PUBLIC HEARING: APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)- NEIGHBORHOOD REVITALIZATION Mr. Josh Outlaw with The Adams Company will join the Zoom Meeting and present applicable information for the CDBG-NR Application. The proposed project will include housing acquisition, clearance, reconstruction, rehabilitation, community park improvements, and general administration. CDBG activities are proposed scattered throughout the Town. The total estimated CDBG program cost is $750,000.00 which represents 100% of the total program costs. This is the second of two-required public hearings (ATTACH. #lA). Mr. Outlaw has provided a Cost Estimate Summary that will be included in the CDBG-NR application (ATTACH. #18). Council is requested to follow the below Public Hearing Procedure: HEARING PROCEDURE: a) Open the hearing and call upon Mr. Josh Outlaw of The Adams Company to present the information; b) Solicit for any written comments received from the public since this is a Virtual Meeting; and c) Close the hearing. (Approval for this agenda item will take place with Agenda Item #2A). Please note with this being a virtual meeting, if written comments are received for the Public Hearing, the meeting will need to be RECESSED in order to comply with the 24-hour requirement. 2. RESOLUTIONS AND CITIZEN PARTICIPATION PLAN A) - Resolution #2020-18 - To Authorize Submission of a Formal CDBG-NR Application (ATTACH. #2A). B)- Citizen Participation Plan - Mr. Josh Outlaw of The Adams Company will present this information for the CDBG-NR Application (ATTACH. #2B). REQUEST: Council is reguested to a prove the Citizen Participation Plan.  C) - Resolution #2020-19 for LGFCU Financial Partners, LLC- As part of the approved loan process for the Elizabethtown Fire Department, the Civic Federal Credit Union, representing LGFCU Financial Partners, LLC, is requesting a Resolution for the purchase of firefighting and rescue equipment (ATTACH. #2C). The $160,000 loan was approved by Town Council on 8/3/2020. REQUEST: Council is requested to a prove the Resolution. D) - Resolution #2020-20- Hazard Mitigation Plan Update- Town Manager Eddie Madden will present this Resolution (ATTACH. #2D). This request was received from Bladen County Emergency Services Director Nathan Dowless. REQUEST: Council is re uested to approve the Resolution. 3. The Zoom Meeting information is included as the last page of this agenda material.  UNOFFICIAL TOWN OF ELIZABETHTOWN Regular Meeting - Virtual August 3, 2020 The Elizabethtown Town Council met for its regular scheduled meeting on Monday, August 3, 2020 at 7:00 p.m. via Zoom. Those present were Mayor Sylvia Campbell, Mayor Pro Tern Rufus Lloyd, Council Members Herman Lewis, Howell Clark Jr., Paula Greene, Ricky Leinwand, Rich Glenn, Town Manager Eddie Madden and Town Attorney Goldston Womble. Department Heads joining the zoom meeting included Fire Chief Nick West, Police Chief Tony Parrish, Planner I Woody Horton, Public Services Director Hugh Bledsoe, Town Clerk Juanita Hester, Cameron West, Code Enforcement, Meredith Merritt, Accountant, Director of Communications & Marketing Terri Dennison and Finance Director Sharon Penny. Representatives from the Press joining via zoom included Emily Williams and Charlotte Smith. Mayor Sylvia Campbell opened the meeting and welcomed everyone, then gave the invocation. Mayor Campbell then made a roll call. A motion was made by Council Member Herman Lewis, seconded by C01mcil Member Howell Clark Jr., to approve the Agenda as presented (Unanimous). Item #2.1: Approval of Previous Minutes Council Member Howell Clark Jr., seconded by Council Member Herman Lewis, made a motion to approve June I, 2020 Corrected Virtual Minutes and July 13, 2020 - Virtual Minutes (Unanimous). Item #3.1: Monthly Project Updates ··---·· ·-. · · --· ______ ·- ____ Town Manager Eddie Madden noted that the Cemetery Project continues to make progress, and it will go out for bidding in September. Fire Department received information from Golden Leaf. Item #3 .2: Rebuild NC Strategic Buyout Program Nathan Dowless, Bladen County Emergency Management Director provided staff with information regarding the Rebuild NC Buyout Program. The purpose of the program is to assist homeowners that have been affected by flooding from hurricanes. The program provides mitigation funding to assist homeowners with relocation and replacement cost. Rebuild NC will purchase property at value, if homeowners remain in the County, the program will offer up to $60,000.00. The program opened in June and 1,700 applicants have applied. Council Member Rich Glenn, seconded by Council Member Ricky Leinwand, moved to approve the Rebuild NC Strategic Buyout Program (Unanimous). Copy attached and incorporated herein by reference. MEETING MINUTES  Item #4.1: Public Hearing Application for Community Development Block Grant (CDBG) Neighborhood Revitalization Mayor Sylvia Campbell opened the Public Hearing and called upon Town Manager Eddie Madden to present. Town Manager noted this is the first of two Public Hearings required. The Town of Elizabethtown is working with Mr. Josh Outlaw from The Adams Company, Warsaw, NC to solicit public input on community revitalization and needs and to make application on behalf of the Town. The CDBG-NR program ($750,000) is for low-and-moderate income persons, blighted properties, and owner-occupied homes. Mayor Campbell called upon Mr. Outlaw to present some of the details. The proposed project will include housing acquisition, clearance, reconstruction, rehabilitation, community park improvements (to include the Town's Martin Luther King Jr. Park) and general administration. Mr. Outlaw indicated that he has been provided a list of candidates that he will visit to detennine eligibility. The plan is to limit the revitalization work to 3 or 4 homes. There was a question as to the Paul R. Brown building being eligible for the program, and it was detennined that it would not qualify for the CDBG-NR program because the building is not owned by the Town of Elizabethtown. Town Manager Eddie Madden reported there were no written comments received for this first virtual public hearing. Mayor Sylvia Campbell then closed the Public Hearing. The second required Public Hearing will be conducted at a Special Called Town Council Meeting (Virtual) on August 18, 2020 at 7 p.m. Item #5.1: Loan approval process for firefighting and rescue equipment - Civic Federal Credit Union Loan Fire Chief Nick West noted that 14 years ago, the Fire Department got a 10-year loan when they went to the Viper Radio System. The radios and pagers have reached the end of service life by Motorola. The loan will include radios, pagers, rescue airbags, protective equipment, washer & dryer. The air bags will not have to be replaced for another 15-years. The County Fire District Board will contribute $30,000 and the remaining $4,000 will come out of the Fire Department _____ _ budget over five years. Council Member Howell Clark Jr., seconded by Council Member Paula __ Greene, moved to approve Civic Federal Credit Union Loan (Unanimous). Copy attached and incorporated herein by reference. Item #5.2: Bid award for construction of sidewalks, parking areas, and mulched trails at Greene's Lake and Conservation Park Town Manager Eddie Madden noted that staff solicited bids from three contractors for work at Greene's Lake and Conservation Park. Two of the three contractors submitted proposals. The project is funded by a grant from the NC Parks and Recreation Trust Fund. S & C submitted a proposal of $244,825 and Smith Brothers $168,850. It is recommended to award the construction bid to Smith Brothers Construction in the amount of $168,850. Council Member Howell Clark Jr., seconded by Council Member Rich Glenn, moved to approve the Bid award to Smith Brothers Construction (Unanimous). Copy attached and incorporated herein by reference.  Item #5.3: Bid award for Playground at Greene's Lake and Conservation Park Town Manager Eddie Madden stated the Town received a bid from Cunningham Recreation in the amount of $165,872.80 but got the cost down to $149,695. The project is funded by a grant from NC Parks and Recreation Trust Fund. The playground equipment includes balance logs, rock climber, log steppers, climbing rocks, walk thrn log, benches, and nature themed play structure. After some discussion, Council Member Howell Clark Jr., seconded by Council Member Herman Lewis, moved to authorize Town Manager Eddie Madden and Sage Design, Sara Burroughs to negotiate the playground equipment (Unanimous). Item # 5.4: Unpaid Fiscal Years' Tax Collection Report and Order Council Member Rich Glenn, seconded by Council Member Howell Clark Jr., moved to approve Unpaid Fiscal Years' Tax Collection and Order (Unanimous). Item #5.5: "Pork and Beats" Festival - November 6 and 7, 2020 Council Member Herman Lewis, seconded by Council Member Paula Greene, moved to cancel the 2020 "Pork and Beats" Festival (Unanimous). Item #5.6: Set September Council Meeting Date There was Council consensus to set the September Town Council Meeting date to September 14th since Labor Day Holiday falls on regular meeting date. Item #5.7: Monthly Financial Report Meredith Merritt, Accountant, noted that it is the first month of the new year and tax bills went out. The Town is working with Bladen County Finance Director Lisa Coleman with ft.mds that have been allocated to the Town for COVID-19. The Town received $126,545 for expenses incurred thru December 31, 2020. In July, the Town paid annual expenses for insurance, worker's comp, and software. Revenue is low and the annual expenses incurred a loss. Council Member Howell Clark Jr. seconded by Council Member Rich Glenn moved to approve the .. Monthly Financial Report (Unanimous). Mayor, Council Member Ricky Leinwand and Howell Clark Jr. will assist with the Black & Brown Business Expo. Council Member Ricky Leinwand noted that it will be a positive experience, and he appreciated it. August 11, 2020 Zoom Chamber of Commerce Meeting at 1 :00 pm.  County received a grant for protective equipment, Town received $123,000 for safety equipment and sanitizer. Do not take storm lightly. There is a State of Emergency with curfew effective from 11:00 pm on 8/3/2020 until 6:00 am on 8/4/2020. Town office will open at 10:00 am, August 4, 2020. The funds must be used for projects which benefit low and moderate-income persons and aids in the elimination and prevention of slums and blight. The program is intended to assist governments in understanding neighborhood improvement programs. The regulations give ultimate responsibility for the design and implementation of the program to local elected officials and require that citizens be given an opportunity to serve in a key advisory role to these elected officials. SCOPE OF CITIZEN PARTICIPATION Citizens will be involved in all stages of the CDBG program, including program implementation, assessment of performance and design of changes in the Citizen Participation Plan. There will be three (3) general mechanisms for their involvement: 1 . To serve as an advisory committee to the project; 2. To attend or hold public hearings or community meetings; and 3 . To provide individual citizen efforts in the form of comments, complaints or inquiries submitted directly to the Program Administrators or designated Town official. PROGRAM IMPLEMENTATION Citizen participation in program implementation will occur primarily through consultation with the Town. The Town will be asked to review and comment on specific guidelines for approved projects. They will also meet to review any program amendments, budget revisions and program _ ___modifications,-AlLsuch..changes-wilLbe discussed-:with-the-'I'own andtheir-comments-considenid- - - prior to taking action. If program amendments require approval from the North Carolina Department of Commerce, a public hearing shall be held specifically on the amendment. Citizens may also be involved in implementation of projects specifically requiring citizen participation, such as self-help projects. Their roles will be defined as the project develops. Technical assistance will be available as needed. PROGRAM ASSESSMENT As part of the orientation to the program offered at the public hearing, citizens will be invited to submit comments on all aspects of program performance through the program year. Comments should be submitted in writing to the Town Clerk. He or she will respond in writing within ten (I 0) days. If the response is unsatisfactory, the complainant should write directly to the Mayor. He or she shall respond within ten (10) days. ATTACH. #2B If the citizen is still dissatisfied, he/she should write to the N.C. Department of Commerce, Rural Economic Development Division/State CDBG Program, 4346 Mail Service Center, Raleigh, NC 27699-4346, Attention: Citizen Participation Matter. Program staff will also be available during normal business hours to respond to any citizen inquiries or complaints at 919-814-4663. VIRTUAL HEARINGS During a declaration of a state of emergency by the Governor or General Assembly, and if a local unit of general government is concerned about significant public health risks that may result from holding an in-person public hearing, the local tmit of general government may undertake a virtual public hearing (alone, or in concert with an in-person hearing) if: • It allows questions in real time, with answers coming directly from the elected representatives to all "attendees." Therefore, members of the public must be entitled to participate and address the governing body during any telephonic or video-conference meeting. • The governing body must post a written notice that gives the public a way to participate remotely, such as a toll-free dial-in number, and that includes an electronic copy of any agenda packet that officials will consider at the meeting. • As with an in-person hearing, the grantee must select a virtual hearing method or platform that provides accessibility for persons with disabilities and limited English proficiency (LEP) to the greatest extent possible. These accommodations must be free to these populations. • A governing body must provide the public with access to a recording of any telephonic or videoconference meeting. • The local unit of government must document its efforts and the reason for them. • Additional specific communication requirements and requirements for conducting remote meetings can be fotmd in Article I A of Chapter 166A and Article 33C of Chapter 143 of the General Statutes. TECHNICAL ASSISTANCE Technical Assistance will be provided to citizen organizations and groups oflow/moderate income persons or target area residents upon request to the Town of Elizabethtown. Such assistance will support citizen efforts to develop proposals, define policy and organize for the implementation of the program. It is expected that such assistance will be provided directly to the Town in response to their request. Assistance could be provided in the form of local presentations, informational handouts, research of a specific issue, or other short-term efforts. PUBLIC INFORMATION The Town of Elizabethtown will also undertake public information efforts to promote citizen participation. These efforts will include the following:  1. Public Notice of all Public Hearings will be published in the non-legal section of the local newspaper at least ten (10) days before the scheduled hearing. These notices will indicate the date, time, location and topics to be considered. 2. Orientation Information will be provided at the first public hearing. The Program Administrator(s) will make a presentation which covers: (a) the total amount of CDBG funds available and the competitive basis for award; (b) the range of eligible activities; (c) the planning process and the schedule of meetings and hearings; (d) the role of citizens in the program and (e) a summary of other program requirements, such as the environmental policies, fair housing provisions and contracting procedures. 3. A Public File containing program documentation will be available for review at the Town Hall during normal business hours. Included will be copies of the Application, Environmental Review Record, the Citizen Participation Plan and the Annual Performance Report. Other program documents are also available for citizen review on request at the Town Hall consistent with applicable State and local laws regarding personal privacy and obligations of confidentiality. 4. The related taxes, freight, installation and training fees for the equipment purchases will not be financed and, therefore, the Town will be responsible for those related costs. Sylvia Campbell, Mayor ATTEST: Juanita Hester, Town Clerk ATTACH. #2C  RESOLUTION OF ADOPTION TOWN OF ELIZABETHTOWN, NC HAZARD MITIGATION PLAN #R-2020-20 WHEREAS, the citizens and property within the Town of Elizabethtown, Bladen County, North Carolina are subject to the effects of natural hazards that pose threats to lives and cause damage to property; and WHEREAS, the Town desires to seek ways to mitigate the impact of identified hazard risks; and WHEREAS, the Legislature of the State of North Carolina has in Part 6, Article 21 of Chapter 143; Parts 3, 5, and 8 of Article 19 of Chapter 160A; and Article 8 of Chapter 160A of the North Carolina General Statutes, delegated to local governmental units the responsibility to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry; and WHEREAS, the Legislature of the State of North Carolina has in Section 1 Part 166A of the North Carolina General Statutes (adopted in Session Law 2001-214 --- Senate Bill 300 effective July 1, 2001), states therein in Item (a)(2) "For a state of disaster proclaimed pursuant to G.S. 166A-6(a) after August 1, 2002, the eligible entity shall have a hazard mitigation plan approved pursuant to the Stafford Act"; and WHEREAS, Section 322 of the Federal Disaster Mitigation Act of 2000 states that local governments must develop an All-Hazards Mitigation Plan in order to be eligible to receive future Hazard Mitigation Grant Program Funds and other disaster-related assistance funding and that said Plan must be updated and adopted within a five year cycle; and WHEREAS, the Town of Elizabethtown, Bladen County, NC has performed a comprehensive review and evaluation of each section of the previously approved Hazard Mitigation Plan and has updated the said plan as required under regulations at 44 CFR Part 201 and according to guidance issued by the Federal Emergency Management Agency and the North Carolina Division of Emergency Management. WHEREAS, it is the intent of the Town Council of the Town of Elizabethtown, NC to fulfill this obligation in order that the Town will be eligible for federal and state assistance in the event that a state of disaster is declared for a hazard event affecting the Town; NOW, therefore, be it resolved that the Town Council of the Town of Elizabethtown, NC hereby: 1. Adopts the Bladen, Columbus, Robeson Regional Hazard Mitigation Plan; and ATTACH. #2D  2. Vests Emergency Services Director Nathan Dowless with the responsibility, authority, and the means to: (a) Inform all concerned parties of this action. (b) Cooperate with Federal, State and local agencies and private firms which undertake to study, survey, map and identify floodplain areas, and cooperate with neighboring communities with respect to management of adjoining floodplain areas in order to prevent exacerbation of existing hazard impacts. 3. Appoints the Emergency Services Director Nathan Dowless to assure that the Hazard Mitigation Plan is reviewed annually and every five years as specified in the Plan to assure that the Plan is in compliance with all State and Federal regulations and that any needed revisions or amendments to the Plan are developed and presented to the Town of Elizabethtown Town Council for consideration. 4. Agrees to take such other official action as may be reasonably necessary to carry out the objectives of the Hazard Mitigation Plan. Adopted on this day, August 18, 2020.
