EVANSTON CITY COUNCIL First Regular M eeting October 17, 2017 The official record of proceedings of the second regular m eeting of the Evanston City Council for the m onth of October was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Council President Andy Kopp led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Council President Kopp called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Ordinance 17-04 Councilmember Schuler moved, Councilmember Perkes seconded, to pass Ordinance 17-04 on third and final reading. ORDINANCE 17-04: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTION 4-1 AND SECTION 4-8 A (1), (3),(4), (5) OF CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE EVANSTON CITY CODE TO REVISE THE DEFINITION OF THE TERM “OPERATIONAL”; TO DELETE THE RESTRICTION ON ELECTED OFFICIALS; TO MODIFY THE REQUIREMENTS ON LIQUOR LICENSEES TO DEMONSTRATE THEIR BUSINESS IS OPERATIONAL; AND TO MODIFY M INIM UM PURCHASE REQUIREMENTS. W HEREAS, the W yom ing Legislature has am ended the state statutes for the sale of alcoholic beverages to revise the definition of operational; to delete the restriction on elected officials; to m odify the requirem ents on liquor licensees to dem onstrate their business is operational; and to m odify m inim um purchase requirem ents for certain licensees; and W HEREAS, the City of Evanston desires to am end its Alcoholic Beverage Ordinance in response to the am endm ents in state law. NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY O F EVANSTON, W YOMING THAT: Section 1. Section 4-1. of the Evanston City Code is hereby am ended to m odify the definition of "Operational" as follows: § 4-1. Definitions. OPERATIONAL–The offering for sale on an ongoing w eekly basis to the general public alcoholic liquor and m alt beverages as authorized under a licence or perm it issued under this chapter for not less than three consecutive m onths during any calendar year. “Ongoing weekly basis” shall mean at least three hours per day for three days each w eek. Section 2. Section 4-8 A (1)(3) (4) and (5) of the Evanston City Code is hereby am ended and reenacted to provide as follows: § 4-8. Issuance to certain applicants prohibited; issuance of more than one license or permit to person prohibited. A. A license or perm it authorized by this Part 2 shall not be held by, issued, transferred or renewed to: (1) Any m ayor, m em ber of the City council or county com m issioner, within their respective jurisdictions; (3) Any person who does not own the building in which the sales room is located or h o ld a w ritte n le a s e fo r th e p e rio d fo r w h ic h th e lic e n s e w ill b e e ffe c tive c o n ta in in g a n a g re e m e n t b y th e le s s o r th a t a lc o h o lic o r m a lt b e ve ra g e s m a y b e s o ld upon the leased prem ises, except as provided by paragraph (4) of this subsection; (4) Any licensee who fails to dem onstrate that his licensed alcoholic or m alt beverage enterprise will be operational in a planned but not physically functional building within two years one year after a license or perm it has been issued or transferred, or if holding a license, fails to open his business in a functional building within two years one year after license issuance or transfer and rem ain operational thereafter. Upon a showing of good cause by the licensee and for an additional period of not to exceed one year, the City m ay extend the tim e period in which the business or enterprise of the licensee is required to becom e operational or open for business pursuant to this paragraph. Any license or perm it in violation of this paragraph shall not be renewed by the City and once the enterprise is operational or open for business, no licensee shall be eligible to repeat the grace periods m ade available by this paragraph w ithout the consent of the governing body of the City due to extraordinary circum stances. For purposes of this paragraph “rem ain operational” m eans operational consecutively, in any license term year, for tw elve m onths  or for not less than three m onths if determ ined by the governing body to be a seasonal operation; (5) Any licensee who did not, during the previous one year term of the license, purchase at least five hundred dollars of alcoholic or m alt beverages or a com bination thereof from the com m ission or any authorized m alt beverage wholesaler. A retail liquor license shall not be renewed if the licensee did not, during the previous one year term of the license, purchase at least two thousand dollars of alcoholic or m alt beverages or a com bination thereof from the com m ission or any authorized m alt beverage wholesaler. This subsection shall not apply to: (a) Any licensee having a planned but not physically functional building pursuant to subsection A(4) of this section; (b) Holders of special perm its issued under Part 2, Article VII. W HEREAS, the W yom ing Legislature has am ended the state statute to elim inate the age restrictions regarding persons who are perm itted to enter and rem ain in a building licensed to sell alcoholic or m alt beverages; and W HEREAS, the City of Evanston desires to am end Section 4-33 of the City Code in response to the am endm ent of state law; and W HEREAS, the City has received input from som e of the liquor dealers of the com m unity about allowing under-age persons to rem ain in their licensed prem ises; NO W , THEREFO RE, BE IT O RDAINED BY THE G OVERNING BODY O F T H E C ITY O F EVANSTON, W YO M ING THAT: Section 2. Section 4-33 of the Evanston City Code is hereby am ended and reenacted to provide as follows: Sec. 4-33. Persons under age Twenty-one years prohibited in dispensing building; exceptions; penalty. A. No licensee or agent, em ployee or servant thereof shall knowingly perm it any person under the age of twenty-one years to enter or rem ain in a licensed building except as set forth below: (1) Bars and Taverns. W here the licensed establishm ent prim arily sells alcoholic or m alt beverages for on-prem ise consum ption, persons under the age of twenty one shall be perm itted in a dining, seating, or waiting area or restaurant no later than 11:00 p.m . N o person under the age of twenty one shall be perm itted to sit at a bar from which m alt or alcoholic beverages are sold or dispensed at any tim e in the licensed building; (2) Liquor Stores. W here the licensed establishm ent prim arily sells alcoholic or m alt beverages for off-prem ise consum ption, persons under the age of twenty one shall be perm itted in the licensed building if they are accom panied by parent or legal guardian who is at least twenty-one years of age. (3) G rocery, retail and convenience stores. W here the licensed establishm ent sells alcoholic or m alt beverages for off-prem ise consum ption, but prim arily sells other retail goods, the establishm ent shall m aintain a separate room for the display of alcoholic and m alt beverages. Persons under the age of twenty one shall not be perm itted in the room where the alcoholic and m alt beverages are displayed for sale unless they are accom panied by parent or legal guardian who is at least twenty-one years of age. Paym ent for the sale of the alcoholic and m alt beverages m ay take place at a register located outside of the room . B. O nly Em ployees of the above-described establishm ents, who are a least eighteen years of age shall be perm itted to work in the sale, display and serving of alcoholic or m alt beverages. C . Any person violating this section, or aiding abetting or inciting any violation thereof is guilty of a m isdem eanor and, upon conviction, will be fined not m ore than seven hundred fifty dollars or im prisoned not m ore that six m onths or both. W HEREAS, the City has a need for software and other related services for the point of sale it uses at the Purple Sage M unicipal G olf Course; and W HEREAS, the City of Evanston and EZLinks G olf LLC have negotiated an Agreem ent and Addendum whereby EZLinks G olf LLC will provide the software and other services as set forth in the Agreem ent and Addendum which is attached hereto; NO W , THEREFO RE, BE IT RESO LVED BY THE G O VERNING BODY O F THE CITY O F EVANSTO N, W YO M ING THAT: Section 1: The M ayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreem ent and Addendum between the City of Evanston and EZLinks G olf LLC, a copy of which is attached hereto, to provide software and services for the point of sale at the Purple Sage M unicipal G olf Course.
