (Whitley, Buzby 2nd) ACTION: Carried, 9-0 (Freeman not yet present). Planning Commission December 8, 2015 Page 1 of 4 5. Public Hearings: Plan Amendments with Concurrent Zoning Map Changes Request A. 4062 Stirrup Creek Drive (A1500008 & Z1500021) Plan Amendment Change Reguest: Office to Industrial; PINs: 0748-02-79-3803. Zoning Map Change Request: Commercial and Office to Industrial; PINs: 0749-04-50-9695. Staff Reports: Ms. Woods presented case A1500008 and Ms. Wolff presented Z1500021. Public Hearing: Chair Harris opened the public hearing. One citzen spoke in support and no one spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on landscaping/berm and the voluntary restriction uses. MOTION: Move A1500008 forward to City Council with a favorable recommendation. (Miller, Buzby 2nd) ACTION: Carried, 10-0. MOTION: Move Z1500021 forward to City Council with a favorable recommendation. (Miller, Whitley 2nd) ACTION: Carried, 10-0. FINDINGS: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. However, should the plan amendment be approved, the request would be consistent with the Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. B. TW Alexander Driverive (A1500009 and Z1500022) Plan Amendment Change Reguest: Commercial and Office to Industrial; PINs: 0749-04-50-9695. Zoning Map Change Request: Commercial Center with a development plan (CC(D)), Office Institutional (OI), and Industrial Park (IP) to Industrial Light with a development plan (IL(D)); PINs: 0749-04-50-9695. Staff Reports: Ms. Woods presented case A1500009 and Ms. Wolff presented Z1500022. Public Hearing: Chair Harris opened the public hearing. Two citizens spoke in support. No one spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on the type of buffer around a cemetery and the types of jobs that would be created. MOTION: Move forward A1500009 to the City Council with a favoravle recommendation. (Buzby, Hyman 2nd) ACTION: Carried, 10-0. MOTION: Move forward Z1500022 to City Council with a favorable recommendation. (Buzby, Freeman 2nd) ACTION: Carried, 10-0. FINDINGS: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. C. 5515 & 5517 NC 55 Highway (A1500011 and Z1500024) Plan Amendment Change Reguest: Commercial to Industrial; PINs: 0737-01-18-2310, -3143. Zoning Map Change Request: Commercial Neighborhood (CN) to Industrial Light with a development plan (IL(D)); PINs: 0737-01-18-2310, -3143. Staff Reports: Ms. Woods presented case A1500011 and Ms. Wolff presented Z1500024. Public Hearing: Chair Harris opened the public hearing. One citizen spoke in support. No one spoke in opposition. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on perfoemance of landscaping. MOTION: Move forward A1500011 to City Council with a favorable recommendation. (Miller, Riley, 2nd) ACTION: Carried, 10-0. MOTION: Move forward Z1500024 to City Council with a favorable recommendation. (Miller, Hyman 2nd) ACTION: Carried, 10-0. FINDINGS: The Planning Commission finds that the ordinance request is not consistent with the adopted Comprehensive Plan. However, should the plan amendment be approved, the request would be consistent with the Comprehensive Plan. The Commission believes the request is reasonable and in the public interest and recommends approval based on comments received at the public hearing and the information in the staff report. 6. Public Hearings: Zoning Map Change Requests (Continued from October 13th, 2015) A. Farrington Mixed Use (Z1500009) Zoning Map Change Request: Office Institutional with a development plan (OI(D)) and Residential Suburban – 20 (RS-20) to Mixed Use with a development plan (MU(D)). PIN(s): 0708-01-48-2313, - 1019, -47-1673, -1083. Staff Report: Ms. Wolf presented Z1500009. Public Hearing: Chair Harris opened the public hearing. Two citizens spoke in support, three against and one undiced. Chair Harris closed the public hearing. Commission Discussion: The discussion centered on traffic, Affordable Housing, Open Space and activities at the northern end of the site. MOTION: Move forward Z1500009 to the City Council with a favorable recommendation. (Miller, Whitley 2nd). ACTION: Failed, 8-2, with Kenchen and Whitley voting yes. FINDINGS: The Planning Commission finds that the ordinance request is consistent with the adopted Comprehensive Plan. However, the Planning Commission believes the request is not reasonable nor in the public interest and recommends denial based on comments received at the Planning Commission December 8, 2015 Page 3 of 4 public hearing, problems with traffic congestion, inadequate transportation infrastructure and lack of affordable housing provided. 7. New Business Grace Smith updated the Commission on the potential cases to be heard at the January 2016 meeting. 8.
