City of Dyersburg Board of Mayor and Aldermen Monday, March 6, 2023 1. Call to Order: The Board of Mayor and Aldermen met for their regularly scheduled meeting on Monday, March 6, 2023 at 7:00 p.m. in the Dyersburg Municipal Court Room. Mayor John Holden called the meeting to order. All members were present except for Mary Claire Hopper. The meeting opened with a prayer by Alderman Rick Crawford. 2. Approval of Minutes: Mayor John Holden called for a motion to approve the minutes from the February 6, 2023 meeting. Alderman James Baltimore made a motion to approve the minutes and Alderman Rick Crawford seconded the motion. All voted in favor. 3. Unfinished Business: None New Business: A. Resolution 03062023 – A resolution stating that the City of Dyersburg be entered into a contract with the Tennessee Department of Transportation for assistance in construction and completion of the herein proposed industrial access highway under the provisions of the Industrial Highway Act of 1959. Mayor John Holden introduced Resolution 03062023 and asked for a motion to adopt the Resolution. A motion to adopt Resolution 03062023 was made by Dennis Moody and Alderman Ricky Hammond seconded the motion. All voted in favor. B. Resolution 03062023A – A resolution delegating authority to the Industrial Development Board of Dyer County to negotiate and enter into payment-in-lieu-of-taxes agreements with companies that are making capital investments and creating jobs in Dyersburg, Tennessee. Mayor John Holden introduced Resolution 03062023A and read an email from Attorney John Lannom explaining the request. A motion to adopt Resolution 03062023A was made by Alderwoman Vanedda Webb and Alderman James Baltimore seconded the motion. All voted in favor. C. Appointment of Tommy Allmon to the Dyersburg Electric Power Board to fill the unexpired term of Dr. Dwight Hedge (March 1, 2023 – June 30, 2024). Mayor John Holden read a letter from Stephen M. Lane, President & CEO of Dyersburg Electric requesting the appointment of Mr. Tommy Allmon to serve out the balance of the vacancy from March 1, 2023 to June 30, 2024. Stephen Lane and Tommy Allmon were also present at the meeting. Alderman Ricky Hammond made a motion to approve the appointment and Alderman Rick Crawford seconded the motion. All voted in favor. D. Attorney Invoice: The attorney invoice, totaling $4,006.25, was approved on a motion by Alderman Dennis Moody and second by Alderman James Baltimore with all others voting in favor.  E. Bids – Greg Williams 1. Department: Sewer Item: Sewer line point repair & relay – Second group of repairs Purpose: Repair sewer line defects identified by survey to comply with consent agreement Budgeted: State Revolving Fund (SDR) loan Notification – State Gazette, Jackson Sun, and (2) plan rooms Bids: Kajacs Contractors Attended prebid but did not obtain plans Trey Construction Attended prebid but did not obtain plans Reagor Construction Attended prebid but did not obtain plans SDT Contractors $2,132,313.60 Marbury Construction $2,549,175.00  SDT Contractors rescinded their bid. They chose to pay $100,000 cash rather than have their bonding company pay for the defaulting. Recommendation: Award bid to Marbury Construction, Denmark, TN, $2,549,175.00. 2. Department: Recreation Item: Turf Mower Purpose: Mow fields at new soccer complex Budgeted: American Rescue Plan Act (ARPA) Notification – None – Sourcewell Contract # 031121 Bid: First Choice Farm & Lawn $31,825.99 Bid awarded to First Choice Farm & Lawn, Dyersburg, $31,825.99. 3. Department: Recreation Item: Tractor to pull turf Mower Purpose: Mow fields at new soccer complex Budgeted: American Rescue Plan Act (ARPA) Notification – None – TN State Contract # 66045 Bid: Ladd’s Inc. $41,183.45 Bid awarded to Ladd’s Inc., Memphis, $41,183.45. 4. Department: Water / Sewer Item: 1-1/2 Ton Truck with Flat Bed Purpose: Replace older truck Budgeted: $65,000 Notification – State Gazette Bid: Ford of Murfreesboro No Response Delta Auto Sales No Bid Tim Castellaw Ford $64,917.00 Bid awarded to Tim Castellaw Ford, Dyersburg, $64,917.00. 5. Department: Street Item: Tractor with boom mower Purpose: Mow roadside ditches Budgeted: American Rescue Plan Act (ARPA) Notification – None – Sourcewell Contract # 110719-JDC Bid: Tennessee Tractor $199,931.02 Bid awarded to Tennessee Tractor, Dyersburg, $199,931.02. Mayor Holden indicated that no motion was required for these bids. He did point out that SDT Contractors (Item # 1) paid $100,000 to rescind their bid. Edward Burks asked where the $100,000 would go. Steve Anderson, City of Dyersburg Treasurer, CMFO, was present and answered that it would go to the Water/Sewer fund. Ricky Hammond asked about the status of the Soccer fields. Mayor Holden said that the goals are being installed and last week they saw a presentation on a piece of equipment that would put the lines on the fields and the bathrooms have been ordered. REPORT FROM THE ALDERMEN/ALDERWOMEN: James Baltimore: Mr. Baltimore wanted to complement a policeman. He didn’t know the policeman’s name, but he stopped and was talking to some neighborhood children and asked them what they wanted to be when they grow up. They said they wanted to be a policeman so he gave them a couple of toy badges. Mr. Baltimore said they played with those badges all afternoon. He said that he was proud to see that policeman’s interaction with the children. He also indicated that he received the email about Zach McBroom being appointed Superintendent in the Street Department. He would like for new hires such as Mr. McBroom to attend a Board meeting and be introduced so they could put a face with their name. Mayor Holden said we could definitely do that. Edward Burks: Mr. Burks said that he appreciated having Tiffany Heard give an update on current projects. He found it very informative. He also said that Brett Sipes had sent the Finance Committee some information on Fire Department equipment needs. He said that the Finance Committee needs to schedule a meeting soon to discuss the needs. Willie Cole: Mr. Cole said that he has had several residents inquire about saving the brick streets in Dyersburg. He also commented on the railroad improvements on Cedar Street. He asked about guard rails on East Court Street and the Mayor said that request would have to be addressed to the State. Rick Crawford: Mr. Crawford congratulated Zach McBroom for being appointed the Superintendent of the Street Department and Tommy Allmon for being appointed to the DES Board. He is also thankful for Resolution03062023 for State road improvements. Ricky Hammond: Mr. Hammond said that he is getting a lot of calls about streets. He also wanted to congratulate the Lady Trojans and Lady Choctaws and is appreciative for all of the community support. Mary Claire Hopper: Absent Dennis Moody: Mr. Moody wanted to thank the Street Department for keeping roads open and Dyersburg Electric and Stephen Lane for quickly restoring service during the recent storms. Vanedda Webb: Mrs. Webb said that a local resident on Speedway Avenue had expressed their appreciation for the Street Department for their assistance during the recent storms. COMMUNICATIONS FROM THE MAYOR In closing, Mayor Holden passed out the Code Enforcement Report for the month of February. He also discussed Form CT-0253, Report on Debt Obligation that was emailed to the Aldermen on March 2, 2023. A copy was also included in the Aldermen’s packets. This is regarding the State Revolving Fund loan to be used for Sewer Repairs. The loan has previously been approved and the form has been accepted by the Division of Local Government Finance.
