YMCA) ELLWOOD CITY BOROUGH COUNCIL REGULAR MEETING – 6:00 P.M. – COUNCIL CHAMBERS April 17, 2023 MINUTES CALL TO ORDER President George Celli called the meeting to order. ROLL CALL Present: Mr. Barry, Mr. Cragle, Ms. Dici, Ms. Lamenza, Mr. Ovial, Ms. Williams, and Mr. Celli Also Present: Borough Manager Kevin Swogger, Mayor Anthony Court, Solicitor Ed Leymarie, and Kaden Schlichtkrull (Jr. Councilperson) INVOCATION – Jay Sterling, First United Methodist Church PLEDGE OF ALLEGIANCE VISITORS None COMMUNICATIONS APPROVAL OF MINUTES: Regular Meeting 3/20/23 A motion was made by Ms. Dici, seconded by Mr. Barry, to approve the Minutes of the Regular Meeting held 2/20/23, as submitted. Voice vote; all in favor. Motion carried. APPROVAL OF VOUCHERS: Pre-Paid Voucher List 4/11/23 and List of Vouchers to be Paid dated 4/12/23 A motion was made by Mr. Cragle, seconded by Ms. Williams, to approve the Pre-Paid Voucher List dated 4/11/23, in the amount of $560,111.97, and the List of Vouchers to be Paid dated 4/12/23, in the amount of $261,690.36. Roll call vote. All in favor, with Ms. Williams abstaining on Pre-Paid Voucher check # 60161. Motion carried. DEPARTMENTAL REPORTS: A motion was made by Ms. Dici, seconded by Ms. Lamenza, to approve the Departmental Reports, as submitted. Voice vote; all in favor. Motion carried. BID OPENINGS ORDINANCES 1. Repeal Ordinance # 2609 & Establish One Way Traffic on Glen Avenue A motion was made by Mr. Cragle, seconded by Mr. Barry, to adopt an Ordinance, as submitted, repealing Ordinance #2609 and establishing one way traffic on Glen Avenue from 5th Street to 6th Street westbound. Roll call vote; all in favor. Motion carried. Advertise Ordinance – Repeal Ordinance #2603 (Stop Intersection, Glen Ave) A motion was made by Mr. Barry, seconded by Mr. Ovial, to advertise an ordinance repealing Ordinance #2603, establishing a stop intersection on Glen Avenue at 5th Street eastbound. Voice vote; all in favor. Motion carried. 2. Advertise Ordinance – Repeal Ordinance #2604 (No Left Turn or Straight Through at Glen Ave & 5th Street) A motion was made by Ms. Dici, seconded by Ms. Lamenza, to advertise an ordinance repealing Ordinance #2604 designating no left turn or straight through at Glen Avenue and 5th Street eastbound. Voice vote; all in favor. Motion carried. 3. Advertise Ordinance – Repeal Ordinance #2605 (No Parking, Glen Ave) A motion was made by Mr. Barry, seconded by Mr. Cragle, to advertise an ordinance repealing Ordinance #2605 and advertise an ordinance establishing No Parking on Glen Avenue (south) from 5th Street to a point 197’ west. Voice vote; all in favor. Motion carried. 4. EC Public Library – Fundraiser A motion was made by Mr. Cragle, seconded by Ms. Williams, to approve the request by the EC Area Public Library to close Lawrence Avenue from 4th Street to 6th Street on August 11 from 5-8pm for a wine and food truck fundraiser. It is also requested to approve suspending Part 6, Chapter 606, of the Codified Ordinance Book pertaining to open containers. This suspension only applies to participants of the library fundraiser event. Event insurance shall be purchased, naming the Borough of Ellwood City as an additional named insured. All necessary State and County permits shall be in place for this event. Voice vote; all in favor. Motion carried. 5. EC Community Enrichment – Summer Concert Series A motion was made by Mr. Ovial, seconded by Ms. Lamenza, to approve the request by the EC Community Enrichment to close Lawrence Avenue from 5th Street to 6th Street beginning at 6:45pm on June 17, July 15, 22, 29, August 5, 12 for the summer concerts at the Community Plaza. Voice vote; all in favor. Motion carried. Public Works: (Barry, Williams, Ovial) 1. Award Bid – Sale of 2009 Lee Boy Pot Hole Patcher A motion was made by Ms. Dici, seconded by Mr. Ovial, to award the bid for the sale of a 2009 Lee Boy Pothole Patcher to Chad Moffatt at the cost of $1,080.00. Voice vote; all in favor. Motion carried. 2. Reject & Readvertise Bids – Stiefel Park Hockey Rink Resurfacing Project A motion was made by Mr. Cragle, seconded by Mr. Barry, to reject all bids and readvertise the bid for the Stiefel Park Hockey Rink Resurfacing Project. Voice vote; all in favor. Motion carried. 3. Request Additional Funding from PennVest – Wampum Ave Pump Station Project A motion was made by Mr. Cragle, seconded by Mr. Ovial, to request additional funding in the amount of $2,500,000 from PennVest relative to the Wampum Avenue Pump Station Project. Approve Quote – M&R Power Equipment A motion was made by Mr. Cragle, seconded by Mr. Ovial, to approve the quote from M&R Power Equipment in the amount of $13,359 (Costar pricing) for an Exmark Zero Turn mower. This amount will be paid from the General Fund ($8000) and the General Capital Reserve Fund ($5359). After a discussion, Mr. Cragle made a motion to Table this item. Roll call vote; all in favor. Motion carried. 5. Rescind Motion made 1/16/23 – Quote (Insight Pipe Contracting) A motion was made by Ms. Williams, seconded by Mr. Cragle, to rescind the motion made at the Regular Council Meeting held 1/16/23 “to approve the quote from Insight Pipe Contracting in the amount of $63,109.90 for the lining of the 6th Street and Lawrence Avenue sanitary sewer. This amount will be paid from the General Fund”. Roll call vote; all in favor. Motion carried. 6. Payment (ratify) – Invoice (Insight Pipe Contracting) A motion was made by Mr. Barry, seconded by Ms. Lamenza, to ratify the payment in the amount of $73,934 to Insight Pipe Contracting for the lining of the 6th Street and Lawrence Avenue sanitary sewer. This amount was paid from the Sewage Collection Reserve Fund. Roll call vote; all in favor. Motion carried. Utilities: (Dici, Barry, Williams) Parks/Recreation: (Cragle, Lamenza, Barry) 1. Field Request – Men’s Softball A motion was made by Mr. Cragle, seconded by Ms. Lamenza, to approve the request to use the Men’s softball field May 20 from 8-10pm and May 21 from 8- 3pm. Voice vote; all in favor. Motion carried. 2. Suspend Alcohol Ordinance – Oktoberfest A motion was made by Mr. Cragle, seconded by Mr. Ovial, to approve suspending Part 10, Chapter 1066, subsection 1066.03 (a) of the Codified Ordinance Book pertaining to the prohibition of alcohol in Ewing Park. This suspension only applies to participants of the “Oktoberfest” event to be held October 7. Event insurance shall be purchased, naming the Borough of Ellwood City as an additional named insured. Memorandum of Understanding – Local Union #964 (Clerical Employees) A motion was made by Mr. Barry, seconded by Mr. Ovial, to approve the Memorandum of Understanding, as submitted, between Local Union #964 (Clerical Employees) and the Borough relative to earning vacation time during the first year of employment. Pension Benefit – Diane Daubenspeck (Municipal Employees’ Plan) A motion was made by Mr. Barry, seconded by Mr. Ovial, to approve the monthly pension benefit of Diane Daubenspeck (Municipal Employees’ Plan), as submitted by the Actuary. Voice vote; all in favor. Motion carried. 5. Resignation – Maximus Franksain (Part-time Public Works) A motion was made by Ms. Dici, seconded by Mr. Cragle, to accept the resignation of Maximus Franksain, a part-time Public Works employee, effective 4/13/23, his last day of employment. Voice vote; all in favor. Motion carried. 6. Advertise Employment – Part-time Public Works A motion was made by Ms. Lamenza, seconded by Ms. Williams, to advertise for a part time Public Works employee at the rate of $15.00 per hour. Voice vote; all in favor. Motion carried. Community Development/Buildings: (Ovial, Barry, Cragle) Blight: (Dici, Ovial, Barry) Technology: (Cragle, Williams, Dici) UNFINISHED BUSINESS NEW BUSINESS 1. National Day of Prayer A motion was made by Mr. Ovial, seconded by Mr. Barry, to approve the request to use the Community Plaza on May 4 from 11-2pm for a National Day of Prayer event. Voice vote; all in favor. Motion carried. 2. Agreement – Playground Program (Beaver Co. YMCA) A motion was made by Mr. Cragle, seconded by Mr. Barry, to approve the Agreement with the Beaver County YMCA, as submitted, relative to the YMCA running the summer playground program at a cost of $4,000 for management, food, transportation and supplies. This amount will be paid from the General Fund. Roll call vote; all in favor. Motion carried.
