EAST TROY VILLAGE BOARD SPECIAL MEETING MINUTES July 1, 2021 Page 1 of 1 Call Meeting to Order; Pledge of Allegiance Administrator Suhm verified the meeting was posted according to law. Roll Call: President Seager called the meeting to order at 6:30 p.m. Present: President Scott Seager, Trustees John Alexander, Mary Nugent, Matt Johnson, Forty Renucci, Jason Smalley and Joe Wisnewski Others: DPW Director Equitz, Administrator Suhm, Attorney Geary All Attendees were Remote Via Zoom Miscellaneous Business 1. Consider authorizing permit for the East Troy Railroad to place watermain under their tracks DPW Director Equitz reviewed the requirement for the permit, explaining Attorney Geary has reviewed the agreement. They hope to begin the utility work next week. Motion by Trustee Johnson, second by Trustee Alexander, to authorize the permit. Motion carried. 2. Consideration/Update on status of Cobblestone property, update on stabilizing the building for construction, and legal waiver DPW Director Equitz explained Walworth County is seeking a waiver so the County and/or contractor will not be responsible for liability associated with any damage that may occur to the Cobblestone building during the construction project. Attorney Geary explained the document is a mutual covenant not to sue. If the building sustains damage or falls and it is not due to any negligent act, the parties are agreeing not to sue each other. He spoke with a representative from the Village’s insurance company to ensure signing the agreement would not negate insurance coverage. Based on that conversation it does not sound like this will be an issue. He asked the Board to approve the agreement subject to final review by attorneys. Motion by Trustee Johnson, second by Trustee Nugent, to approve the agreement subject to attorney’s final review. Motion carried.
