EAST TROY VILLAGE BOARD MINUTES April 15, 2024 Page 1 of 4 Call Meeting to Order; Pledge of Allegiance Clerk Alexander verified the meeting was posted according to law. Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees John Alexander, Jim Holm, Mary Nugent, Fortune Renucci, Jason Smalley, and Joe Wisnewski Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Clerk Alexander Citizen Participation Marty Zess, representing 2839 Main St., spoke on the School Street assessment, suggested holding a Saturday meeting on site with residents to explain the project; spoke on the ordinance relating to assessing corner lots and double frontage lots, and lift station appearance. Consent Agenda 1. Approval of Minutes – 3/18/2024, 3/27/2024 2. Consider annual appointments (see attached packet materials) 3. Consider 2024 farm lease with Peter Wendt 84.1 village-owned acres located on the west side of Highway 120 (TID 4 property) 4. Consider application for Special Event and Temporary Class B license for Knights of Columbus Corn & Brat Roast, July 26-28. 5. Consider application for Temporary Class B license for East Troy Electric Railroad for 18 dates. 6. Consider appointments of additional Election Inspectors and Special Voting Deputies 7. Consider application for East Troy Lions Club 4 th of July Festival for Special Event and Parade permits and Temporary Class B License (5 Temporary operators) for June 28, 29 and 30, 2024. 8. Consider annual renewal of Snow Storage Agreement with Little Angels Daycare as recommended by DPE Equitz 9. Consider application for East Troy American Legion Baseball (5 dates) 10. Consider recommendation from Plan Commission to approve a three-lot certified survey map in ETZ located at N8356 Weber Lane subject to three conditions (addition of correction to Village President’s name) Motion by Trustee Alexander, second by Trustee Nugent, to approve the consent agenda. Trustee Smalley requested the 3/27/2024 minutes be approved separately. Motion carried. Motion by President Johnson, second by Trustee Alexander, to approve the minutes from 3/27/2024. Motion carried with Trustees Smalley and Holm abstaining because they were not in attendance. Miscellaneous Business 1. Consider approval of application for Combination Class B Beer/Liquor from Elevate 88, Inc, for Elevate 88, 2919 Main St., Chao Qun Riley, Agent, for period from 4/15/2024 to 6/30/2024 (pro-rated for balance of license year).  EAST TROY VILLAGE BOARD MINUTES April 15, 2024 Page 2 of 4 Motion by Trustee Alexander, second by Trustee Smalley, to approve the application for Elevate 88. Motion carried. 2. Review of special assessment report for School Street project and possible direction to staff Tim Lynch, Lynch & Associates, presented the Special Assessment Report for the School Street project with bid costs and assessments. DPW Equitz stated that there is the potential for change as they will be changing out sanitary sewer laterals if they are still clay. Curb and gutter, driveway, sidewalks will also be assessed. One address also included water service due to lead and copper sampling. Mr. Lynch explained that driveway approaches require repair due to addition of sidewalk, curb and gutter or changes in elevation or materials such as the requirement of concrete from sidewalk to curb. Discussion included increases due to inflation from the last street project, confirmation that the concrete is 4” thick for sidewalks and 6” thick across driveways. President Johnson discussed the assessment process in East Troy compared to some neighboring communities, the corner lot/double frontage issue, that these questions and concerns arise at each street project assessment, that the Village takes on the debt for these projects in full and the special assessment is a small part of the overall project, the time and work done by staff in relation to the special assessments, the question of benefit of the improvements to the individual resident or the community as a whole, if the benefit is to the entire community the cost should be shared with the entire community, laterals are considered individual and are expensive but the Village does offer a low interest loan for an extended period of time. He suggested considering amending or repealing the special assessment ordinance to address these points going forward, but not to change past work. Motion by Trustee Nugent, second by Trustee Alexander, to direct staff to review the current ordinance and draft an ordinance for review regarding special assessments. Motion carried. 3. Consider purchase/sale and renovation agreement for 2954 Main Street Motion by Trustee Alexander, second by Trustee Nugent, to approve the agreement for the purchase/sale and renovation of 2954 Main Street to Victor Stanford. Motion carried with Trustee Smalley abstaining. 4. Consider recommendation from Plan Commission to approve a one-lot certified survey map to merge 5 existing parcels located off Main Street at the intersection with School Street; Overlook Ridge Exchange LLC Motion by Trustee Smalley, second by Trustee Renucci, to approve the one-lot certified survey map to merge 5 existing parcels located off Main Street at the intersection with School. Motion carried. Ordinances & Resolutions 1. Ordinance 2024-04 - Recommendation from the Plan Commission for a Revision of the Village’s Comprehensive Plan  EAST TROY VILLAGE BOARD MINUTES April 15, 2024 Page 3 of 4 a. Public Hearing President Johnson opened the public hearing at 6:58 pm. Administrator Suhm explained that the Plan Commission adopts a Resolution on the matter, then it is required to be published twice at least a week prior to Village Board consideration. The Plan Commission recommended approval of the land use change in the Comprehensive Plan. If the Board approves the ordinance to amend the Comprehensive Plan, the property owner can then apply to change the zoning from Highway Business to Light Industrial. President Johnson closed the public hearing at 6:59 pm. b. Consideration of Ordinance 2024-04 Motion by Trustee Alexander, second by Trustee Smalley to approve Ordinance 2024-04. Motion carried. 2. Resolution 2024-06 – Approval of Urban Area Boundary recommended by WisDOT Administrator Suhm reviewed that urban area boundaries are done by the WI DOT after each census. She and DPW Equitz met with the DOT regarding this and there are no significant changes from the prior urban area boundary except they have broken off from the Mukwonago urban area boundary. The area is determined by several factors including population, traffic counts, and the agreement affect federal funding and roadways. Motion by Trustee Smalley, second by Trustee Alexander, to approve the Urban Area Boundary. Motion carried. Staff Reports 1. Fire Chief Report – 03/26/2024 – it was requested to share the Chief’s 5-year plan and it was explained that the 5-year plan is updated annually and included with the budget. 2. March Financial Reports a. Financial Summary b. Variance Report c. Capital vs Spent d. Airport Inquiry on the outstanding costs for the impoundment area. That is not a definite amount as the Village has held back some funds based on grass establishment. Once the season further along and this growth can be determined the project will be able to close and have final accounting. 3. Police Department 2024 1 st Quarter Report Committee Reports 1. East Troy Area Emergency Services District Minutes – 02/20/2024 – Trustee Smalley stated the District has purchased an electric vehicle fire blanket, the agreement has been signed including additional members per municipality and balanced vote distribution. 2. DRAFT Plan Commission Minutes – 4/8/2024 – President Johnson stated the Overlook Ridge project was approved and a traffic study was required. 3. Library Board Minutes – 03/12/2024 – Trustee Nugent stated that a new children’s librarian has been hired (Maria Hinners). Updates are being made to the basement area  EAST TROY VILLAGE BOARD MINUTES April 15, 2024 Page 4 of 4 to create “Nancy’s Corner” as a memorial to Nancy O’Connell, and experience passes are now available. President Johnson stated that the Tri-Troy meeting is next week, and he hopes to have the Fire Chief from East Troy and Troy attend. Administrator Suhm reported receiving three proposals from planners for review. Closed session Motion by President Johnson, second by Trustee Alexander, to adjourn to closed session pursuant to Wis. Stats. 19.85(1)(e) deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting of other specified public business, whenever competitive or bargaining reasons require a closed session (Potential Development access through Village-owned property; Offers to Purchase Property).
