CALL TO ORDER & PLEDGE OF ALLEGIANCE TO FLAG Chair Zuniga called the November 16, 2022 Planning Commission Meeting to order at 6:30pm. II. ROLL CALL Roll Call: Commissioner Booth - present Commissioner Swikoski - present Commissioner Baham - absent/excused Commissioner Burns - present Vice Chair Luthi - present Chair Zuniga - present A quorum was present. III. APPROVAL OF THE AGENDA Vice Chair Luthi moved to approve the agenda of the November 16, 2022 Planning Commission Meeting. The motion, seconded by Commissioner Burns, carried with the following roll call vote: Commissioner Booth - yes Commissioner Swikoski - yes Commissioner Burns - yes Vice Chair Luthi - yes Chair Zuniga - yes Motion passes unanimously. IV. APPROVAL OF MINUTES 22-457 Approval of the November 2, 2022 Planning Commission Meeting Minutes Attachments: November 2, 2022 Planning Commission Meeting Minutes Commissioner Burns moved to approve the meeting minutes of the November 2, 2022 Planning Commission Meeting. V. PUBLIC COMMENTS There were no public comments. VI. Chair Zuniga turned it over to staff for an update at 6:34pm. Erin Fosdick, Principal Long Range Planner provided a presentation and an update to the Commission on the Comprehensive Plan. Miguel Aguilar, Senior Transportation Planner introduced himself, his background, and provided the Commission with an update to the Commission on the Transportation & Mobility Plan. Project Name: Elevate Erie Project Tagline: Planning Our Future Together! Chair Zuniga brought it back to the Commission for discussion and questions/comments of staff. Some questions and comments included the following: - As you're analyzing all the data, are you also grabbing information from outside of Erie? - If Home Rule passes in November of 2023, does that still encompass a Comp Plan in some shape or form? - The Comp Plan helps to bring continuity as things constantly change - The Plan Advisory Committee (PAC) - what is the purpose? How can we get the best feedback? How can we best engage? - There are already existing boards - there are different ways of approaching it - What's the best approach for guiding this? - If anything the Planning Commission would be gathering information and bringing it back for discussion - Help us to envision what a PAC meeting would look like - Is it lead by staff? - What are the time commitments? - If we were to start out with this (taking comments), if we set a precedent by taking comments, can we back peddle? - If people come and they want to give comments and it was a huge gathering that wanted to participate, there's a concern that it would prevent the meeting from doing what it needed to do - Likes the idea of having public comment at milestone meetings to hear what the community has to say - It's another avenue to connect with the community - It's not setting a great precedent by opening some meetings and closing some meetings - Housing is an area of opportunity for Erie - Would like to have the presentation on what's happening with the Housing side - Is there an opportunity for the Commission to be involved in informal reviews/check-in? - If we have one person involved in the management, the Commission may not TOWN OF ERIE Page 3 Printed on 2/3/2023 Planning Commission Meeting Minutes November 16, 2022 see all aspects until the deliverables occurs - Foresees the committees being much more involved and sees much more of the project - Is there a more detailed schedule that breaks down the steps, especially looking at the deliverables? - Trying to get an idea on time, staying on track, and seeing all the deliverables - Many of the Commissioners would like to be involved - The scope of services that was included in the fee schedule, that's just for the consultant, correct? - Concern is that we're going to get to task 9 and everyone wonders what happened to the other tasks - wants to reiterate that the Comp Plan doesn't belong to PC, the Board of Trustees, but it belongs to the Town - The Comp Plan is to be decided upon by the citizens of Erie - Compliments to staff on being a great speaker - Questions on process and the Director gave a great explanation - During a conversation with the Director, a question came up about the Town's infrastructure. It's hugely important - How can we help/change these conversations/topics about the Town's infrastructure? It's what defines Erie - As part of our engagement, can we bring it down to a more understandable level for our residents - How can help our residents understand development and how Erie got to where it is now? Make it engaging? - There is an opportunity to invite and engage the community - Where is the Commission's opportunity to engage/facilitate a community event? - It would be a nice opportunity for the Commission to see staff in action at the community events - Would love for the Housing information to come in - PAC representative decided by the next meeting Discussion was had regarding a representative on the PAC Meeting. Ideally, staff would like 1 member and 1 alternate. Everything brought to the PAC will be brought before the Commission. Chair Zuniga asked if there were nominations for someone other than themselves? Staff gave ideas on how to select committee members. Ranking or secret ballots is suggested. Commissioner Swikoski noted that he has a lot of travel coming up so he can step back so others can step up if they would like. Chair Zuniga noted that the Commission should wait until Commissioner Baham is back to make a decision. Deborah Bachelder, Planning Manager/Deputy Director of Planning & Development stated that an email can go out to Commissioner Baham to see if he is interested in serving on the PAC. In addition, staff will send an email regarding the ranking of members as each Commissioner is interested in serving on the PAC. Erin Fosdick, Principal Long Range Planner and Deborah Bachelder, Planning Manager/Deputy Director of Planning & Development, provided a presentation and update to the Commission on the I-25 Erie Gateway. Chair Zuniga brought it back to the Commission for discussion and questions/comments of staff. Some questions/comments included the following: - Interested in understanding the ownership of those properties - What about the percentage of mixed retail vs. housing vs. zoning options? - Has the Historic Preservation Board been updated on this property? - RE: Ownership of Oil & Gas leases out there: Do we have any business on their properties? - Are we thinking a Westminster "Orchard" or a Loveland "Centerra" type of project for this location? - Are utilities available or are we pulling from miles away? - This is exciting - we have so much going on, on our perimeter. We want to make sure we don't miss out - Another developer in the northwest quadrant was mentioned. Are they working with the Town or moving forward with their own plan? - General timing for this? - Improvement funding of this area? - Looking at the ingress/egress of this area - Likes the northern part of "Orchard" blending in - Maps: who owns which properties and which area could be developed? - Next steps: Are there any dates to this regarding annexation, continued outreach? - Do we have dates/timelines with regards to the infrastructure? - As far as the embedded employment, what industry to you imagine, or the magnet, for this area? - Heard that St. Vrain Valley School District was trying to build a high school in this area. Has this been shot down? - What is the diagonal gray strip on the slide with the maps? Railroad? - Does that connect down to Fast Track/128? - Likes the idea of bus rapid transit - The railroad seems a pain to be placed next to building Chair Zuniga and the Commissioners thanked staff for the update and presentation. 22-445 Informational Item: Erie Planning Commission Rules of Procedure Attachments: Planning Commission Rules of Procedure Chair Zuniga introduced Agenda Item 22-445: Informational Item: Erie Planning Commission Rules of Procedure TOWN OF ERIE Page 5 Printed on 2/3/2023 Planning Commission Meeting Minutes November 16, 2022 Chair Zuniga turned it over to staff for an update at 8:20pm. Austin P. Flanagan, Town Attorney gave an overview and background of the Rules and Procedures for the Planning Commission. The Rules and Procedures are in place to make it predictable on how a meeting is run. Some points to note: - Responsibilities of the Chair - Roll call votes and voice votes (preference of roll call votes) - Abstaining from a vote when there's a conflict of interest - Types of motions This will go before the Board of Trustees for vote on the December 6, 2022. Chair Zuniga brought it back to the Commission for any questions/comments. Some questions/comments included the following: - What is the difference of voice vote and roll call vote? - Who is the liaison? - There was a minor typo in the document - For motions where there were no seconds or lots of language adjustment - this will be helpful Chair Zuniga and the Commission thanked Town Attorney Flanagan for the presentation. VII. STAFF REPORTS Deborah Bachelder, Planning Manager/Deputy Director of Planning Development noted that there are 2 public hearings on the December 7, 2022 Commission's next agenda: Colliers Hill Filing 4H Site Plan and Lafferty Preliminary Plat. There is also agenda items/public hearing scheduled for the December 21, 2022 meeting. There is a Study Session with the Board of Trustees on Affordable Housing. Ariel Tolefree, Affordable Housing Manager will be providing the same presentation to the Planning Commission at a future date depending on Ariel's availability. Chair Zuniga noted that it appeared there would be a joint study session on January 17, 2023 with the Board of Trustees to which Mrs. Bachelder confirmed there would be discussion regarding the Comprehensive Plan and the Transportation & Mobility Plan. Melinda Helmer informed the Commission that Deputy Town Clerk, Michele Crawford would be filling as Secretary for the December 7, 2022 meeting. Mrs. Bachelder gave an update on the vacant Planning Commission seat. The Board of Trustees will announce the appointment at their December 13, 2022 meeting. Chair Zuniga asked about the "Save the Date" for a holiday party. Ms. Helmer noted that it was for January 13, 2023 at Top Golf. VIII. COMMISSIONER REPORTS AND DISCUSSION ITEMS Vice Chair Luthi noted that we had our first snow and provided a reminder for those on the roads to please drive safely and take a little extra time reaching your destination.
