Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees John Alexander, Jim Holm, Fortune Renucci, Jason Smalley and Joe Wisnewski Excused: Mary Nugent Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Clerk Alexander, Attorney Geary (attended remotely) Citizen Participation None Miscellaneous Business 1. 2024 Budget a. Updates Since Last Budget Review b. Presentation Administrator Suhm provided the budget presentation as a summary and explanation of the 2024 Budget. c. Public Hearing on 2024 Budget President Johnson opened the public hearing at 6:56 pm. Mary Nicoson, 2916 North Street, asked for clarification of abated debt and why it was not used. It was explained that abated debt was not used so that the tax increase would be lower. The purpose of potentially using abated debt was to smooth the tax rate. She also asked how to obtain a copy of the audit report and when the Village is audited. It was explained that audit reports can be obtained from the Clerk’s office and that the auditors begin the audit process for the prior year in February and generally finish in April. The audit report for 2022 is available, however the audit for 2023 will not be completed until late spring 2024. The Village’s fiscal year is the calendar year. She also asked if the Village is under “home rule powers” and staff offered to provide additional information to her regarding this with specifics. President Johnson stated that the Village also had an improved credit rating this year from Moody’s and that the Board has been diligent with their self-imposed policy to not exceed 50% of the allowable debt limit. He emphasized the Village’s use of the 2023 state aids from Bill AB245 and that the Village was able to add the first new police officer in 30 years. He also reminded the public that the Village is a member of the East Troy Area Emergency Services District and while the Village does manage some of the District’s payroll and benefits for full-time staff that is billed to the District and those costs are shared among the several municipalities. Those costs are being driven by the need for Emergency Services staffing. The Village has been able to capitalize on good financial planning and some lucky timing. Consideration of Ordinance 2023-10 Appropriating Funds to Operate in 2024 and Adopting Levy Motion by Trustee Alexander, second by Trustee Smalley, to approve Ordinance 2023-10. Motion carried. Ordinances & Resolutions 1. Ordinance 2023-09 – Annexation Ordinance (from 11/6 meeting) Administrator Suhm explained that this decision was postponed for clarification of whether the annexation went to the centerline of the road and the intent was to go to the centerline of the road and this ordinance now includes the correct legal description and maps. Motion by Trustee Alexander, second by Trustee Smalley, to approve Ordinance 2023- 09. Motion carried. Closed session Motion by President Johnson, second by Trustee Smalley to adjourn to closed session pursuant to Wis. Stats. 19.85 Wis. Stats. 19.85(1)(e) deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting of other specified public business, whenever competitive or bargaining reasons require a closed session (TID 4 Development and 2954 Main Street) and Wis. Stats. 19.85(1)(g), conferring with legal counsel concerning strategy to be adopted with respect to litigation pertaining to the following: the Aqueous Film Forming Foams Product Liability Litigation, Multi-District Litigation No. 2:18-mn-2873 (3M and DuPont PFAS Litigation (Public Water Systems) Class Action Settlements). Motion carried on at roll call vote: President Johnson Y Trustee Alexander Y Trustee Holm Y Trustee Renucci Y Trustee Smalley Y Trustee Wisniewski Y Reconvene in Open Session Possible action on closed session matters Motion by Trustee Alexander, second by Trustee Smalley, to direct staff to prepare the documents to remain in the PFAS class action lawsuit. Motion carried. Motion by Trustee Alexander, second by Trustee Smalley, to approve the land conveyance agreement and authorize necessary officials to sign off on documents needed for the closing.
