EAST TROY VILLAGE BOARD MINUTES April 24, 2017 Page 1 of 4 Call Meeting to Order; Pledge of Allegiance Administrator Suhm verified the meeting was posted according to law. Roll Call: President Seager called the meeting to order at 6:30 p.m. Present: President Scott Seager, Trustees Alexander Alger, John J. Jacoby, Matt Johnson, Forty Renucci, and Ann Zess Excused: Others: Chief Boyes, Administrator Suhm Youth in Government Representative Alexander Marshman Citizen Participation Steve Rostkowski, 2959 North Shore Dr., stated he is on Walworth County’s Lake Association and the representative of East Troy Lake Association. The Village of East Troy did a study on the phosphorous issue. The Lake Association is wondering if they could get the results of the study because many of the smaller lakes in Walworth County are experiencing the same issues. He is wondering if any kind of conclusion has been drawn from the year-long plus study. Asking the Board to consider working with the East Troy Lake Association and/or Walworth County and share the end results and impact for the Lake Association. He is on the Park and Recreation Board and Park and is asking if another pier were to be put on the pond would it need to have special safety considerations. Trustee Renucci explained that the Village Board cannot answer questions posed during Citizen Participation. He is acting as the representative for the Lake Association as a liaison to the Village staff with any questions/concerns from the members. Miscellaneous Business 1. Recommendation from Plan Commission to approve condo plat for 3001 and 3003 Graydon Avenue; Millennium Dream Homes LLC (Jesse Dropik, agent) applicant (application 2017- 09) Trustee Johnson asked about the conditional approval. Motion by Trustee Johnson, second by Trustee Jacoby to approve the plat subject to the conditions and filing the condo declarations with State. Advisory Vote – Carried. Village Board – Carried. 2. Recommendation from Plan Commission to approve condo plat for 3005 and 3007 Graydon Avenue; Millennium Dream Homes LLC (Jesse Dropik, agent) applicant (application 2017-10) Motion by Trustee Zess, second by Trustee Johnson to approve the plat subject to the conditions and filing the condo declarations with the State. Draft Plan Commission Minutes 4/10/2017  EAST TROY VILLAGE BOARD MINUTES April 24, 2017 Page 2 of 4 Trustee Renucci questioned item nine regarding free standing murals. Administrator Suhm explained murals were already allowed on the side of a building. The amendment allows them as a freestanding sign as well. Trustee Renucci referenced amendment 10 regarding cell towers. He stated there should be a reference to the height limitations with the proximity to the airport. Beautification efforts and entry signage were discussed. Adjourn to Committee of the Whole Motion by Trustee Renucci, second by Trustee Johnson to adjourn to Committee of the Whole. Advisory Vote – Not taken. Village Board – Motion carried. Discussion Items: 1. Joe Klarkowski, Multi-Use Trail Technical Expert and Mary Nicoson, Trail Committee Leader – Information on current work on trails in the area Mary Nicoson explained that the East Troy Area Community Foundation that was introduced to community several years ago, and is a 501c3, designed to bring the three East Troy communities together. There has been a lot of encouragement in surrounding communities looking at trails within their communities. The Foundation is working on a project to bring a walking, recreational, non-mechanical path parallel with the railroad tracks as a perfect venue for residents and visitors to the area. One vision would have it start at the old Trent Tube site, up Energy Dr., cross over Highway ES to Highway 20, cross Highway 20 running parallel to the existing tracks. There is a 25-foot easement on each side of the railroad tracks and the path could continue to Army Lake Road, take Army Lake Road to the end, rejoin the path to Beach Road, onto Stewart School Road to Byrne’s Park. This would connect the communities and the counties as there would be five governmental bodies involved – The Village, the Town of East Troy, the Village of Mukwonago, Walworth County and Waukesha County. The Railroad needs to agree to the project first. Joe Klarkowski explained that he is familiar with the Transportation Assistance Program (TAP) program through his job. This project falls within the definition of the TAP program. The money in the program is funded out many years ahead. This project has an estimated cost, at this time, of about $2 million for a 10’ wide asphalt, all season, trail. The Foundation is looking at doing fundraising, donations, naming rights and sponsors. The first steps would include securing participation buy-in and needing the Railroad and Mukwonago to agree. The next step would be to have a sponsor which would potentially be Walworth County and an intergovernmental agreement would be signed. The TAP application needs to be submitted by this October. The selection of TAP fund recipients would be in January or February, 2018. Design of the trail would happen and building could begin in 2019 or 2020 at the latest. Billing would go from DOT to sponsor (Walworth County) and the County would in turn bill the other entities. It may be a half of a year to a year before entities would be asked to pay for their portion of the design. Joe has spoken with Dave Bretl and County Board Chairman and unofficial they were very  EAST TROY VILLAGE BOARD MINUTES April 24, 2017 Page 3 of 4 positive. The County has been trying to get some trails in the County and each time an issue arises that halts the effort. The Village can help by getting the word out and looking at possibilities for a trailhead parking lot. For the trail to be built by a different user than owner of the railroad property there would need to be limited highway easement document regarding responsibilities of the owner of the trail versus the owner of the right of way. The Railroad does not want any liability or maintenance obligations. This agreement should be in place before the application or if there is a positive intent it could be in process during the application process. We do not have a project unless the federal money is awarded. The question was raised regarding what maintenance could be expected. A trail such as the White River Trail is a crushed limestone base and is graded and compacted once a year and brush is trimmed. An asphalt paved trail will have paint at road crossings which may need to be redone every two to three years at state highways. Joe expressed his hope that the Community Organization/Biking Club would volunteer to maintain the trail by keeping the brush back. Mowing could be done or not – trails are kept both ways. The Railroad did state they wanted a fence between the trail and the tracks, but if a section has a wooded separation that may be acceptable as a barrier. 2. Ehlers, Inc. - Financial planning workshop with Ehlers – Second session will include presentation by Ehlers, review of historical data, financial projections and indicators. May also include discussion regarding future operations and capital planning. Dawn Gunderson reviewed the second workshop items. She reviewed the following:  Forecast assumptions regarding the percentages used for increases in expenditures as well as assumptions related to staffing levels which were kept the same. The levy remained the same for the airport and capital projects funds, but was increased for the other tax supported funds to provide revenue for the additional costs.  The projections were based on the 5-year capital improvement plan adopted with the 2017 budget, which made borrowing necessary as part of the financing plan.  Reviewed the impact on the tax rate. The increases in tax rate were mainly due to the proposed debt.  Reviewed expenditure levy limits and how this limits the amount of tax revenue the Village can receive each year. Dawn suggested reviewing any user fees charged for periodic inflation adjustments.  Reviewed expenditure restraint, which is tied to net new construction and a CPI. Dawn explained the Village receives approximately $50,000 annually for expenditure restraint. An increase in expenditures, including a transfer out from the general fund, likely would eliminate the incentive payment that year. Discussed planning to forgo the restraint payment one year to transfer general fund balance to capital for projects. She projected in 2021 the Village would not qualify for the payment to be received in 2022 due to a transfer from general fund balance to capital for a dam project.  EAST TROY VILLAGE BOARD MINUTES April 24, 2017 Page 4 of 4 The Board discussed concerns about the projects included in the capital project plan in addition to other projects that had not been included. It was concluded the Board will review the capital project plan at the May 15 Village Board meeting to prioritize and obtain a more realistic capital plan for projections. The financial planning workshop in May will cover the utilities and a new capital plan will be given to Dawn prior to her return in June.
