APPROVED MINUTES OF THE CITY COUNCIL CITY OF EAST GRAND FORKS TUESDAY, JULY 16, 2024 – 5:00 PM CALL TO ORDER: The Council Meeting of the East Grand Forks City Council for Tuesday, July 16, 2024 was called to order by Council Vice-President Riopelle at 5:00 P.M. CALL OF ROLL: On a Call of Roll the following members of the East Grand Forks City Council were present: Mayor Steve Gander, Council President Mark Olstad, Council Vice-President Tim Riopelle, Council Members Clarence Vetter, Ben Pokrzywinski, Dale Helms, Brian Larson, and Karen Peterson. DETERMINATION OF A QUORUM: The Council President Determined a Quorum was present. PLEDGE OF ALLEGIANCE: OPEN FORUM: Council Vice-President Riopelle stated the open form was an opportunity for members of the public to address the City Council on items not on the current agenda and items requiring Council action maybe deferred to staff or Boards and Commissions for research and future Council Agendas if appropriate. He asked if anyone would like to address the City Council, please come up to the podium to do so. No one came forward. APPROVAL OF MINUTES: 1. Consider approving the minutes of the “Regular Meeting” for the East Grand Forks, Minnesota City Council of July 2, 2024. 2. Consider approving the minutes of the “Work Session” for the East Grand Forks, Minnesota City Council of July 9, 2024. A MOTION WAS MADE BY COUNCIL MEMBER HELMS, SECONDED BY COUNCIL MEMBER LARSON, TO APPROVE ITEMS ONE (1) AND TWO (2). Voting Aye: Larson, Peterson, Vetter, Pokrzywinski, Riopelle, Helms, and Olstad. Voting Nay: None. City Council Meeting July 16, 2024 SCHEDULED BID LETTINGS: NONE. Consider adopting Resolution No. 24-07-54 approving the hiring of Herman Gray as a Police Officer at a salary of $32.43 per hour. 4. Consider approving the Special Event Permit Application to the Iron Pigs Motorcycle Club for the motorcycle ride on the Kenneth M. Olson Memorial Trail in the greenway system on Saturday, August 3, 2024 between 10am and 10:30am. 5. Consider adopting Resolution No. 24-07-55 approving alternate judges for the Primary and General Elections for the 2024 cycle. 6. Consider adopting Resolution No. 24-07-56 entering into an agreement between the City of East Grand Forks and the State of Minnesota for fixed route transportation in East Grand Forks for 2025. 7. Consider adopting Resolution No. 24-07-57 entering into an agreement between the City of East Grand Forks and the State of Minnesota for paratransit services in East Grand Forks for 2025. Regular meeting minutes of the Water, Light, Power, and Building Commission for June 18, 2024. COMMUNICATIONS: NONE OLD BUSINESS: NONE NEW BUSINESS: 9. Consider adopting Resolution No. 24-07-58 authorizing a special election on November 5, 2024 to consider the implementation of the local sales tax and approve the two questions that would be included on the ballot. A MOTION WAS MADE BY COUNCIL MEMBER LARSON, SECONDED BY COUNCIL MEMBER POKRZYWINSKI, TO ADOPT RESOLUTION NO. 24-07-58 AUTHORIZING A SPECIAL ELECTION ON NOVEMBER 5, 2024 TO CONSIDER THE IMPLEMENTATION OF THE LOCAL SALES TAX AND APPROVE THE TWO QUESTIONS THAT WOULD BE 2|Page City Council Meeting July 16, 2024 INCLUDED ON THE BALLOT. Voting Aye: Larson, Peterson, Vetter, Pokrzywinski, Riopelle, Helms, and Olstad. Voting Nay: None. 10. Consider approving the Economic Development Authority to hire an executive search firm for up to the amount of $24,000, contingent upon approval of the EDA Board of Commissioners, should the EDA deem necessary after review of the applicant qualifications and experience collected at the July 23rd meeting of the EDA. A MOTION WAS MADE BY COUNCIL MEMBER HELMS, SECONDED BY COUNCIL MEMBER LARSON, TO APPROVE THE ECONOMIC DEVELOPMENT AUTHORITY TO HIRE AN EXECUTIVE SEARCH FIRM FOR UP TO THE AMOUNT OF $24,000, CONTINGENT UPON APPROVAL OF THE EDA BOARD OF COMMISSIONERS, SHOULD THE EDA DEEM NECESSARY AFTER REVIEW OF THE APPLICANT QUALIFICATIONS AND EXPERIENCE COLLECTED AT THE JULY 23RD MEETING OF THE EDA. Mayor Gander stated this would be needed only if no qualified applications were received. Council member Helms said had been discussed by the EDA Board meeting and would not prolong the process if needed. Council member Peterson asked if the agency would be determined at a later date. Mr. Huttunen told the Council that decision would be made by the EDA Board if they moved forward with hiring a search firm. Council member Larson said process had been extended the process to try and avoid hiring a search firm, but this would let them move forward quickly if needed. Voting Aye: Larson, Peterson, Pokrzywinski, Riopelle, and Helms. Voting Nay: Vetter and Olstad. 11. Consider adopting Resolution 24-07-59 authorizing a $20,000 matching contribution pledge to support the City of Grand Forks application to the USDOT Small Community Air Service Program. A MOTION WAS MADE BY COUNCIL MEMBER VETTER, SECONDED BY COUNCIL MEMBER LARSON, TO ADOPT RESOLUTION 24-07-59 AUTHORIZING A $20,000 MATCHING CONTRIBUTION PLEDGE TO SUPPORT THE CITY OF GRAND FORKS APPLICATION TO THE USDOT SMALL COMMUNITY AIR SERVICE PROGRAM. Council member Helms asked what the City gained from this. Mr. Huttunen said Mr. Wilfahrt was at the meeting to answer questions and give background information. Mr. Wilfahrt stated a federal grant application was completed requesting $1 million, the City of Grand Forks approved up to $300,000 for a local match, and another $200,000 would be needed from the local communities. He explained the intent was to have Sky West to have flights from Grand Forks to Denver as a daily service and the goal was to expand airplane service to Grand Forks. He added this would be a pledge and at this point they had $130,000 raised including from some businesses in East Grand Forks. He told the Council the local match would make this application more appealing and benefit the communities, this was Mayor Bochenski’s big initiative for the year, and the Grand Forks EDC and the Chamber was tasked with helping raise additional funds for the grant. He informed the Council they had a letter from Sky West to go with the application saying they were willing to provide service, or the application would not be considered. He added it was a fast-moving process and it was a good opportunity they would be able to see service going to Denver. 3|Page City Council Meeting July 16, 2024 Council member Helms asked what the guarantee was that service would continue. Mr. Wilfahrt said they would need to use it, or it would be lost, and it connected to a United hub so it was a separate carrier. Council member Helms asked what the $1 million would be used for. Mr. Wilfahrt said if the service was profitable, they would not use the local funds, but it was a revenue guarantee. He commented hopefully people would be using the service and Fargo had completed four of the grants which had been successful for them. He said if the funds were needed it would not be until 2025, they would have to negotiate with the airline, and a consulting firm had been hired to help with the process. Council member Helms asked how the $20,000 was determined. Discussion followed about how the amount of pledges have varied from $1,000 up to $20,000, applications that did not have a minimum of 40% local match did not get funded, it was the region’s air service, Grand Forks was putting up at least $200,000, and the City participating would help significantly in the grant process. Consider authorizing the City Administrator/Clerk-Treasurer to issue payment of recommended bills and payroll. A MOTION WAS MADE BY COUNCIL MEMBER HELMS, SECONDED BY COUNCIL MEMBER VETTER, TO AUTHORIZE THE CITY ADMINISTRATOR/CLERK-TREASURER TO ISSUE PAYMENT OF RECOMMENDED BILLS AND PAYROLL. Voting Aye: Larson, Peterson, Vetter, Pokrzywinski, Riopelle, Helms, and Olstad. Voting Nay: None. COUNCIL/STAFF REPORTS: Mayor Gander said he had been asked about what was being put in at the railroad crossing and how safety structures were being installed for the quiet zone. He commended the work being done, the improvements to the traffic lights have helped improve traffic flow, and the work progressed quickly to get things done in a timely fashion. Council Member Helms asked Mayor Gander and Council member Larson if they would be judges for the hotdish contest during Heritage Days and reminded everyone Heritage Weekend was August 9th and 10th this year. Both agreed to be judges. Council Member Larson said he was proud to be a hotdish judge. Mr. Emery informed the Council the sidewalk and multi-use trail project had started the previous week, the concrete work should be completed this week, and the project should be completed by the end of July. He stated the quiet zone project was progressing, by the end of July Central Avenue should be back open to traffic, and by the first of August 3rd Street would be closed. He added they were hoping to have the project completed by August 31st so it was done before school started. Council member Helms asked if they had replaced the traffic lights at 2nd Avenue. Consider accepting the proposal from Johnson Controls to update the HVAC system at the Senior Center for a total of $148,500. Council member Vetter said there was still interest in the building so this item should be tabled. Council President Olstad said it was his opinion it should be voted on and not tabled. Consider adopting Resolution No. 24-07-52 approves reclassification of the Senior Center Coordinator position and freezes the position’s wage until the approved salary meets or exceeds the Grade 12 pay range. Consider declaring the 2020 Ford Police Interceptor and associated equipment as surplus and approve the sale to Guardian Fleet Safety with funds to be used as a credit towards the new equipment for the outfitting of the new squad car. DETERMINATION OF A QUORUM: The Council President Determined a Quorum was present. 1. Review of the Safe Streets for All Action Plan – Stephanie Halford Ms. Halford said this was an updated on the action plan for Safe Streets for All, reminded the Council how the grant was applied for, $400,000 was received to help plan, and this granted access to additional funding sources. Mr. Blue Weber stated again how being awarded a grant allowed the communities to access funds and help make safer streets for all users. He explained they would be a part of the entire process, how $1 billion dollars each year would be available for Safer Streets for All projects, and action plans were needed to show how the funds would be used. He reviewed the five elements for the safe system approach, how it was for everyone that used the road system, crash information was used in the process, and that would help to be proactive by identifying issues and setting priorities. He stated there were eight components for the project and gave a brief explanation for each. He told the Council this was early in the schedule, there would be additional updates throughout the project, they were holding pop-up events, they were willing to be at other types of events, and there was a website with an interactive map that people could add input. Mr. Weber informed the Council they would be looking at a high injury network which would be based on the crash information from across the area along with an intersection analysis to try and determine why there were issues at certain locations and come up with implementation goals. He added they were also working with a subcontractor that had worked in other cities on environmental impacts along with other factors and helped implement plans in other cities. He stated there was a peer review and the cities were chosen based on weather and population distribution. He told the Council again how there were going to be pop-up opportunities and reach out for public input. He asked for questions. 8 Work Session July 9, 2024 Mayor Gander thanked them for the presentation, was glad this could open doors to funding, and asked what things could be brought to a neighborhood. Mr. Weber said it could include a road reconstruction, sidewalks, round-a-bouts, or other items. Ms. Halford commented how they were looking for intersections or corridors. Mayor Gander asked if they wanted to hear from the people. Mr. Weber said yes, they could contact him because they wanted feedback about issues in areas. Mayor Gander said this would help make sure the funding went to the greatest need. Mr. Weber added they should be proud of Ms. Halford, because of the grant request, the communities received a grant four times more than what the Fargo/Moorhead area received. There were no other questions. This item will be brought back to a future meeting. 2. Consider Approval of the 2025 Fixed Route and Dial-A-Ride Applications – Nancy Ellis Ms. Ellis told the Council the operating grants would be split 95/5 for 2025 because the federal funds were increased from $135,000 up to $208,000. She stated there were many overages in Grand Forks for Dial- A-Ride services, they could only request so much funding based on the cost models, but they could make an adjustment once the contract was received. She added there was a concern about maintenance and suggested rolling over anything remaining in the 2024 budget to help with the 2025 budget. There were no questions. This item will be referred to a City Council Meeting for action. 3. Consider Approving the Hiring of a New Police Officer – Mike Hedlund Chief Hedlund informed the Council they were short one position but that was currently being filled by Officer Gunderson who would be returning to the schools soon as the resource officer. He added the new police officer would be moving to the area. Council Pokrzywinski asked how long the position had been open. Chief Hedlund said they were fully staffed until the school resource officer was able to go back into the schools. Council member Larson asked what brought this person to the community. Chief Larson said it was family ties of his significant other. There were no further questions. This item will be referred to a City Council Meeting for action. 4. Discussion on Sales Tax Ballot Questions – Jeremy King Mr. King said ballot questions were due to the County no later than August 13th. He explained they had been working with Kennedy and Graven on the two separate questions and during this process learned there might need to be another ballot question in 2026 because the City Charter requires a vote if the City were to issue general obligation bonds for fundraising. He said that question had a blank in it because they were not sure at this time what amount they would be trying to fundraise for so at this time they would be moving forward with just the two questions. Council member Peterson suggested that when this was talked about in the community to include the economic impact the facilities have because that was not always brought up. Mr. King said the consultants were working on updating the information about the project and would hopefully have it by the next meeting and they would include the importance of economic impact. Council member Peterson said it was important to show what these facilities did and not just for the programs. BACKGROUND INFORMATION: This is an annual application and contract with MnDOT to receive operating funds for the Fixed Route and Paratransit/Senior Rider (DAR) service. MnDOT has been given additional funds from the state’s budget surplus and are again providing a 95/5 split for 2025. As well, MnDOT allows us to use 75% of our Federal appropriated dollars for operating instead of the past where Fed dollars were a 50/50 split between operating and capital. When we approve our final City budget in November or December, I will have the State’s approved cost share of each transit service for the year of service, 2025. At this time, the cost of services is an estimate; and the funds from the State, the amount of our federal allocation used toward the operating expenses, and our local share is still a work in progress. Our costs for fixed route purchase of service are a percentage of the total cost to operate Cities Area Transit split between GF, EGF and UND. Dial-a Ride with Grand Forks will go up because operations for DAR/SR service is increasing and the total cost to run the service is now separated from the Fixed Route billing. We now have Cost Allocation Models for both services that break out direct and indirect costs using past years total charges with a modest increase. Both are used for our MnDOT operating applications and for our use to budget transit. I am preparing the applications for the estimated costs we currently have available to us. Voting Aye: Grinde, Beauchamp, Quirk, Riopelle Voting Nay: None Kristen Shipes Commission Secretary 24 #9 RESOLUTION NO. 24 – 07 - 58 A RESOLUTION OF THE CITY OF EAST GRAND FORKS RELATING TO THE IMPOSITION OF A SALES AND USE TAX AND CALLING A SPECIAL ELECTION THEREON Council Member ____________, supported by Council Member _________, introduced the following resolution and moved its adoption: WHEREAS, Minnesota Statutes, Section 297A.99 (the “Local Tax Act”), provides the City of East Grand Forks, Minnesota (the “City”), with the authority to impose a local sales tax if that tax is approved by the voters at a general election and the State of Minnesota (the “State”) Legislature (the “Legislature”) approves the local sales tax through the creation of a special law; and WHEREAS, the Legislature passed and the Governor of the State signed, Minnesota Laws 2024, Chapter 64, Article 10, Section 33 (the “Special Law”) which authorizes the City to, among other things, impose a sales and use tax of up to one percent, if approved by the voters as required by the Local Tax Act; and WHEREAS, the Special Law is effective upon approval by a majority vote of the City Council of the City (the “Council”) and the filing of a certificate (the “Certificate”) with the Secretary of State, all in accordance with Minnesota Statutes, Section 645.021, subdivisions 2 and 3, and the Council approved the Special Law on March 19, 2024, and the City filed the Certificate with the Secretary of State in March 2024. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of East Grand Forks, Minnesota as follows: 1. The Council proposes to submit to electors questions regarding whether to impose a local sales and use tax of one percent (the “Taxes”) on items that are taxable by the State in order to raise revenues to finance (i) the reconstruction and remodeling of, and upgrades and additions to, the City’s Civic Center Sports Complex (the “Civic Center Project”) and (ii) the reconstruction and remodeling of, and upgrades and additions to, the City’s VFW Memorial Arena (the “VFW Memorial Arena Project”), including securing and paying debt service on bonds issued to finance such project and associated bond issuance costs. 2. The questions of imposing the Taxes shall be submitted to the qualified electors of the City as city ballot questions as shown in Exhibit A attached hereto. 3. The Taxes are proposed to be collected for approximately 20 years or until amounts equal to $6,745,000 related to the Civic Center Project and/or $8,000,000 related to the VFW Memorial Arena Project, plus the costs of collecting and administering the tax and an amount sufficient to pay the costs related to issuance of any bonds for the projects, including interest on the bonds is collected, in accordance with the Special Law. 4. The questions set forth in Exhibit A shall be submitted to the qualified electors of the City at a special election which is hereby called and directed to be held in conjunction with the general election on Tuesday, November 5, 2024. Before a contract in excess of $1,000 is awarded for printing ballots, the printer shall furnish, in accordance with Minnesota Statutes, Section 204D.04, a sufficient bond, letter of credit or certified check acceptable to the City Clerk in an amount not less than $1,000 conditioned on printing the ballots in conformity with the Minnesota election law and the instructions delivered. The City Clerk shall set the amount of the bond, letter of credit or certified check in an amount equal to the value of the purchase. 9. Election judges shall be appointed for this special election shall be the election judges appointed for the city general election. The election judges shall act as clerks of election, count the ballots cast, and submit the results to the Council for canvass in the manner provided for other City elections. 10. The special election shall be held and the returns made and canvassed in the manner prescribed by law, and the Council shall meet on November 12, 2024 (a date between three and ten days after the election) or no later than November 15, 2024 for the purpose of canvassing the results thereof. Dear Mayor Gander, This email is sent on behalf of Grand Forks Mayor Brandon Bochenski, who has initiated an aggressive effort to help attract increased air service at Grand Forks International Airport (GFK). The Grand Forks Region EDC and Grand Forks-East Grand Forks Chamber are committed to supporting Mayor Bochenski’s objective to increase community air travel options. As part of this important initiative, the Grand Forks – East Grand Forks business community has participated in surveys that have profiled air travel activity in the region. The results of the surveys demonstrate a strong business case for increased air service at GFK. We are at a critical point in our work and are preparing an application to the U.S. Department of Transportation (USDOT) for an air service development grant. If awarded, the grant will provide GFK and the City additional resources to help recruit another major airline to our market. The grant application, which is due on Thursday, July 25, will target funds to attract nonstop service by United Airlines to its Denver hub, an important destination for GFK travelers, offering passengers considerable connecting opportunities in the U.S. and internationally. We will request federal funds of $1 million from the USDOT to support a revenue guarantee for nonstop service to Denver. The revenue guarantee will help offset airline risk associated with the start-up phase for a new route/airport market that typically spans the first year of service. As part of the grant application, we need to demonstrate community support through financial pledges that will come due if: 1) GFK is awarded a USDOT grant and 2) a second major airline is secured to serve the GFK market. In other words, only if a new service begins at GFK. We expect to know the USDOT grant decision before the end of the year. We have set a pledge target of $400,000 to match the $1 million request to the USDOT. As an important stakeholder in supporting regional businesses, we respectfully request the 46 City of East Grand Forks consider partnering on this critical initiative by pledging $20,000 to match the anticipated USDOT air service grant.
