EAST TROY VILLAGE BOARD MINUTES August 5, 2019 Page 1 of 3 Call Meeting to Order; Pledge of Allegiance Administrator Suhm verified the meeting was posted according to law. Roll Call: President Seager called the meeting to order at 6:30 p.m. Present: President Scott Seager, Trustees John Alexander, Alexander Alger, Alan Boyes, Mary Nugent, Matt Johnson and Forty Renucci Others: Chief Swendrowski, Administrator Suhm, Attorney Pruitt, Deputy Clerk Alexander Citizen Participation Valencia Aide, 3051 South St., read a letter that she has submitted to the East Times Times expressing her concerns regarding the option of using chemical application to control the cattails in the impoundment area and the impact on the environment. She also praised the dog park. Becky Magestro, 2955 Mallard Way, spoke regarding her concerns of the parking of vehicles on the street at 2925 Mallard Way and on Brookstone Lane. Her concern is this is a hazard for children in the neighborhood because the vehicles are an impairment visibility and traffic. She requested that the parking ordinances be enforced, and the resident use his garages and driveway for parking. Consent Agenda 1. Approval Minutes – 7/11/2019 Joint Meeting, 7/15/2019 2. Operator’s Licenses – see attached list 3. Consider approval of Successor Agent for Dollar General – Kelli Van Bendegom 4. Consideration of appointment recommended by President Seager of Leslie Thomas to Library Board as Village Representative 5. Consider approval of Parade Permit for ET High School Cross Country 5K Run, “Your Theme for Our Team”, August 17, 2019, 8:00 am to 11:00 am, route attached, to use a Police Department “rolling” start and finish. 6. Consider approval of Parade Permit for High School Homecoming Parade, September 27, 2019, 1:30 – 2:30 p.m., Jinnesa Pluess, Event Chairperson 7. Consider granting approval of Special Event Permit for the East Troy Chamber of Commerce Bluegrass Festival, Sept. 6-8, Friday 5 – 8 pm; Saturday and Sunday 10 am - 6:30 pm, estimated attendance 1,000-2,500, contingent upon receiving written approval from Walworth County to close Hwy ES on the north side of the Square on Saturday and Sunday. a. Consider approval of Temporary Class B license for East Troy Chamber of Commerce Bluegrass Festival, Sept. 6 – Sarah Manke and Vanessa Lenz, Operators Motion by Trustee Boyes, second by Trustee Alexander, to approve the Consent Agenda. Motion carried. Miscellaneous Business 1. Consider Wayfinding Sign policy and 2020 plan for inclusion in 2020 budget Trustee Renucci suggested adding the Public Library to the Wayfinding Signs. Motion by Trustee Johnson, second by Trustee Nugent, to approve the policy and renderings and set aside $8,000 in the 2020 budget for Wayfinding signs with any overage to be held over for Wayfinding Signs in 2021. Discussion and direction to staff regarding desired changes in service levels to be considered with the 2020 budget Administrator Suhm explained this item begins the budget season. The question was raised if the additional yard waste curbside pick-ups were being utilized. This will be the second year and we do not have utilization data at this time. It is planned to discontinue offering the leaf collection site at the end of Young Street once residents become familiar with the curbside pick-up. Discussion also included promotion of the Electronic Recycling dates and additional fencing at the ball fields for safety and larger tournaments as well as the guardrail at the playground in Mitchell Park. 3. Update on 2954 Main Street Chief Swendrowski explained his memo and discussed the condition of the building at 2954 Main St. He explained that there have been attempts to contact the owner and citations issued and the owner still refuses to contact the Code Compliance Specialist. His court date is set for later in August. Attorney Pruitt discussed options that are open to the Village to reach the goal of compliance and public safety. He suggested that the citations be issued as daily citations. If there is no action the Village could get a judgement and place a lien against the property to allow the opportunity for the Village to recoup any cost it should incur in securing the property for safety, repairs or razing in the future. Concerns were expressed about the unpaid back taxes on the property and how that could impact the property. Attorney Pruitt reviewed steps and the timeframe that the Village could take to encourage the owner of the property to bring the property into compliance and/or issuing a raze/repair order. Concerns included the rear door, broken windows, collapsing brickwork, access by animals, etc. Discussion included the differences in a raze order vs. a raze/repair order and that this property currently would not meet the criteria for a raze only order. Attorney Pruitt advised the Village could board the door and windows of concern due to the number of letters sent indicating it is a nuisance. He suggested a letter be sent to the owner stating the Village is taking that step. The cost can be charged to the property owner. The Village Building Inspector will become involved in determining the extent of violations at the property. It was desired that the owner makes repairs by a specified date or the Village of East Troy will make the repairs and charge the owner. Once a raze or repair order is issued by the Building Inspector Attorney Pruitt explained it should be recorded on the property so if the property is sold a buyer is made aware of the order. Motion by Trustee Johnson, second by Trustee Boyes, to direct staff to issue a notice to the owner to abate the public nuisance (specifically noting the property maintenance of repairing the rear door and broken windows) or the Village will do this and charge it back to the property owner, go to a daily forfeiture methodology for citations and if the owner doesn’t attend his court date on August 21 or provide satisfaction of the repairs to the property the Village will pursue a raze/repair order. Motion carried. 4. Direction to staff regarding 2020 budget item for broadcasting/streaming meetings Administrator Suhm reviewed the memo and recommendation to accomplish this. She asked the Village Board what direction they would like to go. Consensus of the Board was to start with a system to use a single camera to record the meeting and upload the recording to YouTube and to be sure that the audio is acceptable. Should this be well received it could be expanded upon in the future. 5. 2019 Update on Fireworks Sales Motion by Trustee Alexander, second by Trustee Nugent, to disallow fireworks sales in the Village. Ordinances & Resolutions 1. Ordinance 2019-03 – Modifications to Chapter 470, Article II, Related to Recycling Administrator Suhm explained the reason for the modifications are to ensure that the Village is complying with grant requirements. Motion by Trustee Alexander, second by Trustee Johnson, to approve Ordinance 2019-03. Motion carried. Reports 1. Parks & Recreation Minutes – 05/13/19 2. ETAESD Minutes – 05/21/19 3. Dam Financial Report – Administrator Suhm distributed a revised report and noted the changes were due to formula. Suggestions were made on the format for future reports 4. Municipal Court – June 2019 5. June Financial Report 6. Police Department 2nd Quarter 2019 Report – Chief Swendrowski pointed out the reports from the new RMS system and the new formats 7.
