The meeting was held in the council chambers, 1751 College Ave., Elko. This meeting was called to order by Mayor Reece Keener. CALL TO ORDER The Agenda for this meeting of the City of Elko City Council has been properly posted for this date and time in accordance with NRS requirements. II ROLL CALL . ACTION WILL NOT BE TAKEN There were no public comments. V. APPROVAL OF MINUTES A. August 8, 2023 Regular Session The minutes were approved by general consent. VIII. PERSONNEL A. Employee Introductions: 1.) Melissa Spring, Records Technician I, Police Department 2.) Kinzie Compston, Administrative Assistant, Fire Department Both new employees were present and introduced. VI. PRESENTATION A. Reading of a proclamation by the Mayor in recognition of Suicide Prevention Month September 2023, and matters related thereto. INFORMATION ONLY - NON ACTION ITEM Mayor Keener read the proclamation. Lynette Vega,President Zero Suicides Elko County, stated she has been doing this for 15 years but only 3 years with Zero Suicide Elko County. She thanked the Mayor for the proclamation and for the support. Since january, we have lost 11 lives in Elko County. We will be having Safe Talk classes available in Elko soon. She invited everyone to their walk next month (flyer attached to packet) September 9th. She thanked EFCU for all their sponsoring and help. B. Reading of a proclamation by the Mayor in recognition and appreciation of former Planning Commissioner Douglas Owen, and matters related thereto. INFORMATION ONLY - NON ACTION ITEM Mayor Keener stated he had the pleasure of serving on the Planning Commission with Doug Owen for many years. He was saddened when he saw Doug's passing earlier this year. He read the proclamation and gave a copy of it to Mrs. Carolyn Owen. Carolyn Owen said she was speaking to a family member and it was said that Doug was a quiet accomplisher. He did so many things that nobody knew about. August 22, 2023 City Council | Minutes Page 2 of 10  C. Update on Elko Inn located at 837 Idaho Street, concerning recent complaints, and matters related thereto. INFORMATION ONLY-NON ACTION ITEM Beginning in June of 2022, the City of Elko has received and investigated many complaints from neighboring residents and businesses, as well as law enforcement regarding the Elko Inn at 837 Idaho Street. City Staff has conducted numerous inspections of the property and notified the property owner of numerous code violations. As a result, several code violations have been addressed over an extended period of time. Staff provided its last update to the Council on August 8, 2023. In conformance with Title 5 Chapter 1, the City has completed its investigation of the property located at 837 Idaho Street for a possible public nuisance. As a result of the investigation, and in conformance with Title 5 Chapter 1, the City Manager has determined that a public nuisance exists at 837 Idaho Street and the owner has been properly noticed by the City’s legal counsel to abate the nuisance. In conformance with Title 5 Chapter 1, the property owner, Ville 837 LLC has requested, in writing, a hearing, before the City Council, to determine if in fact a nuisance does exist. KG Kurstin Greenlund, Enforcement Officer, explained the owner requested a hearing and the hearing is set for August 29th at 4:00 p.m. VII. CONSENT AGENDA A. Review, consideration, and possible approval of revisions to “Chapter 1 General Provisions” section of the City of Elko Human Resources Personnel Policy Manual, and matters related thereto. FOR POSSIBLE ACTION POOL/PACT released updated sample policies in July 2023, with minor updates from what was recently approved by Council in May 2023 for Chapter 1. Revisions to “Chapter 1 General Provisions” are included in the agenda packet, with any significant changes highlighted for reference. SS B. Review, consideration, and possible approval of revisions to “Chapter 2 Employee Relations” section of the City of Elko Human Resources Personnel Policy Manual, and matters related thereto. FOR POSSIBLE ACTION POOL/PACT released updated sample policies in July 2023, with minor updates from what was approved by Council in May 2023 for Chapter 2. Revisions to “Chapter 2 Employee Relations” are included in the agenda packet, with any significant changes highlighted for reference. SS ** A motion was made by Council Member Stone, seconded by Council Member Puccinelli to approve the consent agenda as written. The motion passed unanimously. (4-0) IX. APPROPRIATION August 22, 2023 City Council | Minutes Page 3 of 10  A. Review and possible approval and / or ratification of warrants, and matters related thereto. FOR POSSIBLE ACTION ** A motion was made by Council Member Puccinelli, seconded by Council Member Morris to approve the regular warrants FY23, in the amount of $198,580.48. The motion passed unanimously. (4-0) ** A motion was made by Council Member Puccinelli, seconded by Council Member Morris to approve the regular warrants FY24 in the amount of $499,417.58. The motion passed unanimously. (4-0) ** A motion was made by Council Member Puccinelli, seconded by Council Member Morris to approve the hand-cut checks FY24 $114,830.44. The motion passed unanimously. (4-0) ** A motion was made by Council Member Puccinelli, seconded by Council Member Morris to approve the utility refunds, in the amount of $338.41. The motion passed unanimously. (4-0) B. Review and Possible approval of Alliance Document Technologies Warrant, and matters related thereto. FOR POSSIBLE ACTION ** A motion was made by Council Member Puccinelli, seconded by Council Member Morris to approve the Alliance Document Technologies warrant in the amount of $686. The motion passed. (3-0 Mayor Keener abstained.) C. Review, consideration, and possible award of the bid for the Cattle Drive Waterline Extension, and matters related thereto. FOR POSSIBLE ACTION Council directed Staff to solicit bids for the Cattle Drive Waterline Extension on June 13, 2023. Bids were received on August 8, 2023 and opened at 1:00 pm. Great Basin Engineering provided the lowest responsive bid of the five bids received in the amount of $3,187,756.40. DJ Dale Johnson, Utilities Director, explained we got the bids back and recommend awarding to Great Basin Engineering. Mayor Keener asked if he was surprised with the number of bids. August 22, 2023 City Council | Minutes Page 4 of 10  Mr. Johnson answered there were quite a few contractors at the pre-bid meetings. Jan Baum, City Manager, reminded everyone this is one of our ARPA projects. ** A motion was made by Council Member Stone, seconded by Council Member Puccinelli to award a bid for the Cattle Drive Waterline Extension, in the amount of $3,187,7456.40 to Great Basin Engineering. The motion passed unanimously. (4-0) X. NEW BUSINESS A. Review and possible approval of an agreement with Elko County for the traffic signal maintenance at the intersection of State Route 227 and 228 in Spring Creek for an annual reimbursement to the City of Elko of $5,000 not to exceed $10,000 per year effective July 1, 2023, and matters thereto. FOR POSSIBLE ACTION Members of the City of Elko Facilities team currently assist Elko County with maintenance of the traffic signal at the intersection of State Route 227 and 228 in Spring Creek. The County has 2 traffic lights; one in Jackpot, and one in Spring Creek. The City of Elko's Facility Team are trained in traffic light maintenance and work with traffic lights on a regular basis. This agreement formalizes the current process of assisting Elko County with maintenance of the Spring Creek traffic light. JB Justin Alanis, Facilities Supervisor, explained we have been assisting the County for many years with this traffic signal. The County only has 2 signals they take care of. This is a good gesture to the County. They have the same detection and cabinets we have. NDOT doesn't work on any signals in the State. They have similar agreements with Counties or Cities for signals. We are not taking this totally over; this is a sub agreement to help them out with this signal. Mayor Keener said he was concerned with safety. Mr. Alanis noted in the agreement, the County is to assist us with traffic control. We also have to notify NDOT when we work on the signals. ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve the agreement with Elko County for the traffic signal maintenance at the intersection of State Route 227 and 228 in Spring Creek for an annual reimbursement to the City of Elko of $5,000, not to exceed $10,000 per year, effective July 1, 2023. The motion passed unanimously. (4-0) XII. REPORTS A. Mayor and City Council August 22, 2023 City Council | Minutes Page 5 of 10  Mayor Keener reported on the Nevada League of Cities in Las Vegas. They had a number of different workshops, from homelessness to strategic planning. We will have a special meeting a week from today, for the Liquor License hearing for the Punchbowl and then the nuisance hearing for Elko Inn. Councilman Stone reported on PopCon at the ECVA last weekend. There were great things happening there. People from all over the nation were present. It is already scheduled for next year. Mayor Keener mentioned with school starting, traffic will get crazy again. Everyone should leave a few minutes earlier than normal. B. City Manager Jan Baum gave a shout out to the Mayor who was voted as the Public Official of the Year at the Nevada League of Cities. A trophy was placed in chambers. Mayor Keener said he had no idea he was going to be receiving that award. Ms. Baum said there is a special meeting a week from today. That agenda will be posted Thursday morning. There was some talk about the Safe Talk training. She attended the training. She felt it was good training and she learned some important things. She hopes to provide that training to City of Elko employees. Mayor Keener spoke about an associate that took his own life. He talked to Bill Coffee from the National Service Line Insurance Program. Ms. Baum stated she will have a meeting with Bill later this week. If we decide to move forward, we will bring this back to Council with more information. C. Assistant City Manager Absent. D. Utilities Director Dale Johnson reported on the Hospital 2nd Source Project and other projects. They made a repair on Lamoille Highway where the pavement caved in. The pipe was repaired but it was in poor shape. This morning there was a 6-inch water main hit by a contractor for SCI. That has been taken care of and put back together. Jan Baum mentioned the collapse of Lamoille Highway was a good partnership between NDOT and the City of Elko. Mayor Keener asked the status with Anthem and the claim. Ms. Baum answered the 30 days is not up yet but it will be on the next agenda. August 22, 2023 City Council | Minutes Page 6 of 10  E. Public Works Director Mayor Keener mentioned an email from a resident on West Ash Street that didn't feel a micro slurry patch was going to be good enough. He drove there after the crews were done and it looks like a brand new road. The micro slurry is really helping us keep the roads looking good. F. Airport Manager Jim Foster reported staff has been doing patrols every 2 hours to keep birds away from the airport. G. City Attorney Absent. H. Fire Chief Chief Johnston said they will be short one staff soon. Promotions are set at the end of the month. The Fire Picnic will be on Friday the 13th at the Fire Station. We had a structure fire this morning that went well. I. Police Chief Chief Trouten apologized for arriving late. He asked who would be running in the T-Rex races next week. Councilman Morris answered he is running in the race. Mayor Keener mentioned the biker rally in Jackpot. Chief Trouten said it was uneventful and it worked well. That same weekend there were some bomb call-outs too. Mayor Keener asked about the law enforcement presence at the biker rally in Jackpot. Chief Trouten answered is was not a large presence. We were there just in the event of an emergency. J. City Clerk No report. K. City Planner No report. L. Development Manager August 22, 2023 City Council | Minutes Page 7 of 10  M. Financial Services Director Mayor Keener said he reads the reports Candi Quilici sends out every month on Sales Tax. He has noticed a trend and he is hoping things will improve. N. Parks and Recreation Director James Wiley reported last week we had a Golf Course Advisory Meeting. We went over fees but it is early in the year still. We do not have a lot of information from the Restaurant yet. At the end of the season we will look at priorities and rates. There will be some minor adjustments at the pool. Because of school starting, we will lose a fair amount of our lifeguards during school. This is the time of year we start to get caught up on weeds. Soccer and Football is around the corner and will be starting up soon. O. Civil Engineer Bob Thibault reported road construction will be starting on Ruby Vista Drive. He asked that drivers slow down. P. Building Official Mayor Keener asked about a drainage permit for Apartments on Sage. Have you seen any plans yet? Jeff Ford answered no, he has not seen any plans yet. The VA Clinic will be 5300 sq. ft. Komatsu is moving along. Harbor Freight is open now. We have plans in for a new Dollar store next to Harbor Freight. The Temple has been going along well. Q. Animal Shelter Manager Mayor Keener asked Alyssa about the Animal Shelter. Alyssa Magnum answered we will have the final reading of our ordinance tonight and, other than that, things are looking up. After the reports and before the break, Lee Hoffman, 1085 Barrington, asked what happened to the electric scooters. Cathy Laughlin answered Byrd Scooters did an analysis after one year in our community. Scooters were being left out and they were being damaged. They let Cathy know they were pulling out of the community. She hoped they come back. Mr. Hoffman asked if it is appropriate to call the contractor that did the patch or public works when patches get peeled up or damaged. Mayor Keener thought he should contact Public Works. August 22, 2023 City Council | Minutes Page 8 of 10  Jan Baum answered he could contact Scott Wilkinson because he is keeping a list of places that needs repaired. BREAK XI. 5:30 P.M. PUBLIC HEARING A. Second reading, public hearing, and possible adoption of Ordinance No. 883, an ordinance amending Title 5 Chapter 3: "Animals and Fowl", and matters related thereto. FOR POSSIBLE ACTION Council initiated Ordinance No. 883 on April 25, 2023. Ordinance No. 883 includes changes that amend the definitions, changes the length of stay for impounded animals, as well as makes other necessary revisions. First reading was repeated and approved on August 8, 2023, again due to a substantial change being made in the ordinance on page 16 section 5-3-14-G changing the "shall" to "may" regarding court orders on dangerous or vicious animals. There have been no other changes or comments. KW Kelly Wooldridge, City Clerk, explained she has not had any comments on this. The only question she has had is when this will be effective. It will be effective upon publishing in the paper. It will be published on Saturday. Mayor Keener said he got a call resident that has three hens and wanted to make sure this does not affect her chickens. Ms. Wooldridge answered it will not affect her chickens. Mayor Keener called for public comments without a response. ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve second reading, public hearing and adopt Ordinance No. 883.
