EVANSTON CITY COUNCIL First Regular M eeting November 3, 2015 The official record of proceedings of the first regular m eeting of the Evanston City Council for the m onth of Novem ber was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Chief Jon Kirby led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Those present from the governing body at the start of the m eeting were: Mayor W illiam s; Councilm em bers Tim Lynch, Andy Kopp, Evan Perkes, David W elling, Saundra Meyer, and W endy Schuler. Staff m em bers present at the start of the m eeting were: City Attorney, Dennis Boal; City Engineer, Brian Honey; City Treasurer, Kathy Defa; Director of Planning & Developm ent, Paul Knopf; Police Chief, Jon Kirby; Public W orks Director, Oop Hansen; Director of Parks and Recreation, Jay Dee Nielsen; and Deputy City Clerk, Nancy Stevenson. Director of Adm inistrative Services/City Clerk, Am y Grenfell was excused. A group of interested citizens were also present. Approve Agenda Councilmember W elling moved, Councilmember M eyer seconded, to approve the agenda. Council Comments Councilm em ber Schuler thanked all those who helped repair the broken water line by the fair grounds. She also com m ented on the Boys and Girls Club Casino Night fundraiser, Rocktober Fest, and the Downtown Trick or Treating. Ordinance 15-01 Councilmember Schuler moved, Councilmember M eyer seconded, to pass Ordinance 15-01 on third and final reading. Ordinance 15-01: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING EXTENDING THE TERM OF THE FRANCHISE ORDINANCE GRANTED TO ALL W EST/W YOMING, INC., ITS SUCCESSORS AND ASSIGNS, FOR THE TELECOMMUNICATION LINES, CABLES AND ACCESSORIES. W HEREAS, on or about May 10, 2000, the governing body of the City of Evanston gave final passage to Ordinance 00-04 which granted a non-exclusive franchise (the “Franchise”) to All W est/ W yom ing, Inc., a W yom ing Corporation, to construct, m aintain, operate, use and furnish to the public, including governm ental, industrial, com m ercial and individual and all other consum ers, a telephone system and all incidental or like facilities; and W HEREAS, the Franchise was granted for a term of ten (10) years which term has expired; and W HEREAS, the governing body held a public hearing on July 21, 2015, to receive public input, com m ent and concerns regarding the renewal and/or extension of the Franchise Ordinance; and W HEREAS, the City of Evanston and All W est/W yom ing, Inc., desire to extend the term of the Franchise for an additional term of ten (10) years upon the sam e term s and conditions which are set forth and contained in Ordinance 00-04; NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING, as follows: Section 1: The term of the Franchise granted to All W est/W yom ing, Inc., a W yom ing corporation, as set forth in Ordinance 00-04 is extended for an additional term of ten (10) years com m encing from the date of the publication of this ordinance, unless the Franchise is sooner term inated in accordance with the provisions of Ordinance of 00-04. Section 2: All of the other term s, covenants, conditions and provisions of Ordinance 00-04 shall rem ain in full force and effect during the additional term of the Franchise. Ordinance 15-02: AN O RDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING AND EXTENDING THE TERM OF THE FRANCHISE ORDINANCE W HICH HAS BEEN ASSIGNED TO ALL W EST/W YOMING INC., FOR THE CONSTRUCTION, MAINTENANCE, AND OPERATION OF A CABLE SYSTEM. W HEREAS, on or about April 6, 2004, the governing body of the City of Evanston gave final passage to Ordinance 04-05 which granted a non-exclusive franchise (the “Franchise”) to Century wyom ing Cable Television Corp., d/b/a/ Adelphia Cable Com m unications to construct, m aintain, operate, use and furnish to the public a cable com m unications system ; and W HEREAS, the City approved the assignm ent of the Franchised from Adelphia Cable Com m unications to Tim e W arner NY Cable on August 16, 2005, in Resolution 05-79; and W HEREAS, the City approved the assignm ent of the Franchise from Tim e W arner NY Cable to W indjam m er Com m unications LLC on July 15, 2008 in Resolution 08-59; and W HEREAS, the City approved the assignm ent of the Franchise from W indjam m er Com m unications LLC to All W est/W yom ing, Inc., on October 4, 2011 in Resolution 11-90; and W HEREAS, the governing body held a public hearing on July 21, 2015, to receive public input, com m ent and concerns regarding the renewal and/or extension of the Franchise Ordinance; and W HEREAS, the City of Evanston and All W est/W yom ing, Inc., desire to extend the term of the Franchise for an additional term of ten (10) years upon the sam e term s and conditions which are set forth and contained in Ordinance 00-05, except as am ended below; NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING, as follows: Section 1: The term of the Franchise granted to All W est/W yom ing, Inc., a W yom ing corporation, as set forth in Ordinance 04-05 is extended for an additional term of ten (10) years com m encing from the date of the publication of this ordinance, unless the Franchise is sooner term inated in accordance with the provisions of Ordinance of 04-05. Section 2: Section 9 of Ordinance 04-15 is am ended to reflect that the m ailing address of the Grantee of the Franchise is the following: All W est/W yom ing, Inc. 50 W 100 N Kam as, UT 84036 Section 3: All of the other term s, covenants, conditions and provisions of Ordinance 04-05 shall rem ain in full force and effect during the additional term of the Franchise. Resolution 15-67 Councilmember M eyer introduced Resolution 15-67. Councilmember M eyer moved, Councilmember Perkes seconded, to adopt Resolution 15-67. Resolution 15-67: RESOLUTION AUTHORIZING THE CITY OF EVANSTON, W YOMING TO ACCEPT AND APPROVE A RENEW AL OFFER W ITH DELTA DENTAL OF W YOMING TO PROVIDE DENTAL INSURANCE FOR CITY EMPLOYEES. W HEREAS, the City of Evanston, W yom ing has for m any years provided dental insurance for its em ployees; and W HEREAS, it is necessary for the City to accept the attached renewal offer with Delta Dental of W yom ing to continue to provide dental insurance for its em ployees. NOW , THEREFORE, BE IT RESOLVED BY THE G OVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston hereby accepts and approves the renewal offer from Delta Dental of W yom ing, a copy of which is attached hereto and incorporated herein, to provide dental insurance for its em ployees. Comments/Remarks Jay Dee Nielsen com m ented on the Evanston W yom ing Tree Guide brochure that was recently produce. He explained that the tree guide shows tree species that can survive Evanston’s clim ate and also other useful inform ation regarding trees in our area. Public Participation Jack W alkenhorst, with All W est, addressed the Mayor and Councilm em bers thanking them for passing the All W est franchise agreem ents.
