CITY OF ELKO PLANNING COMMISSION REGULAR MEETING MINUTES 5:30 PM, TUESDAY, OCTOBER 3, 2023 ELKO CITY HALL, COUNCIL CHAMBERS 1751 COLLEGE AVENUE, ELKO, NV 89801 I. CALL TO ORDER Jeff Dalling, Chairman of the City of Elko Planning Commission, called the meeting to order at 5:30 p.m. II. ROLL CALL Present: Jeff Dalling Stefan Beck Garret Kamps Mercedes Mendive Michael Irish Tony Odeh Absent: John Lemich City Staff Present: Jan Baum, City Manager Cathy Laughlin, Assistant City Manager Ralph Negron, Development Manager Bob Thibault, Civil Engineer Jamie Winrod, Fire Marshal Rachel Randall, Planning Technician III. PLEDGE OF ALLEGIANCE IV. COMMENTS BY THE GENERAL PUBLIC There were no public comments at this time. V. APPROVAL OF MINUTES A. September 5, 2023 - Regular Meeting - FOR POSSIBLE ACTION ** A motion was made by Vice-Chairman Beck, seconded by Commissioner Mendive to approve the minutes of the September 5, 2023 regular meeting. The motion passed unanimously. (6-0) October 3, 2023 City of Elko Planning Commission Meeting Minutes Page 1 of 4 VI. NEW BUSINESS A. PUBLIC HEARING 1. Review, consideration and possible recommendation to City Council for Rezone 4-23, filed by the City of Elko, for a change in zoning from GI (General Industrial) and C (General Commercial) to LI (Light Industrial) Zoning District, approximately 12.379 acres, specifically APN 001-630-103, located generally at the terminus of Silver Street approximately three hundred ninety feet northeast of the intersection of Walters Court and Silver Street, to allow for the development of light industrial uses, and matters related thereto. FOR POSSIBLE ACTION The zone amendment is associated with a parcel map that the City of Elko has submitted for review. The parcel is currently assessed as one parcel although Silver Street has been dedicated and bisects the parcel. The parcel map will split the parcel into three parcels and the zone amendment will eliminate the dual zoning on the parcel and bring the parcel into conformance with surrounding zoning districts. CL Ralph Negron introduced himself as the city's new Development Manager. Chairman Jeff Dalling welcomed him. Cathy Laughlin, City Planner, stated the City of Elko was the applicant. She highlighted the parcel on the projected map, indicating it was on Silver Street, near the Igloo, at the current terminus of Silver Street. The remainder of the street had been dedicated up to the Union Pacific railroad property, but at that time, the parcel was not split into multiple parcels. Recently, the City did a parcel map to split it into three. It currently has multiple zoning districts - Commercial and General Industrial. This application would rezone it to Light Industrial, which would be consistent with other uses in the area. She then went over the City of Elko Staff Report, dated September 12, 2023, which listed nine findings and recommended approval. Mr. Negron had no conditions. Bob Thibault, Civil Engineer, recommended approval as presented by staff. Jamie Winrod, Fire Marshal, had no comments or concerns. Jan Baum, City Manager, recommended approval. ** A motion was made by Commissioner Mendive, seconded by Commissioner Odeh to forward a recommendation to City Council to adopt an ordinance which approves Rezone #4-23. October 3, 2023 City of Elko Planning Commission Meeting Minutes Page 2 of 4 Commissioner Mendive's findings to support her recommendation were the proposed zone amendment is in conformance with the Land Use Component of the Master Plan and supports the goals and objectives of the Master Plan. The proposed zone district is compatible with the Transportation Component of the Master Plan. The proposed zone district is in conformance with wellhead protection plan and any future use will be required to be in conformance with the wellhead protection plan. The property is partially located within the redevelopment area. The zone amendment does not conflict with the goals and objectives listed in the Redevelopment Plan. The proposed zone district is in conformance with Elko City Code Section 3-2-4(B). Any future development of the property will be required to be in conformance with Section 3-2-12 of City Code. The application is in conformance with Elko City Code 3-2-21. The proposed zone district is partially located in a designated Special Flood Hazard Area (SFHA). Development under the proposed zone district will not adversely impact natural systems, or public/federal lands such as waterways, wetlands, drainages, floodplains etc., or pose a danger to human health and safety. The motion passed unanimously. (6-0) VII. REPORTS A. Summary of City Council Actions Ms. Laughlin reported at the September 26th City Council meeting, the final map (FM 2-23) for Ash Street Village was approved for the townhomes on Ash Street and 5th Street. The parcel map (PM 5-23) for the City of Elko parcel, running in conjunction with the rezone heard tonight, was also approved. B. Summary of Redevelopment Agency Actions C. Professional articles, publications, etc. 1. Zoning Bulletin - INFORMATION ONLY - NON-ACTION ITEM D. Training Ms. Laughlin told the commission their annual ethics training was virtual this year. The Human Resources department sent it in an email. She asked them to check their 'elkocitynv.gov' accounts and to complete it as soon as they could. Chairman Dalling and Commissioner Garret Kamps responded they had not received it. Ms. Laughlin said she had checked with HR earlier this afternoon, but would check again. She suggested they look in their spam folders. She stated staff was excited to have Mr. Negron on board and that next month's agenda already had four items scheduled.
