Minutes Village of East Troy Plan Commission & Architectural Review Board December 11, 2017 1. Call to order – President Seager called the meeting to order at 6:30 pm 2. Pledge of Allegiance 3. Verification of open meeting notice - Administrator Suhm verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Seager, Commissioners John Grudnowski, Roger Hayes, Erin Seaverson, Benny Stichmann Excused: Commissioner Edward Arendt and Absent: Trustee Forty Renucci Others: Zoning Administrator Tim Schwecke and Administrator Suhm Youth in Government Representatives – Matt Kisting & Nick Schwall 5. Approve Plan Commission minutes of November 13, 2017 Commissioner Seaverson requested a correction on the last paragraph of page two, third line, adding the word “to” so it reads “making alterations to existing or to new construction. Motion by President Seager, second by Commissioner Grudnowski to approve the minutes from November 13, 2017, with the correction stated by Commissioner Seaverson. Advisory Vote – Motion carried. Plan Commission – Motion carried. 6. Approve Plan Commission minutes of November 20, 2017 Motion by President Seager, second by Commissioner Grudnowski to approve the minutes dated November 20, 2017. Advisory vote - Motion carried. Plan Commission – Motion carried. 7. Citizen participation None. 8. Site plan for a lift station including a building for a generator located at 3071 South Street (RXUP 00190); Village of East Troy, applicant (application 2017- 33) Details are available online: https://s.zoninghub.com/UX4YAIH0WA Plan Commission Minutes December 11, 2017 Page 2 of 4 A. Possible action by the Plan Commission Will Hein, an engineer with Applied Technologies, Inc., presented the plans for the lift station, reviewing the plans for the wet well, mechanical well and building to house the generator. He stated he is concerned that an oak tree on the site may be affected by the construction. Zoning Administrator Schwecke reviewed his staff report dated December 4, 2017. He stated the concrete in front of the building was extended from what had been submitted in the packet. In addition, light locations were not in the packet, but depicted on a display for the Commission. The Commission discussed the following: • The new building is smaller than the previous structure, but the concrete area is larger. • Prior equipment will be removed and filled below grade. • The generator runs during power outages and exercised once per month. • The light over door on the west side faces the woods and is dusk to dawn. The light at the front of the building is a work light. Motion by President Seager, second by Commissioner Stichmann, to approve the site plan for the lift station as proposed, provided the petitioner obtains a building permit from the Village’s Building Inspector for the generator building. Advisory Vote – Motion carried. Plan Commission – Motion carried. 9. Conditional use application for a sports complex classified as indoor commercial entertainment and outdoor commercial entertainment located on the north end of Executive Drive (RA376700001); Marcus LLC, property owner, Ron and Andrea Jarecki, applicant (application 2017-23) Details are available online: https://s.zoninghub.com/1BDLK88EKL A. Public hearing (adjourned at the meeting on September 11, 2017 and November 13, 2017) Zoning Administrator Schwecke stated the petitioner asked for a delay while working through financing, a business plan and other details. The public hearing should be adjourned, and when the materials are submitted we will republish and send a new notice to the neighbors. B. Possible recommendation by the Plan Commission to the Village Board Motion by Commissioner Seaverson, second by Commissioner Grudnowski, to adjourn the public hearing to an unspecified date and staff is to provide a public notice for the hearing when the date has been finalized. Note: The applicant has again asked that the public hearing be adjourned to allow additional time to finalize their plans. Given the time-delay, a new public hearing notice will be published when the review date has been finalized. 10. Proposed amendment to the Village's zoning code relating to definition of building height; (application 2017-32) Details are available online: https://s.zoninghub.com/SXZF63ZBOI A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed his staff report dated December 4, 2017. He explained the purpose is to modify the definition of building height and address the measurement when dormers exist. President Seager closed the public hearing. With no public attendance, no comments were made. B. Possible recommendation by the Plan Commission to the Village Board Motion by President Seager, second by Commissioner Stichmann, to recommend to Village Board the approval of the ordinance as drafted, based on the findings contained in the proposed ordinance. Advisory Vote- Motion carried. Plan Commission – Motion carried. 11. Discussion related to potential zoning code amendments relating to accessory buildings Zoning Administrator Schwecke reviewed his staff report dated December 6, 2017. He reviewed the need to address inconsistencies in the current code. The other element the Commission will need to address is determining the appropriate size(s) for accessory buildings. Discussed the following: • The proposed ordinance will not refer to a building as a garage or shed, only an accessory building which could include buildings such as a garage, shed, gazebo or pool house. • There are not regulations in the current code to address attached garages. This could be addressed at a later date. • The lot size and setbacks would prohibit too large of a garage. • In addition to an accessory building a smaller shed, less than 150 square feet, would be allowed. • The wording of section JJ should be clarified as it relates to the wording of “nonresidential” • Removing the word residential in section 3(JJ)(3). Plan Commission Minutes December 11, 2017 Page 4 of 4 • The Commission agreed to the proposed total floor areas in the draft A. Possible action by the Plan Commission No action taken. The Commission determined they would like to review the revisions and sizes incorporated into a draft prior to setting a public hearing. 12. Discussion related to potential zoning code amendments relating to storage of boats, trailers, and other vehicles in residential districts Zoning Administrator Schwecke reviewed his staff report dated December 8, 2017. The purpose of the amendment is to address the number and types of vehicles and other things that can be parked on a property. The Commission discussed the following revisions to 510-938: • A(2) strike “pop-up” from camping trailer • A(3) keep 16,000 pounds (remove 10,000) • The 30 feet in length, section B(3), should apply to a camping trailer, boat trailer or boat • Section A, last paragraph, add “if so required” to the provision that trailers must be registered and licensed. A. Possible action by the Plan Commission No action taken. Zoning Administrator Schwecke will prepare a draft in ordinance format with the revisions discussed for review at the next meeting. 13. Recommendations for future agendas Commissioner Seaverson requested a review of attached garage regulations be added to a future agenda 14.
