CITY OF ELKO PLANNING COMMISSION SPECIAL MEETING MINUTES 5:30 PM, THURSDAY, JULY 6, 2023 ELKO CITY HALL, COUNCIL CHAMBERS 1751 COLLEGE AVENUE, ELKO, NV 89801 I. CALL TO ORDER Jeff Dalling, Chairman of the City of Elko Planning Commission, called the meeting to order at 5:30 p.m. II. ROLL CALL Present: Jeff Dalling Stefan Beck Mercedes Mendive Tony Odeh Absent: Garret Kamps John Lemich Michael Irish City Staff Present: Scott Wilkinson, Assistant City Manager Cathy Laughlin, City Planner Bob Thibault, Civil Engineer Rachel Randall, Planning Technician III. PLEDGE OF ALLEGIANCE IV. COMMENTS BY THE GENERAL PUBLIC There were no public comments made at this time. V. APPROVAL OF MINUTES A. June 6, 2023 - Regular Meeting - FOR POSSIBLE ACTION ** A motion was made by Vice-Chairman Beck, seconded by Commissioner Odeh to approve the minutes from the June 6, 2023 regular meeting. The motion passed unanimously. (4-0) July 6, 2023 City of Elko Planning Commission Meeting Minutes Page 1 of 4 VI. NEW BUSINESS A. PUBLIC HEARING 1. Review, consideration and possible recommendation to City Council for Rezone 3-23, filed by Christopher Beardmore, for a change in zoning from AG (General Agriculture) to R (Single Family and Multiple Family Residential) Zoning District, approximately 9.860 acres, to allow the zoning to be consistent with the current land use, and matters related thereto. FOR POSSIBLE ACTION When a property is annexed into the City of Elko, it defaults to AG- General Agriculture. The residence was existing at the time of annexation and the property was never rezoned to be consistent with the land use. Christopher Beardmore, 5477 Ovando Way, Las Vegas, NV, introduced himself as the applicant and stated he was available for questions. Nick Claerbout, 986 Benti Way, asked about future development plans for the property. Mr. Beardmore responded that today's request was just for the rezone so he could repair the existing Benti house and garage. Later, it would get developed. Mr. Claerbout asked if he would be looking into some kind of phased approach with single family dwellings. Mr. Beardmore affirmed. Mr. Claerbout ask for more information about logistics and traffic regarding future plans. Cathy Laughlin, City Planner, went over the City of Elko Staff Report, dated June 21, 2023, which included information addressing Mr. Claerbout's concerns. She stated this application was unique because a portion of Ruby Vista Drive was currently an easement, instead of dedicated right-of-way. If any development were to occur, the City would request a dedication of the remainder of Ruby Vista Drive to tie into the intersection of Spruce Road and North Hollow Drive. The application has the rezone going to the centerline of the easement. The remainder of the easement, on the neighboring property, could be rezoned from agricultural to commercial, by the City, at the time of development. Staff recommended approval with no conditions. Bob Thibault, Civil Engineer, had no additional comments and recommended approval as presented by staff. Scott Wilkinson, Assistant City Manager, speaking on behalf of Development and the City Manager's office, had no comments and recommended approval as presented by staff. Ms. Laughlin reported that Fire had no comments or concerns. July 6, 2023 City of Elko Planning Commission Meeting Minutes Page 2 of 4 ** A motion was made by Commissioner Mendive, seconded by Commissioner Odeh to forward a recommendation to City Council to adopt an ordinance, which approves Rezone 3- 23. Commissioner Mendive's findings to support her recommendation are the proposed zone district is in conformance with the Land Use Component of the Master Plan. The proposed zone district is compatible with the Transportation Component of the Master Plan and is consistent with the existing transportation infrastructure. The property is not located within the Redevelopment Area. The proposed zone district and resultant land use is in conformance with City Wellhead Protection Plan. The proposed zone district is in conformance with Elko City Code Section 3-2-4(B). The proposed zone district is in conformance with Elko City Code Section 3-2-5. The application is in conformance with Elko City Code 3-2-21. The proposed zone district is not located in a designated Special Flood Hazard Area (SFHA). The proposed zone district is consistent with surrounding land uses. Development under the proposed zone district will not adversely impact natural systems, or public/federal lands such as waterways, wetlands, drainages, floodplains etc., or pose a danger to human health and safety. The motion passed unanimously. (4-0) 2. Review, consideration and possible action on Zoning Ordinance Amendment 1- 22, Ordinance 880, an amendment to the City Zoning Ordinance, specifically Title 3, Chapter 2, Section 2 (Definitions) and Title 3, Chapter 2, Section 10 (PC, C Commercial Districts), and matters related thereto. FOR POSSIBLE ACTION The Planning Commission considered Ordinance 880 at their April 4, 2023 meeting and made a recommendation to City Council. City Council considered the ordinance and tabled the item at their April 25, 2023 meeting. Staff worked with legal counsel on additional changes to the ordinance and the proposed changes were significant enough that the proposed changes need to be considered by Planning Commission again. Ms. Laughlin stated the agenda packet included the ordinance as well as a few pages at the end highlighting the changes that had been made since the last time the Commission heard it. Under the Planned Commercial zoning district section, "Permanent accessory building(s) for storage are allowed", was added. Under the Commercial zoning district section, standards for accessory buildings were added; for the Central Business District, item (c), "change in ownership" was struck out, "other use of land" was added, "veterinary clinics" was removed, and language from item (d) regarding light manufacturing activities was moved to this item. Mr. Wilkinson, speaking on behalf of Development, recommended approval as presented by staff. Mr. Thibault recommended approval as presented. July 6, 2023 City of Elko Planning Commission Meeting Minutes Page 3 of 4 ** A motion was made by Commissioner Mendive, seconded by Commissioner Odeh to forward a recommendation to City Council to adopt an ordinance which approves Zoning Ordinance Amendment 1-22 of the Elko City Code specifically Sections 3-2-2 (Definitions) and 3-2-10 (PC, C Commercial Districts) . The motion passed unanimously. (4-0) VII. REPORTS A. Summary of City Council Actions Ms. Laughlin reported that at the June 13th City Council meeting, the vacation for a portion of Commercial Street to the Stockman's was approved (Vac 2-23/Res. 7-23). A granting of a pedestrian and maintenance easement for the same area was approved. A deed of dedication for the roads around the Main City Park was approved. The parcel maps for the Sports Complex and the City park with the Skate Park, Kump Field and Herrera Field, were approved (PM 2-23 & 3-23). The first readings of the ordinances for rezones on Manzanita and 30th Street and the Sports Complex were approved (Ord. 884/Rez 1-23 & Ord. 885/Rez 2-23). The sidewalk waiver along Errecart Boulevard was approved (CGS 1-23). At the June 27th meeting, the second readings of the ordinances for rezones on Manzanita and 30th Street and the Sports Complex were approved. A resolution conveying land to the Committee Against Domestic Violence for the Harbor House building was approved (LSR 3-23/Res. 8-23). A parcel map for the city park, where the swimming pool currently is, was approved (PM 4-23). B. Summary of Redevelopment Agency Actions C. Professional articles, publications, etc. 1.
