I. Workshop Item
16167 Presentation and Discussion of Possible Revisions to the Land Development
Regulations
Lori Barnes, Development Services Director, presented the proposed revisions to the Land
Development Regulations (LDRs) and provided an overview of the reasons for the revisions to
remove inconsistencies between the LDRs, the Comprehensive Plan, state and federal regulations
and best practices. The revisions cited were as follows: 1) Consistency with the Comprehensive
Plan regarding maximum densities; 2) Definition of single family attached dwelling; 3) Update of table
to clarify that public and utility services and facilities are permitted uses; 3) Clarifying that wireless
communication antenna and towers are not included in the definition for ''public service/utility" and
clarifying permitted locations; and 4) Consistency with the downtown vision plan and Central Business
District (CBD) .
Ms. Barnes explained that the downtown development guidelines are only guidelines and were not
adopted as code. She stated staff's proposal to require a mandatory minimum two-story building for
new construction in the CBDAJC and Mixed Use in the downtown area. She presented a proposed
boundary for the mandatory mixed use if a residential component is desired. She asked for
Commission input on the suggested two-story minimum and whether or not they want to codify the
downtown development guidelines.
II. Commission Discussion
The Commission discussed the guidelines and the two-story minimum with Ms. Barnes explaining
that outside the yellow line could be multi-family but inside the yellow line would have to have
commercial or retail on the ground floor with residential allowable on the upper floors.
Ms. Barnes explained how the discussion arose due to a request to build a single story professional
building in the downtown core.
The Commission discussed why the Main Street Design Guidelines were not previously codified.
CONSENSUS: It was a consensus of the Commission to follow the recommendation of staff to
require the mandatory two-story minimum building height and the mixed use in the Commercial
Business District core and adopting as code the Main Street Design Guidelines.
Ms. Barnes then reviewed the proposed changes for Chapters 100 and 109, the need to remove
definitions not used elsewhere in the LDRs and to add the following definitions: 1) fast lube/oil
change; 2) car wash, automated, full service and self-service; 3) poultry and swine farming; 4)
live-work; 5) recreational vehicle parks; 6) shooting range, indoor and outdoor; 7) some signage
definitions; 8) mobile vendor; 9) vehicle service, general and major; and 10) pharmacy.

Ms. Barnes discussed the pennitting of dispensaries for medical cannabis by the Florida Health Dept.
Office of Compassionate Use. She recommended a definition be added and that they be restricted
to those areas allowing retail sales.
The Commission questioned if the City could wind up with a large number of dispensaries with Ms.
Barnes explaining they are for the dispensing of a product for medical use only. She expressed
doubt that the City could support a large number of dispensaries.
The Commission questioned whether or not there could be a sub-classification for cannabis
dispensaries with Ron Neibert, City Manager, explaining the City could; however, they could not
restrict it to the point it makes it impossible for them to locate in the City nor can they limit the number
of dispensaries. The Commission also discussed not being able to restrict the number of any type of
retail use and how the market would limit the number.
Ms. Barnes continued listing the additional definitions needed including modifying the daycare facility
definition and the industrial/light, clean and industrial service/heavy. She then reviewed changes to
the Chapter 109 - Development Intensity Table and the need to clarify the minimum open space and
maximum impervious surface requirements.
Ms. Barnes explained the existing fence regulations and presented proposed changes that would
leave the regulations as is but provide clarification. She also presented the possibility of not allowing
any fence taller than four feet in the front of a home.
The Commission discussed the fence regulations, where it would be appropriate to have a six-foot
solid fence, and only allowing a four-foot fence in the front yard.
CONSENSUS: It was a consensus of the Commission to only allow a four-foot fence in the front
yard in residential districts.
Ms. Barnes then reviewed issues regarding the enclosure of garages and carports under Chapter
109. She cited the recent variances to allow the enclosure of existing carports and suggested that
carport enclosure be allowed on /ega/lots of record below the minimum size standards and in urban
design districts with the requirement they provide the required onsite parking and outside storage in
the fonn of a shed.
CONSENSUS: It was a consensus of the Commission to allow the recommended change to allow
the carport enclosures as stipulated.
Ms. Barnes reviewed the issues regarding outdoor storage in Chapters 109 and 115. She
recommended allowing outdoor storage in all areas if screened appropriately. She also
recommended requiring motor vehicle repair facilities to screen vehicles awaiting repair from view of
the public right-of-way and adjacent properties. She indicated that, if the revisions are adopted, the
affected businesses will be notified of the ordinance change prior to implementation. She then
reviewed recommended changes regarding outdoor display of products. She further explained the
need to consolidate and clarify the regulations regarding vehicle storage and the need to provide
clearer definitions with illustrations to assist with enforcement.
Ms. Barnes then discussed building lot types and the need to reinstitute frontage buildout
percentages which were removed in 2015. She commented on the need to standardize the common
lot setback to 5 feet. She cited the Chapter 110- General Building Design Standards regarding
storefront character. She recommended that properties along Hwy. 441 and SR 19 outside the
urban design district be exempted from the storefront character architectural requirement.
Ms. Barnes cited the Commission's desire to improve the gateway conidors and commented on the
number of automotive repair businesses with outdoor automotive lifts particu/arty along Hwy. 19.
She commented on the number of existing lifts under canopies. She proposed that automotive lifts
be required to be contained within an enclosed building except in Genera/Industrial/and use districts.
She stated a less costly alternative could be to require the outdoor lifts be covered by a canopy or
shade structure that is designed to be consistent with the existing building's architecture.

The Commission discussed how existing businesses would be affected with Ms. Barnes explaining
they could continue unless it was destroyed and then they could request a variance to replace it the
way it was. She further explained that businesses with existing outdoor Iitts would not be permitted
to install a metal canopy over the lift. Under Option A, they would have to construct a building
addition to enclose it within their building. Under Option B, any canopy installed would have to match
the architecture of the existing building.
CONSENSUS: It was a consensus of the Commission to allow existing businesses the option of
either enclosing the lift or installing a canopy with a consistent architectural theme and limiting the full
enclosure requirement to new businesses.
Ms. Barnes then cited the use of metal buildings in Public Institutional and Mixed Commercial/
Industrial and the number of recent CUP requests. She stated that even if a business has an existing
metal building, if they want to add another; it will require a CUP She stated staff's suggestion that if a
property already has a metal building or if it is located in an MCI district that is already established as
industrial and has metal buildings, staff could provide administrative approval for a metal building.
Following discussion with Commission, she suggested that when the ordinance is brought back she
would provide information regarding the areas of the City that would be affected by the proposal.
Ms. Barnes explained that the site lighting requirements provide no flexibility for new technology such
as LED. She commented on the need to clarify the landscaping code regarding tree removal and
tree mutilation and eliminate the possibility of someone removing a tree prior to requesting
redevelopment.
Mr. Neibert noted this would not apply to electrical companies trimming trees with Ms. Barnes
explaining the procedure used for the electric companies.
Ms. Barnes explained that at some time the landscape maintenance requirements were removed from
the code and recommended the requirements be reinstated. She indicated changes needed to be
made to the storm water regulations in Chapter 115 to make sure they are consistent with the st.
John 's River Water Management District, the Upper Oklawaha Basin Management Action Plan and
the Little Wekiva River Management Action Plan design standards.
Ms. Barnes explained that the Division of Emergency Management has recommended changes to
make sure the City's floodplain ordinance is consistent with FEMA 's model flood ordinance.
III. Public Input
Commissioner Gnann-Thompson expressed concern regarding abandoned cars with Ms. Barnes
explaining code enforcement is done in response to complaints. She stated that the City is in the
process of hiring an additional code enforcement officer to be shared with Umatilla which will allow
the City to be more proactive. She encouraged the Commissioners to report anything they see.
IV. Commission Direction
CONSENSUS: It was a consensus of the Commission for staff to bring back the revisions as
discussed.
Mayor Holland announced that the regular Commission meeting would convene at 6:15p.m.
