EVANSTON CITY COUNCIL First Regular M eeting October 3, 2017 The official record of proceedings of the first regular m eeting of the Evanston City Council for the m onth of October was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Mayor W illiam s led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. W HEREAS, funds are available from the W yom ing Association of Sheriffs and Chiefs of Police which are to be used to reduce underage drinking of alcohol within the com m unity; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yom ing as follows: Section 1. RESO LUTIO N 16-66: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING AMENDING AND REENACTING SUBSECTION (e) of SECTION 5-1 OF ARTICLE V OF THE PERSONNEL POLICY MANUAL BY ADDING SUBPART (6) TO REQUIRE TUITIO N REIMBURSEMENT BY AN EMPLOYEE IN CERTAIN CIRCUMSTANCES. W HEREAS, the governing body desires to am end Subsection (e) of Section 5-1 of Article V of the Personnel Policy Manual by adding subpart (6) to require tuition reim bursem ent by an em ployee to the City in certain circum stances; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yom ing as follows: Section 1. Subsection (e) of Section 5-1 of Article V of the Personnel Policy Manual of the City of Evanston is hereby am ended by adding subpart (6) and is reenacted to read as follows: Section 5-1 EM PLOYEE EDUCATION, JOB TRAINING AND CERTIFICATION (e) Attendance for educational courses will be on the em ployee's own tim e and does not qualify for an excused absence. Should a required course be scheduled during working hours only, em ployees m ay arrange with their supervisor for tim e off to attend the course and m ake up the lost tim e during the sam e week. These adm inistrative guidelines apply: (1) Em ployees m ust com plete the educational reimbursem ent form and obtain Departm ent Head and Mayor approval prior to actual course enrollm ent (2) Courses m ust be satisfactorily com pleted while the em ployee is on the payroll. (3) The City will reim burse 80% of books, tuition and required fees. If other financial sources are available the City will pay the unpaid balance not to exceed 80% of the total. (4) Em ployees m ust earn the equivalent of a C grade and provide docum entation of grade and expenses. (5) Reim bursem ent for educational expenses m ay require tax withholding as required by the IRS. (6) If an em ployee resigns or is term inated before receiving a grade, the em ployee will not be reim bursed for tuition or book expenses. If an em ployee resigns or is term inated within two years of receiving a reim bursem ent, the em ployee shall repay the City the full am ount reim bursed. RESOLUTION 17-67: A RESOLUTION OF THE CITY O F EVANSTON, W YOMING AMENDING AND REENACTING SUBSECTION (l) of SECTION 1-3 OF ARTICLE I OF THE PERSONNEL POLICY MANUAL BY AMENDING SUBPART (2) TO ALLOW EMPLOYEES TO ACCUMULATE 60 HOURS IN COMPENSATORY TIME. W HEREAS, the governing body desires to am end Subsection (l) of Section 1-3 of Article I of the Personnel Policy Manual by am ending subpart (2) to allow em ployees to accum ulate 60 hours in com pensatory tim e; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yom ing as follows: Section 1. Subsection (l) of Section 1-3 of Article I of the Personnel Policy Manual of the City of Evanston is hereby am ended and reenacted to read as follows: Section 1-3 EM PLOYM ENT POLICY (l) Overtim e  (1) For tim e worked over forty (40) hours In a week or 80 hours per 14 day work period for Police em ployees, all em ployees whose positions are determ ined eligible by the City Council, will be com pensated at one and one-half (1-1/2) tim es their norm al hourly rate either in the form of m onetary pay or com pensatory tim e off subject to the following conditions: (i) All overtim e worked m ust be given proper authorization, and; (ii) Records of all overtim e worked m ust be kept by Departm ent Heads with copies to the accounting payroll clerk. (2) Accum ulated com pensatory tim e will be lim ited to sixty (60) hours per em ployee. Additional com pensatory tim e m ust be used by the last pay period in the fiscal year in which it was accrued or receive m onetary pay in lieu of. (3) The decision to give the em ployee m onetary pay or com pensatory tim e subject to subpart (1) above shall be at the sole discretion of the Departm ent Head. (4) An em ployee m ay request use of com pensatory tim e in hourly increm ents provided such requests do not interfere with the departm ent’s needs. TO PROVIDE A PHASE 1 ENVIRONMENTAL SITE ASSESSMENT OF THE PROPERTY LOCATED AT 187 BEAR RIVER DRIVE. W HEREAS, Prem ium Oil Com pany has proposed donating to the City the real property located at 187, Bear River Drive, Evanston, W yom ing; W HEREAS, the City of Evanston has a need to establish a baseline of the environm ental conditions existing on the real property before accepting the donation; and W HEREAS, Terracon Consultants, Inc. has subm itted a Proposal, to the City of Evanston to provide a Phase 1 Environm ental Site Assessm ent of the real property; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is authorized to execute and the City Clerk attest the attached Proposal and Agreem ent with Terracon Consultants Inc. to provide a Phase 1 Environm ental Site Assessm ent of the property located at 187 Bear River Drive. RESOLUTION 17-71: RESOLUTION OF THE CITY OF EVANSTON AUTHORIZING THE EXECUTION OF CUSTOMER INSTALLATION AGREEMENTS W ITH ROCKY MOUNTAIN POW ER TO INSTALL MORE ENERGY EFFICIENT LIGHTING IN CERTAIN CITY BUILDINGS. W HEREAS, there is potential energy savings if the City were to increase the energy efficiency of the lighting used in city buildings; and W HEREAS, Rocky Mountain Power is willing to extend to the city incentives to encourage the energy saving conversion, as set forth in the attached Custom er Installation Agreem ents; NOW , THEREFORE, BE IT RESOLVED BY THE GO VERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor and City Clerk are authorized to sign and attest the attached Custom er Installation Agreem ents with Rocky Mountain Power to increase the energy efficiency of lighting used in city buildings as set forth in the attached agreem ents.  PASSED, APPROVED AND ADOPTED the 3 rd day of October, 2017. ___________________________ Kent H. RESOLUTION 17-72: A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON APPROVING CHANGE ORDER NO. 006 FOR THE EVANSTON RAILYARDS ROUNDHOUSE W INDOW S AND MASONRY PROJECT IN THE CITY OF EVANSTON. W HEREAS, the City of Evanston has previously authorized the Evanston Railyards Roundhouse W indows and Masonry Project which is being constructed by North Ridge Construction; and W HEREAS, the governing body has determ ined that it is in the public’s interest to approve Change Order No. 006 for the reasons set forth therein; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yom ing, as follows: Section 1. Change Order No. 006 for the Evanston Railyards Roundhouse W indows and M asonry Project, a copy of which is attached hereto, is approved. Section 2. The Mayor is authorized to approve Change Order No. 006 on behalf of the City. PASSED, APPROVED AND ADOPTED the 3 rd day of October, 2017. ___________________________ Kent H.
