EVANSTON CITY COUNCIL First Regular Meeting November 5, 2019 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Scott Ehlers; Senior Planner, DuWayne Jacobsen; and Police Lieutenant, Ken Pearson. Police Chief, Jon Kirby was excused. A group of interested citizens were also present. Approve Agenda Councilmember D. Welling moved, Councilmember M. Welling seconded, to approve the agenda. Council Comments Councilmember Sellers thanked the Public Works Department for their help with water leaks by the Aspen Grove Town Homes. He also wished the EHS Swim Team good luck at the state swim meet. Mayor Williams commented that the Holiday’s are quickly approaching and encouraged everyone to participate in the upcoming events. Ordinance 19-08 Councilmember D. Welling moved, Councilmember M. Welling seconded, to pass Ordinance 19-08 on second reading. ORDINANCE 19-08: AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM MEDIUM DENSITY RESIDENTIAL-DEVELOPING AND PUBLIC TO MEDIUM DENSITY RESIDENTIAL-DEVELOPING, AS REQUESTED BY THE CITY OF EVANSTON AS OWNER OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN. The motion to pass Ordinance 19-08 on second reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 19-09 Councilmember Perkes sponsored Ordinance 19-09. Councilmember Lynch moved, Councilmember D. Welling seconded, to pass Ordinance 19-09 on first reading. ORDINANCE 19-09: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTIONS 6-12 AND 6-13 AND REPEALING SECTIONS 6-2, 6-3, 6-4, 6-5, 6-6, 6-9, 6-11 AND 6-15 OF CHAPTER 6, BICYCLES, OF THE EVANSTON CITY CODE TO UPDATE THE ORDINANCES REGARDING THE OPERATION OF A BICYCLE WITHIN THE CITY LIMITS. The motion to pass Ordinance 19-09 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 19-10 Councilmember Ottley sponsored Ordinance 19-10. Councilmember Lynch moved, Councilmember Perkes seconded, to pass Ordinance 19-10 on first reading. ORDINANCE 19-10: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 17-1.3 OF THE EVANSTON CITY CODE TO ENABLE THE GOVERNING BODY TO ESTABLISH THE HOURS IN WHICH A CITY PARK MAY BE OPEN FOR PUBLIC USE. The motion to pass Ordinance 19-10 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Resolution 19-64 Councilmember Lynch introduced Resolution 19-64. Councilmember Lynch moved, Councilmember M. Welling seconded, to adopt Resolution 19-64. RESOLUTION 19-64: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A SELECTIVE TRAFFIC ENFORCEMENT GRANT FROM THE HIGHWAY SAFETY PROGRAM OF THE WYOMING DEPARTMENT OF TRANSPORTATION. WHEREAS, grant funds are available from the Highway Safety Program of the Wyoming Department of Transportation which are to be used by local law enforcement agencies improve traffic safety through increased enforcement; and WHEREAS, it is necessary for the City to execute that attached Grant Agreement in order to receive Selective Traffic Grant funds; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor is authorized to sign the, a Selective Traffic Enforcement Grant from the Highway Safety Program of the Wyoming Department of Transportation, a copy of which is attached hereto. Welling.  Resolution 19-65 Councilmember Sellers introduced Resolution 19-65. Councilmember Sellers moved, Councilmember Ottley seconded, to adopt Resolution 19-65. RESOLUTION 19-65: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH UINTA ENGINEERING & SURVEYING, INC. TO PROVIDE ENGINEERING SERVICES FOR THE CITY VIEW WATER MAIN REPLACEMENT PROJECT-PHASE 2. WHEREAS, the City of Evanston and Forsgren Associates, Inc. have negotiated an agreement whereby Uinta Engineering & Surveying, Inc., will perform the services set forth in the Agreement for the City View Water Main Replacement Project-Phase 2; and WHEREAS, the City of Evanston and Uinta Engineering & Surveying, Inc have set their agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and Uinta Engineering & Surveying, Inc, a copy of which is attached hereto, for engineering services necessary for the City View Water Main Replacement Project-Phase 2. Final Acceptance/Street Overlays Project Councilmember D. Welling moved, Councilmember Sellers seconded, to authorize final acceptance and payment of retainage to Consolidated Paving and Concrete, Inc., for the 2019 Street Overlays Project. Comments/Remarks Scott Ehlers announced that the Golf Course will be open again while the good weather lasts. Public Participation Kayne Pyatt invited everyone to attend the 19th Amendment event on Saturday, November 16th at 6:30 p.m. at the Strand Theater. Local women who have made a difference in our community will be honored..
