EAST TROY VILLAGE BOARD MINUTES July 20, 2026 Page 1 of 4 Call Meeting to Order; Pledge of Allegiance Clerk Smith verified the meeting was posted according to law. Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees Adam Duda, Bryan Harding, Dan Moody, Mary Nugent, Scott Seager and Joe Wisniewski Excused: Others: Chief Swendrowski, Administrator Suhm, DPW Director Equitz, Clerk Smith Citizen Participation Maria Elena Bisabarros, who is running for Assembly District 33, introduced herself, gave her history and explained why she is running for office. Consent Agenda 1. Approval Minutes – 7/6/2026 2. Consider approval of Assignment of Hangar Area Lease Assignment for D-3 to Pinots Properties, LLC (David Iglewski and Michelle Iglewski) 3. Consider approval of Walworth County Occupancy Agreement for Phase 2 of Multi-use Trail Motion by Trustee Nugent, second by Trustee Seager, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Consider citizen input related to allowing ATV/UTV traffic on roads within Village jurisdiction a. Adjourn to Committee of the Whole Motion by President Johnson, second by Trustee Wisniewski to adjourn to the Committee of the Whole. Motion carried at 6:40 pm President Johnson noted that the last discussion on the topic at the board level was in 2022, and that recent requests from residents prompted the conversation. Chief Swendrowski said that the Village of East Troy is among only a few municipalities in Walworth County that do not allow ATV/UTV traffic. He said that of the municipalities who do allow it, there are some discrepancies in what is allowed based on the age of drivers, limits on which roads can be driven on, and different age requirements for licensed drivers and for passengers. He added that State highways do not permit that traffic at all. If permitting this type of traffic in the Village, the Village ordinance can be as restrictive as the board wants. Discussion took place for over an hour, with input from both residents and board members. President Johnson conducted a show-of-hands poll on permitting ATV/UTV traffic: about 12 attendees were in favor and four were opposed. Individuals who spoke included: Vickie McKone, 3019 Main St.; Vania Schneider, 2026 Division St.; Sam Bresler, 1865 Ridge Dr.; Jason Neider, 1955 Beulah Ave.; Jim Manser, N9008 EAST TROY VILLAGE BOARD MINUTES July 20, 2026 Page 2 of 4 Austin Rd., Town of East Troy; Rich Prosser, Town of Troy; Jeff Schwartz, 2913 North Shore Dr., Town of East Troy; Graeme Kent, 3029 Clayton Ave.; Joey Tess, 2026 Division St.; Key points in favor the ATV/UTV traffic included: • Benefits the Village economy and tourism; • Gives individuals and families something to do together in an economical way; • Provides fundraising opportunities for clubs and organizations; • UTVs have improved safety features; Key points against the ATV/UTV traffic included: • Safety, noise and speed discrepancies (both below and above the limits) • Policing the added traffic; • Possibility of distracted driving, impaired driving and reckless driving; b. Reconvene to regular session with possible direction to staff Motion by President Johnson, second by Trustee Seager, to adjourn the Committee of the Whole. Motion carried at 7:57 pm. The consensus of the board was to direct Chief Swendrowski to bring examples of other municipalities’ ordinances and language for a suggested Village ordinance to the September 21 Village Board meeting. 2. Update from Strand Associates on Well 10 Ben Wood, with Strand and Associates, provided an update to the board on the progress of the Village’s loan application process for Well 10. He explained that there are two different branches of the Wisconsin Department of Natural Resources (WDNR) including a technical branch that works on the water quality issues and PFAS regulations, and then there’s the funding branch. The issue is that the normal timeline for delivering a technical project doesn’t align with the financial portion. Additionally, any funding that the Village has received for PFAS settlements would offset the amount of grant funds in the final accounting. The loan closing documents have shifted the timeline for well drilling design, bidding and contract, and for loan closing and well testing. The Village will need to proceed with the final design of the well facility and treatment now to meet the funding requirement of executed construction contracts by May 31, 2027, in order to keep the treatment portion of the scope funding eligible. Design costs are eligible. The proposed facility would have both iron and/or radium treatment added if it is found to be required after the well testing is completed. Mr. Wood intends to bring a design contract proposal back to the board at its August 3 meeting. Mr. Equitz said that due to the timing, the Village could potentially receive additional grant money, and also due to the timing, the Village will have to take a unique approach to how the well moves forward as it relates to design and bidding. President Johnson suggested that if contracts are to go forward, the Village would want to add language that would recognize that certain parts of the facility may or may not need to be constructed, depending on what the well testing would reveal. Resolution to vacate a portion of the Oakmont Drive right-of-way, located within the Village, namely: That portion of the Oakmont Drive right-of-way shown on Subdivision Plat #51751, “Lake Bluff,” recorded in the Walworth County Register of Deeds Office on or about August 3, 2006, as Document No. 684187, in Volume D, Page 57, and being located between Lake Bluff Lots 42 and 43 (RLB 00043 and RLB 00042) and Parcel RXUP 00254. a. Public Hearing President Johnson opened the public hearing at 8:26 pm President Johnson said that at its meeting on July 13, the Plan Commission had recommended that the board deny the resolution. John Donovan, Director of Acquisitions with Bielinski Homes Inc., was present to explain why the developer wanted to vacate the road right- of-way for Oakmont Drive in the Lake Bluff Subdivision. He said that in May, he had come before the Village Board to discuss the road vacation and begin the process. He said that buyers have come forward who want to purchase the two lots. However, if the road is built, the setbacks on these corner lots would be 25 feet, versus the standard lots at 15 feet. Since the land isn’t being used by the Village, he said they would look at vacating it so that the right-of- way footage could be added to the lots. Then, the lots would look like the rest of the streets with the homes in the middle of the lots. He added that other reasons for vacating roads in subdivisions include safety, such as the proximity of the private road, within 200 feet, to Carriage Drive at St. Peter’s Road. Additionally, there is a private entity who owns the land directly to the east between the private road in the Town of East Troy and the subdivision. He had suggested to the Plan Commission that they table their decision until Mr. Equitz and the Village engineer could be present for the discussion, but the commissioners voted to recommend denial 4-to-1. He would like the Village Board to approve the vacation of Oakmont Drive from Carriage Drive to the end of the road right of way. DPW Director Equitz said that staff had considered the value of the road right-of-way vacation. Even if the road could be put in, which it currently can’t, it is going out onto a dead- end road. He explained he does not see the value of a future connection like this as Seminary Road is a private road in the Town of East Troy. Tim Lynch, of Lynch and Associates, spoke on the proposal, noting that from an engineering and planning standpoint, there is no issue with this vacation. Residential input included discussion by: • Dennis Kasian, 2819 Oakmont Dr., who had submitted both a poll and a petition to the board. He said he used to be a developer and understands the discussion. There are two items that no one can dispute: Seminary Road is private and the land to the north and the strip of private land was in existence at the time of the subdivision plan in 2006 and that another way out of the subdivision was promised to the homeowners. He read the results of the social media poll that had been sent out to homeowners and of a petition hand-delivered to the majority of the residents. He said of the 85 occupied homes, 58-percent of those who were able to be contacted oppose the elimination of Oakmont Drive. He also noted that the utility lines would have to zigzag to any new development instead of going out directly to the new development. DPW Director Equitz clarified that no utilities are located in the Oakmont Drive stub, as there are mains going up Carriage Dr. and off St. Peters Rd. that would feed a new subdivision. EAST TROY VILLAGE BOARD MINUTES July 20, 2026 Page 4 of 4 • Jane Haefner, 2697 Red Oak Ln., said there will be a total of 148 lots in all three phases of the subdivision. She thinks future development should allow for traffic to go out Oakmont Drive. She is concerned with traffic on the roads going in and out now. Trustee Nugent said there was once a public road parallel to Seminary Road. Jeff Grafenauer, N8594 Wilmers Landing, said that the strip of land used to be part of his farm and it did originally go all the way back and was used when Seminary Road was closed once a year so it could remain a private road. Trustee Wisniewski asked Mr. Donovan if the two properties by the road right-of-way would gain property. He replied that yes, State Statute requires that a road vacation be apportioned to the parcels. President Johnson said he still does not see having a second road so close to Carriage Drive, and that the Village will have to balance what is happening now versus down the road. Trustee Moody said he agrees with the Village engineer, and Trustees Harding and Wisniewski both agree that Oakmont Drive should remain in case the property to the East is developed. President Johnson closed the public hearing at 9:07 pm. b. Consider recommendation from Plan Commission to deny Resolution 2026-11 Motion by Trustee Harding, second by Trustee Wisniewski, to approve the Plan Commission recommendation to deny Resolution 2026-11.
